An Iowa House member suggested last week that the state Environmental Protection Commission went “beyond the intent of the law” by calling a closed session to discuss a decision related to a hog lot expansion in Poweshiek County. However, a spokesperson for the Iowa Attorney General’s Office suggested that a “contested administrative law case that involves legal briefs, hearings, decisions, appeals” qualifies as a circumstance permitting a closed session under the Iowa Code.

At least 28 eagles died from lead poisoning in Iowa between September 1, 2011 and April 15, 2012, according to data collected by the non-profit Saving Our Avian Resources. The real figure could be significantly higher, and even this statistic casts doubt on claims that hunting with lead ammunition does no harm to wildlife.

The U.S. Environmental Protection Agency informed the Iowa Department of Natural Resources yesterday that a preliminary report finds the state of Iowa does not adequately enforce the Clean Water Act with respect to confined animal feeding operations (CAFOs).

As a bonus, I’ve included some textbook sleight of hand by the Democratic Congressional Campaign Committee. DCCC press releases hammered Republicans Tom Latham and Steve King for backing “Big Oil” interests during House debate on the Strategic Energy Production Act. But the DCCC glossed over the fact that Latham’s opponent in Iowa’s third district, Representative Leonard Boswell, was one of 19 House Democrats to vote with Republicans for final passage of that very bad bill.  

Iowa Governor Terry Branstad has joined a lawsuit seeking to overturn a U.S. Environmental Protection Agency rule that would gradually reduce mercury and other toxic emissions from power plants. Meanwhile, a group of state attorneys general including Tom Miller of Iowa have asked a U.S. Court of Appeals to uphold the EPA rule.

Governor Terry Branstad’s office confirmed today that former Republican lawmaker Chuck Gipp will be the next director of the Iowa Department of Natural Resources.  

Syngenta Crop Protection Inc. agreed last week to settle a class-action lawsuit out of court rather than go to trial over claims related to the herbicide atrazine. The settlement could help some utilities in Iowa cover the cost of removing the chemical from drinking water.

Farmers have withdrawn an application to build a 5,000-head hog facility in northern Dallas County, amid strong local opposition to the project.

Longer days, warmer weather and the approaching end of the school year mean more time outdoors for many Iowans, especially children. Last week Kamyar Enshayan, a Cedar Falls City Council member and director of the University of Northern Iowa’s Center for Energy and Environmental Education, raised an important question: “Is having weed-free lawn worth it?”

In the final days of the 2011 Iowa legislative session, funding for passenger rail was one of the last disputes House Republican and Senate Democratic negotiators resolved. The final deal called for no passenger rail money in the state budget for fiscal year 2012, but left “intent” language describing future state funding to match federal grants for a train route between Iowa City and Chicago. At that time, news reports indicated that legislators would need to allocate $6.5 million toward passenger rail in fiscal year 2013 to keep this project alive, plus $10 million total in subsequent years.

Before the Iowa House and Senate adjourned last week, I saw no mention of passenger rail funding in any reports about the infrastructure budget for fiscal year 2013, which begins on July 1. Wondering whether no news was bad news, I started asking around. What I learned is after the jump, along with new links on the potential for passenger rail across Iowa.

Governor Terry Branstad signed an executive order today to nullify an administrative rule banning the use of lead ammunition for hunting mourning doves in Iowa. He advanced two contradictory positions: that the Iowa legislature (not the state Natural Resources Commission) should decide whether dove hunters must use alternative ammunition, and that he was compelled to act because the Iowa Senate failed to assert its authority on this important issue.

The Connect the Dots project is organizing a global day of action this Saturday, May 5, to raise awareness about how climate change affects extreme weather around the world. Eight events are scheduled in Iowa (Ames, Cedar Rapids, Davenport, Decorah, Des Moines, Dubuque, Independence, and Iowa City). I’ve posted a press release with the details after the jump.

State Senator Rob Hogg gave every senator a copy of this statement from Iowa faith leaders urging action to combat climate change.

More than 50 religious leaders in Iowa have signed an appeal for “responsible precautionary action to limit global climate change.” I’ve posted below the full statement below with all the signatories, including Catholic Bishops Martin Amos and Richard Pates, United Methodist Bishop Julius Trimble, Lutheran Bishops Michael Burk and Michael Last, and Episcopal Bishop Alan Scarfe.

The faith leaders mention a recent warning to Iowa legislators from 44 scientists representing 28 Iowa colleges and universities. Unfortunately, even when Democrats controlled the state House and Senate, lawmakers did almost nothing to implement the Iowa Climate Change Advisory Council’s recommendations (pdf).

I enclose below State Senator Rob Hogg’s comments on the religious leaders’ statement. He is of the Iowa legislature’s strongest advocates of policies to combat climate change.

On a related note, the 2011 Iowa Farm and Rural Life Poll indicated that 68 percent of Iowa farmers believe climate change is happening, 5 percent do not believe it is happening, and 28 percent are not sure. About 45 percent of that survey’s respondents said human activities are partly or mostly responsible for changing climate patterns.

A senior staffer for the Iowa Farm Bureau Federation confirmed this week that plaintiffs will appeal a Polk County District Court’s ruling dismissing their challenge to an important water quality regulation.

A conference committee of Iowa House and Senate members has yet to determine whether the Iowa legislature will allocate $5 million over two years to rebuild the dam at Lake Delhi in Delaware County. However, it’s already clear that more worthwhile lake restoration projects in Iowa will go without funding next year thanks to money set aside to rebuild the Delhi dam.

A Polk County District Court judge rejected a lawsuit by the Iowa Farm Bureau Federation and two other industry groups seeking to invalidate the most significant water quality regulations adopted in Iowa during the past decade.

Recreation on Iowa rivers generates enough economic activity to support about 6,350 jobs, according to a new study by Iowa State University’s Center for Agricultural and Rural Development.

Unfortunately, a new report by Environment Iowa indicates that this state’s rivers are among the country’s most polluted waterways.

In a step forward for small-scale wind power in Iowa, the Iowa Utilities Board designated Johnson County and Floyd County as our state’s first Small Wind Innovation Zones last week.

The Iowa legislature’s second “funnel” deadline passed on Friday, which means that most non-appropriations bills are dead unless they have been approved in one chamber and in at least one committee in the other chamber. It’s time to catch up on the most significant bills being debated in the Iowa House and Senate.

The Iowa Environmental Council is one of 11 plaintiffs in two lawsuits filed today to challenge inaction by the U.S. Environmental Protection Agency. The legal actions are aimed at forcing the EPA “to address the nitrogen and phosphorous pollution degrading water quality in Iowa, the Mississippi River Basin, and the Gulf of Mexico, where this pollution causes the Dead Zone.”  

Governor Terry Branstad and Iowa Attorney General Tom Miller both joined a brief filed today by seven Midwestern states that oppose California’s Low Carbon-Fuel Standard. Branstad was eager to “take a stand for Iowa farmers against [an] unconstitutional California law,” as a press release put it.

It’s not every day that a governor who has praised strict constructionists and “the philosophy of judicial restraint” cheers for the Ninth Circuit U.S. Court of Appeals to keep an injunction on (and eventually strike down) a state law.

Expanding nuclear power is again a hot topic at the Iowa statehouse. It’s not clear whether Iowa Senate Commerce Committee Chair Matt McCoy can find the votes he needs to advance House File 561. McCoy announced last week that new language in the bill would protect consumers and satisfy a majority of his committee members. However, opponents say the changes address only one of many problems in a bill that would primarily benefit MidAmerican Energy at the expense of its ratepayers. McCoy was forced to delay consideration of House File 561 on March 8, but he is expected to bring up the bill before his committee sometime this week–if he has the votes.

The Iowa delegation split on party lines yesterday over a bill designed to give California farms more access to water in the San Joaquin Valley. The bill would overturn Obama administration regulations designed to protect endangered fish populations.

The U.S. House approved a bill last night that would encourage more offshore oil drilling and force the Obama administration to approve the Keystone XL pipeline. Although Leonard Boswell (IA-03) has talked about getting tough on oil companies for the past year, he was one of 21 House Democrats who joined most Republicans in supporting the “drill here, drill now” crowd’s wish list.  

The League of Conservation Voters released its National Environmental Scorecard yesterday, based on 11 U.S. Senate votes and 35 U.S. House votes during 2011.

Iowa Rivers Revival announced today that Charles City won its 2011 “Iowa River Town of the Year” award. The non-profit organization, created to advocate for protecting Iowa rivers and streams, honored the Floyd County seat because city leaders “responded to record floods in 1999 and 2008 by embracing the Cedar River with new ideas and bold projects, such as transforming a low-head dam into Iowa’s first whitewater kayak course and installing the state’s largest permeable paving system.” A press release describing Charles City’s river projects in more detail is after the jump. Iowa Rivers Revival previously recognized Webster City (2007), Elkader (2008), Coon Rapids (2009) and Cedar Falls (2010) as River Town of the Year. The Democratic Congressional Campaign Committee signaled this week that it is willing to spend additional resources supporting Christie Vilsack’s campaign against Representative Steve King in Iowa’s fourth Congressional district.

Several environmental groups are mobilizing against $5 million in proposed state funding to rebuild the Lake Delhi dam on the Maquoketa River in Delaware County.

President Barack Obama announced today that his administration is rejecting the application for the Keystone XL Pipeline, which would take oil sands from Alberta, Canada to the Gulf Coast of the U.S. In a statement I’ve posted after the jump, the president blamed Congressional Republicans, who attached a “rushed and arbitrary deadline” for the Keystone decision to the temporary payroll tax cut extension bill in December.

Obama’s decision takes the pipeline off the table for now. House Republicans may look for ways to override the administration’s decision, but the Democratic-controlled Senate is unlikely to approve such legislation this year. However, all bets are off after the 2012 elections. TransCanada may resubmit its application after finding a different route through Nebraska.  

By this summer, I predict that “Keystone” will be a household word in the U.S., as Republicans and corporate-funded groups blame Obama’s decision for rising gasoline prices and continued high unemployment. Environmental groups that have opposed the pipeline have a huge public education task on their hands.

Republican State Senator Merlin Bartz confirmed this week that he will run for re-election in the new Iowa Senate district 26. His race against Democratic incumbent Mary Jo Wilhelm is probably a must-win for Senate Democrats in order to preserve their majority. After the jump I’ve posted a district map. Bleeding Heartland previewed the Bartz/Wilhelm matchup here.

Bartz has given Iowa progressives plenty of reasons to want him gone, from encouraging county recorders to ignore a Supreme Court ruling to trying to block the most significant water quality regulations of the last decade. Bartz’s record is so bad that even learning he “has performed for over 35 years in north and northeast Iowa with various dance bands” didn’t give me any sympathy for the guy. Democrats who live within striking distance of Worth, Mitchell, Floyd, Howard, Chickasaw, Cerro Gordo, or Winneshiek counties have a golden volunteer opportunity here.

I mention this because your January 15 comment on Bartz’s crusade against “obsolete” laws reads a lot like Bleeding Heartland’s post from January 10.  

The U.S. Environmental Protection Agency released a new database yesterday showing 2010 greenhouse gas emissions for large facilities across the country. After the jump I’ve posted the top 10 emitters in Iowa.

Projects in St. Ansgar, Mason City, Dubuque, Guttenberg, Sioux City and Perry were recognized this year as some of the best examples of sustainable development in Iowa.

It’s the season of giving, and the U.S. Environmental Protection Agency just delivered an outstanding present to Americans who breathe air.  

Catching up on news from the weekend, the U.S. House and Senate averted a federal government shutdown by passing an omnibus spending bill for fiscal year 2012, which runs through September 30 of next year. The government had been operating on a continuing spending resolution, which was due to expire on December 17. Details on the last-minute appropriations deal and how the Iowans voted are after the jump, along with comments from some members of the Congressional delegation.

Several Iowa power plants are among the largest emitters of certain toxic heavy metals, according to a new report by the Environmental Integrity Project.

Some bills are designed to solve real problems, some bills are designed to create the appearance of solving real problems, and some bills are designed to solve non-existent problems. The U.S. House passed that third kind of bill yesterday, seeking to block rules the Environmental Protection Agency has not even proposed.

Bruce Braley (IA-01), Dave Loebsack (IA-02), and Leonard Boswell (IA-03) were among the 33 Democrats who voted with Republicans to pass the H.R. 1633, the Farm Dust Regulation Prevention Act of 2011. The Iowa Democrats weren’t all equally supportive during the floor debate, however.

The U.S. House passed yet another bill designed to prevent new federal government rules yesterday. This legislation one was so extreme that only four Democrats voted with Republicans to support it.
