Although Iowa Attorney General Tom Miller hasn’t made any official announcement about plans to seek a ninth term in 2014, he recently previewed what could become central themes of a re-election campaign. Storm Lake Times editor Art Cullen made a splash in the Iowa newspaper world last month with editorials calling for Miller to retire. Cullen cited the attorney general’s position on open records controversies and his alleged efforts to thwart the work of Iowa’s ombudsman. Newspapers including the Des Moines Register and the Des Moines-based weekly Cityview republished Cullen’s case for Miller to step aside and clear the path for “an attorney general for the people.” Des Moines Register columnist Rekha Basu cited several other troubling examples of how Miller has lost his way in recent years.

To defend his work and “set the record straight,” Miller wrote guest editorials for various publications. You can read his specific rebuttals to Cullen here. I was more interested in the list of achievements he cited as proof that “in the last few years,” the Attorney General’s office has “done more than ever to serve Iowans.” It sounds like the kernel of a stump speech or television commercial to me. I’ve posted those excerpts after the jump.

I haven’t heard yet about a Republican challenger to Miller, but I would not be surprised to see his 2010 opponent Brenna Findley take another shot next year. She is currently Governor Terry Branstad’s legal counsel and just completed a six-week stint as the governor’s interim chief of staff.

Most Americans are relieved the federal government will be fully operational again this week, but the short-term deal on the 2014 budget and debt ceiling isn’t popular on the right wing of the Republican base. I got a kick out of this “Tea Party Insult Generator” based on real comments posted to House Speaker John Boehner’s Facebook page.

Of the members of Congress who may run for president in 2016, only Representative Peter King of New York voted yes on the deal to reopen the government (the House roll call is here, and the Senate roll call is here). King isn’t a real contender for the GOP nomination anyway; he would be running for president to send a message.

House Budget Committee Chairman and former Vice Presidential nominee Paul Ryan voted no last night, as did Senators Rand Paul, Marco Rubio, and Ted Cruz. After the jump I’ve posted statements from all of those politicians about the deal. Their talking points will make a good impression on likely Iowa Republican caucus-goers, even if the events of the last few weeks have hurt the GOP on the generic Congressional ballot.

The Central Iowa Building and Construction Trades Council is standing by its endorsement of former State Senator Tony Bisignano in the Democratic primary to represent Iowa Senate district 17. Bisignano is one of three Democrats running for the seat State Senator Jack Hatch is vacating in order to run for governor. Bisignano was recently arrested for driving with a blood alcohol level over the legal limit. Commenting on that arrest, Cityview’s Civic Skinny columnist noted that supporters of Ned Chiodo “think Bisignano should drop out.” Both Chiodo and Bisignano have a political base on the south side of Des Moines. The third candidate, Nathan Blake, lives in the Sherman Hill neighborhood near downtown.

The latest edition of Cityview contains a letter to the editor by Earl Agan Jr., president of the Central Iowa Building and Construction Trades Council. He explains why his group “reaffirmed” its support for Bisignano last week. I’ve posted excerpts from Agan’s letter after the jump.

Any comments about the race in Iowa Senate district 17 are welcome in this thread. The winner of the Democratic primary is almost certain to succeed Hatch in the Senate. As of October 2013, Senate district 17 contained 16,943 registered Democrats, 7,179 Republicans, and 11,256 no-party voters.

The U.S. Senate and House voted tonight to fund the federal government through mid-January 2014 and raise the debt ceiling by enough to last until early February. Here’s the bullet-point version of the deal Senate Majority Leader Harry Reid negotiated with Minority Leader Mitch McConnell. In classic Congressional fashion, senators loaded this must-pass bill with a bunch of goodies. A new House and Senate conference committee will negotiate over the federal budget for fiscal year 2014, and that committee must reach some agreement by December 13. The big sticking point will be whether to fund the government at levels approved for fiscal year 2013 before the “sequester” cuts went into effect in January.

Tonight the Senate approved the deal first by 81 votes to 18. All the Democrats, including Iowa’s Tom Harkin, and most Senate Republicans supported the deal to reopen the government. Our state’s senior Senator Chuck Grassley was one of the 18 no votes.

House Speaker John Boehner reluctantly agreed to put the bipartisan Senate agreement up for a vote on the House floor. He had wanted to bring up a different bill, but a “stunning rebuke” from GOP colleagues forced him to abandon a House vote yesterday on his latest plan.

The House approved the deal by 285 votes to 144. Every Democrat present voted yes, including Bruce Braley (IA-01) and Dave Loebsack (IA-02). Tom Latham (IA-03) was among 87 Republicans who also voted yes. Steve King (IA-04) was one of the 144 House Republicans who voted no. He has long demanded that “Obamacare” be defunded as a condition of funding the federal government, and he does not believe that the U.S. faced a real risk of default if Congress failed to raise the debt ceiling by October 17.

I enclose below some Iowa reaction to today’s events. I will update this post as needed.  

Today Tom Rubel became the second Democrat to enter the race in Iowa Senate district 41, a strong pickup opportunity in 2014. First-term Republican State Senator Mark Chelgren currently represents the district, covering the population centers of Wapello and Jefferson counties, plus all of Davis and Van Buren counties. I’ve posted a map after the jump. According to the Iowa Secretary of State’s office, Senate district 41 contained 15,169 registered Democrats, 11,558 Republicans, and 13,698 no-party voters as of October 2013.

Rubel is a former superintendent of the Ottumwa Community School District and is now executive dean of Regional Economic Advancement at Indian Hills Community College. More background is in his campaign announcement, which I’ve also posted below. He is the second Wapello County-based Democrat to enter this race. Wapello County Supervisor Steve Siegel kicked off his campaign in September. Ed Malloy, the mayor of Fairfield in Jefferson County, is considering this race too. Presumably Malloy would have a better chance in a primary against two people splitting the Ottumwa vote.

All Congressional candidates had to file third-quarter fundraising reports with the Federal Election Commission by October 15. After the jump I’ve posted details on the fundraising by Iowa’s candidates for U.S. House.

The Senate reports are not online yet at the Federal Election Commission’s website, so those numbers will come later.

Two weeks into the partial federal government shutdown, U.S. Senate leaders appear close to a deal to reopen the government and raise the debt ceiling while a new joint budget committee negotiates “a replacement for the automatic spending cuts known as sequestration.” After the jump I’ve posted details on last week’s Congressional votes related to funding the federal government and preventing a possible default.

Although Iowa is reportedly the state least affected by the shutdown, because we lack national parks and have few military facilities, thousands of Iowans in the National Guard are still without paychecks. Thousands more who receive benefits through the Women, Infants and Children nutrition program will suffer if the shutdown extends into next month, because WIC is only funded through October.

The lack of a new farm bill arguably affects more Iowans directly than the shutdown does. The latest temporary extension of federal farm programs expired on September 30. At the end of this post, I’ve included some news and comments on efforts to pass a comprehensive farm bill.

In July 2011, State Representative Walt Rogers endorsed former U.S. Senator Rick Santorum for president. Today Santorum returned the favor by announcing that he and his Patriot Voices PAC support Rogers’ campaign for the open seat in Iowa’s first Congressional district. I’ve posted Santorum’s full endorsement after the jump.

When Rogers formed his exploratory committee last month, he said several fellow Iowa House Republicans had encouraged him to run for Congress. A few days ago, the Rogers campaign rolled out endorsements from four current and three former Republican lawmakers whose districts include parts of IA-01. I enclose that statement below as well. Former Congressman Tom Tauke is also backing Rogers’ current campaign. Tauke represented parts of northeast Iowa in the U.S. House before losing the 1990 U.S. Senate race to Tom Harkin.

Any comments about the IA-01 race are welcome in this thread. Besides Rogers, Rod Blum and Steve Rathje are seeking the GOP nomination. Former Iowa Secretary of State Paul Pate is expected to announce his campaign soon, and former State Representative Renee Schulte has said she is considering the race.  

Imagine you own a business.  There’s a knock on the door.  It’s the government, and they’re here to help.  “We’re going to give everyone enough money to buy your product.  We’re not going to make anyone buy it, but it won’t cost them anything if they do.  Your profit is going grow 20%, but we’re going to take half of the new profit so we can afford to pay people to buy it.  But you get to keep the rest.

That’s essentially what happened with the Affordable Care Act (ACA) with respect to Medical Device Manufacturers (MDM).  MDM’s started paying a 2.3% excise tax on the sale of their wares in January 2013.  The logic behind the compromise was as simple as the opening scenario.  Prior to ACA, 30 million to 50 million people were either uninsured or uninsurable.  As a practical matter, people without insurance go without hip and knee replacements and similar procedures.  They just limp.

While there may well be more knee replacements, there will be many more people with insurance, and virtually everyone will have access to insurance if they need it.

Now the winds are shifting.  Tea Party Republicans, ostensibly opposed to deficit spending, have shut down the government and are threatening to cause the first credit default in US history.  In a particularly ironic twist, a compromise is emerging, most recently championed by Sen. Susan Collins, a Republican from Maine, to repeal the tax on MDMs.

In other words, the government will be greatly expanding the market and increasing the profits of MDMs, but will not ask for anything in return for that expanded market.  The result will be an increase in the deficit of $30 billion over the next 10 years.

I’ve been catching up on news related to the Iowa Supreme Court. On October 9 the seven justices heard oral arguments in two cases at the Fort Dodge Middle School auditorium. One of those cases was Iowa Farm Bureau, et al. v. Environmental Protection Commission, et al. Interest groups representing major water polluting industries in Iowa are seeking to overturn one of the most significant water quality protection rules this state has adopted during my lifetime. In March 2012, a Polk County District Court judge declared the legal challenge to the rule “without merit.” The Farm Bureau quickly signaled its intent to appeal, claiming the case was about “good government” rather than water quality.

The Iowa Supreme Court will likely announce a decision in this case sometime early next year. Ryan Koopmans noted recently at the On Brief blog that the justices have cleared what used to be a major backlog and are running an efficient operation.

On average, the Court issues a decision 112 days after final submission (which is usually triggered by oral argument).  But even that figure understates the Court’s efficiency.   There is a small subset of cases that, because of their complexity or other unusual factors, skew the average, which means that the median might give a better picture of the Court’s timeliness.  That’s 87 days between final submission and decision, which is relatively fast.

The Court is even faster when the situation calls for it.  In February, the Court issued a decision in In re Whalen-a case about a burial location- just 29 days after the scheduled oral argument.  And the  Court has made it a priority to respond quickly to certified questions from federal district courts.

Incidentally, last week’s session in Fort Dodge is part of the Iowa Supreme Court’s relatively new commitment to hear cases outside its chambers in Des Moines periodically. The effort was one response to the 2010 retention elections, the first ever in which voters chose not to retain Iowa Supreme Court justices. University of Iowa College of Law professor Todd Pettys cited those hearings around the state as one among many reasons that the 2012 vote to retain Justice David Wiggins turned out differently from the elections two years earlier. You can download Pettys’ paper for the Journal of Appellate Practice and Process here. While it’s probably healthy for the justices to work in other cities from time to time, I think the other factors Pettys discusses were far more important in 2012 than the court’s statewide tour.

At the end of Pettys’ paper, he discusses the future for the Varnum v Brien ruling, which cleared the way for same-sex marriages in Iowa in 2009. Commenting on a somewhat surprising “special concurrence” by Justices Edward Mansfield and Thomas Waterman in a different case related to marriage equality, Pettys suggests that perhaps “the Iowa Supreme Court is no longer of one mind about whether the Varnum Court was right to hold that the Iowa Constitution grants same-sex couples the right to marry.”

State Senator Jack Hatch’s campaign released a list of prominent Iowa endorsers today, including eight-term U.S. Representative Leonard Boswell, eight Iowa Senate Democrats (Dennis Black, Joe Bolkcom, Tom Courtney, Dick Dearden, Matt McCoy, Steve Sodders, Joe Seng, and Rich Taylor), and six Iowa House Democrats (Ako Abdul-Samad, Marti Anderson, John Forbes, Ruth Ann Gaines, Bruce Hunger, and Frank Wood). Several of those lawmakers stood with Hatch during his statewide tour last month to announce his candidacy. Others had not taken a public stand in the governor’s race before today, to my knowledge.

I’ve posted the Hatch campaign’s press release after the jump. Boswell and several of the endorsers cited Hatch’s experience and record of legislative accomplishments, themes I expect to hear repeatedly during the next eight months. Hatch’s main Democratic primary competition, State Representative Tyler Olson, has support from more than two dozen state lawmakers but doesn’t have nearly as much legislative experience. Nor is he known for doing the heavy lifting on many bills that have become law.

This comment from Senator Tom Courtney jumped out at me from today’s press release: “Anyone can floor manage a bill passed out of another chamber or sign on as a co-sponsor to an existing bill, but Jack has shown real leadership throughout his time in public service – creating new ideas, finding allies, drafting legislation, and fighting to see it succeed in the legislative process.” I read that as a subtle swipe at Olson, because his major legislative accomplishment was floor-managing the public smoking ban in 2008–a cause initially pushed by other legislators, including Janet Petersen and Staci Appel. Highlighting Hatch’s “new ideas” is also an implicit rebuttal to Olson’s promise to provide “fresh leadership” for the next 30 years.

Kevin Hall reported for The Iowa Republican blog yesterday that a fourth candidate is planning to seek the GOP nomination in the open Iowa House district 91. Republican State Representative Mark Lofgren is vacating the seat to run for Congress against four-term Democratic incumbent Dave Loebsack. It’s a swing district where President Barack Obama outpolled Mitt Romney in the 2012 election, even as Lofgren was re-elected.

Hall provided some background on Gary Carlson:

Carlson is an executive with HNI, the parent company of HON Furniture in Muscatine. HNI is a global company, with 10,000 employees. Prior to being a vice-president at HNI, Carlson was the president and CEO of the Muscatine Chamber of Commerce. He also served as the vice-president at the Bandag Corporation, where he managed Bandag operations in Europe, the Middle East, and Africa from 1974-1997.

I wonder whether all three other declared GOP candidates in House district 91 (Emily Lofgren, Mark LeRette, and Mark Cisneros) will follow through before the filing deadline next March. So far only one Democratic candidate has announced in the district, John Dabeet.

Speaking of Mark Lofgren, I find it pathetic that ten days into the federal government shutdown, he’s said nothing about the situation on his Congressional campaign website, twitter feed, or Facebook page. Most of the Iowans running for Congress have given some idea of whether they favor a “clean” continuing spending resolution to fund the federal government, or whether they would insist on conditions such as defunding/delaying the 2010 health care reform law. Lofgren is doing lit drops and attending Republican fundraisers, but he has nothing to say to a wider audience about the most important job of Congress: passing a budget. If Mariannette Miller-Meeks takes another shot at IA-02 (and I think she will), I hope she destroys Lofgren in the primary. She crushed three GOP rivals in 2010 before losing the general election to Loebsack.

UPDATE: Bleeding Heartland user Columcille points out in the comments that Emily Lofgren dropped out of the House district 91 race on October 11. She says she will focus on getting her father elected to Congress. Lofgren ran her father’s 2010 Iowa House campaign against a Democratic incumbent.

I am notoriously bad at distinguishing the yellow asters of late summer, but as far as I know, I have enclosed several pictures of Jerusalem artichoke after the jump. The surefire way to confirm the ID would have been to dig around the plant looking for tasty and healthful potato-like tubers, but I didn’t want to disturb any soil on public land. I hope some native plants experts in the Bleeding Heartland community will correct me if I have featured the wrong wildflower.

President Barack Obama finally settled on Janet Yellen to succeed Ben Bernanke as the next chair of the Federal Reserve. No woman has previously held that position, nor has any previous nominee for the job been as qualified as Yellen. Binyamin Appelbaum’s profile of Yellen for the New York Times is excellent. Some other good links about her views are here. She is commonly described as an “inflation dove,” meaning that in her opinion, reducing unemployment should be a higher priority than keeping inflation low (the traditional obsession of Fed chairs). A few years ago, Bleeding Heartland user PrairieBreezeCheeze discussed why it’s time for a Fed chair willing to prioritize employment. Even now, long-term unemployment is still near historically high levels.

Nobody’s perfect, and Zach Carter offers a more negative take on Yellen, focusing on her support for NAFTA, a chained Consumer Price Index, and repealing the Glass-Steagall Act during the 1990s. Nevertheless, Yellen is a much better person to run the Fed than Obama’s first choice for the job, Larry Summers. Credit goes to the coalition that came out early against Summers, convincing five Democrats on the Senate Banking Committee to oppose him.

Despite today’s news, President Obama’s record on appointing women to cabinet-level positions remains worse than Bill Clinton’s–and not for lack of qualified women to choose from.

Last month Wapello County Supervisor Steve Siegel announced plans to run against first-term Republican Mark Chelgren, a surprise winner in the 2010 wave. Given the tilt of this Senate district, I’ve been wondering whether a Jefferson County-based Democrat might take a shot at this race too.

Former State Senator Becky Schmitz, now a Jefferson County supervisor, told me yesterday that she has ruled out running in Senate district 41 next year. She made that choice when she decided to run for supervisor last year.

Another name that has come up in conversations with Jefferson County Democrats is Ed Malloy. He served two terms on the Fairfield City Council before being elected mayor in 2001. He has since been re-elected twice and is seeking a fourth term this year. Msn.com named him one of the 15 greenest mayors in the country in 2009. Malloy also serves on the Fairfield Area Chamber of Commerce Board of Directors and has been a trustee of the Maharishi University of Management.

Speaking to me by telephone yesterday, Malloy said he is interested in serving in the Iowa Senate and is considering becoming a candidate in Senate district 41. He is now focused on his re-election campaign for mayor but will give the Senate race serious thought after the local elections on November 5.

Without question, this past week was good for the future of the Iowa caucuses. State Senator Kent Sorenson was pressured to resign after a special investigator found probable cause that he lied about evading Iowa Senate rules against being paid by presidential campaigns. Thanks to improved coordination between the Republican Party of Iowa and Iowa Democratic Party, the 2014 off-year caucuses will be held simultaneously, as usual. Both developments should take ammunition away from critics who point to potential cheating during the Iowa caucus process.

Now it’s up to Iowa lawmakers to prevent corruption or the appearance of corruption from undermining our state’s role during the 2016 presidential race.  

Governor Terry Branstad signed a proclamation today setting the special election to fill Iowa Senate district 13 for Tuesday, November 19. Republican State Senator Kent Sorenson resigned last week after special investigator Mark Weinhardt delivered an exhaustive report about Sorenson’s alleged malfeasance to the Iowa Senate.

I highly recommend looking through Weinhardt’s report (here are links to volume 1 and part 2). It astounds me that Sorenson is posturing as the victim of a “straight-up political witch hunt.” Exhibit 12 in this part of Weinhardt’s report summarizes an interview with Susan Geddes, who managed Sorenson’s Iowa House campaign in 2008 and Iowa Senate campaign in 2010. She repeatedly warned Sorenson that he could not be paid by the Michele Bachmann’s presidential campaign under Iowa Senate rules, and that the truth would catch up with him.

Republican blogger Craig Robinson discussed “winners and losers” in the Sorenson ordeal here. I largely agree with his list, but I would put Senate Minority leader Bill Dix in the loser category, as well as Senate Ethics Committee Republicans Jack Whitver and Jerry Behn. If they’d had their way, Weinhardt would never have been appointed to look into Sorenson’s wrongdoing. Speaking of ethics, it is customary to link to a blog post when you mention it. Robinson referred to, but failed to link to, this Bleeding Heartland post about the legal problems of Sorenson’s attorney, Ted Sporer.

Former Iowa House Democrat Mark Davitt announced today that he will run in the Senate district 13 special election. I’ve posted his press release after the jump. Davitt was born in Madison County and represented most of Warren County in the Iowa House for three terms before losing his seat to Sorenson in 2008. Republican State Representative Julian Garrett is running, but I expect at least one other person to seek the Republican nomination for the special election.

I enclosed a map of Senate district 13 after the jump. As of October 1, the district contained 13,293 registered Democrats, 15,013 Republicans, and 15,909 no-party voters.

New surveys by Public Policy Polling indicate slight leads for an unnamed Democratic candidate against Republican incumbents Tom Latham (IA-03) and Steve King (IA-04). The generic Democrat’s lead over Latham increased after respondents were told Latham “supported the government shutdown.”

The latest episode to divide Iowa Republicans is a warning from Republican Party of Iowa officials in response to planned traffic safety checkpoints in Polk County. After the jump I’ve posted more details on that story.

Having grown up during the 1980s, when “card-carrying member of the ACLU” was a term of abuse Republicans used against liberals, I’m still floored whenever Republicans actually care about potential encroachment on civil liberties by law enforcement officials.

That’s far from the most mind-blowing political reality of our day, though. Just for fun, at the end of this post I put up a non-scientific poll for any Bleeding Heartland readers, but especially those “of a certain age.” Think back 20 to 25 years and ask yourself, what reality of 2013 would be most shocking?

Two-term Iowa House Republican Julian Garrett told WHO-TV’s Dave Price yesterday that he plans to seek the GOP nomination for the special election in Iowa Senate district 13. The seat is vacant because of Kent Sorenson’s resignation. A date for the nominating convention will be set sometime after Governor Terry Branstad announces the special election date.

I’ve posted Garrett’s official bio after the jump. I knew he was a retired attorney but didn’t realize that he is a former assistant Iowa attorney general for consumer protection. The current holder of that position, Nathan Blake, is seeking the Democratic nomination in Iowa Senate district 17.

I expect at least one other candidate to seek the Republican nomination in Senate district 13, where the GOP has a voter registration advantage. Garrett represents Madison County and parts of Warren County in the Iowa House already, but unlike Kent Sorenson, he’s never been wildly popular among the GOP’s tea party or “liberty” factions. Party central committee delegates from the precincts in the district will choose a nominee, and the Warren County Republican activists have not favored mainstream candidates lately. Warren County was one of the strongest performers for Bob Vander Plaats in the 2010 Republican gubernatorial primary, and way out there Steve McCoy easily defeated Carlisle Mayor Ruth Randleman in the 2012 primary to represent House district 26. McCoy later lost the general election to Democrat Scott Ourth.

I wouldn’t be surprised to see McCoy take a shot at Senate district 13. Another possible candidate is Warren County GOP Chair Ricky Halvorson. He was active in Sorenson’s previous successful campaigns and made the Des Moines Register’s “50 Most Wanted” list of Republican activists in 2011.

UPDATE: Added more comments from Garrett below. I agree with him that this seat is a must-hold for Republicans if they want to win a Senate majority in 2014.
