Here we go again.

If the University of Iowa and Iowa attorney general’s office get their way, a legacy gift from a grateful and accomplished graduate will no longer help students like him.

The graduate, Ezra L. Totton, was an esteemed chemist during the latter half of the 20th century. One chapter in his great American success story was written in the chemistry building at the University of Iowa in the 1940s.

Totton’s story deserves retelling because he was at the center of a recent Iowa Supreme Court decision.

Here’s betting District Judge Adria Kester does not read the Aspen Daily News. That Colorado newspaper’s front-page slogan declares, “If you don’t want it printed, don’t let it happen.”

What happened to Judge Kester occurred outside of her usual venue — the 22 courthouses of north-central and northwest Iowa where, until recently, she served as chief judge of the Second Judicial District.

It happened when that Boone County resident found herself on the other side of the law, as a criminal defendant.

Now, she is keeping the story alive by filing a civil lawsuit seeking special treatment she likely did not accord to those who appeared before her.

Because of his intimidating style, the legendary 1950s baseball pitcher Sal Maglie was known as “The Barber.” His brush-back pitches came sooooo close batters felt as if they were getting a shave.

Considering his nickname, it’s probably best that “The Barber” is no longer with us, lest he find himself in hot water if he made a cameo appearance at the College World Series in Omaha.

In a seemingly unrelated note, the Orpheum Theater in Omaha might want to rethink any plan to reprise last October’s performances of the opera, “The Barber of Seville,” especially if it intends again to picture Figaro on stage with a barber pole. 

Similarly, my friend Kurt should remain in Iowa, because if he ever moved to Wahoo or Ogallala, the barber chair in his family room could raise eyebrows of Nebraska officials.

At the risk of blurring the increasingly fuzzy line between church and state, here is a Gospel reading for public employees and elected officials, according to Matthew: 

“But blessed are your eyes, for they see; and your ears, for they hear.”

Unfortunately, it does not take much looking these days to see government leaders bedeviled by lousy optics. Perhaps it is a lack of vision or just a refusal to listen.

Either way, these officials are doing and saying things that leave the taxpayers who pay their salaries perplexed.

Come July, Iowa employers may want to add an ominous warning on their job application forms: tell a lie and you could go to jail.

That’s right — no more puffing the resume with false degrees from the University of Okoboji or Faber College. 

And do not claim to have chauffeur’s license when you lack the permit needed to drive a truck.

The offices of the Des Moines Register’s opinion staff were mostly empty when my telephone rang late one afternoon about fifteen years ago.

The guard at the lobby security desk said two men were there and hoped I had time to meet with them. I said sure and invited them up to our office on the fourth floor.

Within minutes, the Rev. Jesse Jackson and his driver emerged from the elevator. They were on their way to Waterloo. But Jackson wanted to detour to the Register, just to talk about some concerns on his mind.

City leaders in Des Moines are making it difficult to understand why they selected the current police chief, considering how they have imposed a code of silence about their recent $975,000 payout to one of the candidates who did not get the job.

The payout and, even worse, the sealed lips are just another example of how common sense and good government suffer whenever public officials refuse to detail how and why they spend taxpayer money.

This textbook example of misplaced priorities began in 2024 when Des Moines Police Chief Dana Wingert announced his retirement after nearly a decade leading the department.

We all need reminders now and then.

Some of us believe there is only one correct way to think and speak and act in these United States of America. But that is not true.

Americans are not who we are because we are the same. Americans are who we are, and our nation has long been a shining beacon, because we are all different and were brought together by that freedom to be different.

It’s funny how a government body can learn and teach an important civics lesson in the time it takes a student to go from kindergarten through 12th grade.

In 2012, the Atlantic Community School District won a lawsuit to keep information secret about disciplinary measures taken against two employees who conducted a strip-search of five girls to try to find $100 another student reported missing.

Iowa Supreme Court Chief Justice Mark Cady wrote a dissent in the case, noting that “transparency in government surely will be thwarted” by those who can “quell public discourse and end controversies over employee misconduct with no public scrutiny by simply announcing discipline has been imposed.”

January ended with a notable week for federal courts because of the voices of its judges.

Judges in Minnesota and Texas spoke with clarity in these troubled times. In between them, a longtime Iowa federal judge’s voice fell silent after a quarter century of delivering justice, along with lessons in compassion, fairness and our shared history.

Robert W. Pratt was 78 when he died. The Emmetsburg native was a U.S. district judge in the Southern District of Iowa from 1997 to 2023.

Pratt began his legal career working for Iowa Legal Aid, a nonprofit law firm that champions society’s underdogs and gives a voice to those who rarely are heard in our society.

The 2025 college football season is in the history books.

The season ended with a national championship victory by Heisman Trophy winner Fernando Mendoza and his Indiana University Hoosiers over the University of Miami.

The season began back on August 23 in Dublin, Ireland, matching Iowa State University against Kansas State University in the Aer Lingus College Football Classic.

A lot has happened since the Cyclones’ 24-21 victory.

Iowa State President Wendy Wintersteen retired. The Iowa Board of Regents screened a bunch of candidates and hired North Dakota State University President David Cook to replace her.

Cyclone coach Matt Campbell resigned after Penn State University lured him away to take over its football program. That same day, Iowa State announced he would be replaced by Jimmy Rogers from Washington State University.

Yet, in the five months since the football season started, Iowa State still has not provided me with financial records I requested on September 4 concerning the Ireland trip and the Aer Lingus game.

It was Christmas Eve. The gifts were laid beneath the Christmas tree at the home of Merlin and Nelda Powers in Urbandale.

But the family’s holiday celebration ended abruptly that day in 1968 when the Powers’ 10-year-old daughter Pamela disappeared from the YMCA in downtown Des Moines while the family attended her brother’s wrestling meet.

Two days passed before the family received the horrible answer to their “where is Pamela” question. Police located the girl’s body in a roadside ditch just off Interstate Highway 80 near Mitchellville.

Days removed from the winter solstice, when Iowa’s nights are the longest, we have another example of the absence of sunshine in Iowa government. And this example shows why the state legislature has much to do about openness and accountability when it convenes on January 12.

A recent court decision with ties to the collapse in May 2023 of an apartment building in Davenport highlights the urgent need for legislative action. The case involves more than the public’s right to know, considering that three people died in the collapse and rescue workers needed to amputate a survivor’s leg to free her from the rubble.

What makes freedom of speech so difficult to understand and accept?

That question came up during a recent discussion at the Des Moines Valley Friends Meeting. The Friends invited me to speak at the gathering that coincided with the 50th anniversary of the December 15, 1975 bombing of the Friends meeting house and the adjacent American Friends Service Committee building at 42nd Street and Grand Avenue in Des Moines.

Police never located the bomber, so no criminal charges were filed. Consensus remains that someone planted the explosives who disliked the Quakers’ and AFSC’s opposition to the Vietnam war, their support of non-violence, and their humanitarian relief efforts in Vietnam after the war.

I reminded the audience of what Mary Autenrieth of Paullina, the chair of the AFSC’s regional policy board 50 years ago, told The Des Moines Register then: “I expect in a nation where open disagreement is encouraged, there are some who disagree with us. But I would expect that they would not use violence in answer.”

There seems to be a lack of consistency—if not outright contradictions—in President Donald Trump’s approach to drug trafficking into the United States.

While the text of the Iowa Constitution lacks the prominence of that adopted by our nation’s Founders, people from Ackley to Zwingle and points in between should track down a copy and give it a read. 

Buried away in the document Iowa voters adopted in 1857, they will find Article III, Section 31, or what has come to be known as the public purpose requirement. That section says, in essence, that state and local governments are barred from spending public money unless there is a public purpose for those expenditures.

My public-school education tells me that section prohibits the use of taxpayer money to continue to pay someone for work after their performance ends unless the government entity provides justification of the public purpose served by those payments.

Where I come from, going-away gifts do not serve a public purpose. And this brings me to the Des Moines Public Schools and recent news headlines.

Recent events in Chicago, Washington, D.C., and at Sacred Heart Cathedral in Davenport provide stark reminders that our nation’s leaders have seemingly forgotten a biblical command around for the ages.

It is one Robert Ray followed during his tenure as Iowa governor, which ended some 42 years ago.

Ray was front of mind as I digested the news last week. His service contrasted with the haunting picture the three easily missed events presented of who we are as Americans and who we are becoming.

As Iowans headed to the polls this week to elect local school board members, they faced an issue beyond the usual ones of taxes, student achievement, teacher pay, curriculum and enrollment.

This year, school board and administrators’ performance and trustworthiness were front and center in some school districts. And on that, for voters, it is what they do not know that might hurt them.

Not surprisingly these days, free speech on college campuses is back in the headlines.

That makes it worthwhile to highlight the seven-page policy the Iowa Board of Regents wrote to proclaim how it values and protects freedom of expression at the three state universities.

The nation’s founders got right to the point when they laid out how to treat the First Amendment freedoms of religion, speech, the press and the rights of people to assemble and to petition the government. They used only 45 words, without asterisks.

Their simple words should lead to simple conclusions. Yet, recent Iowa cases illustrate why people in general, and educators specifically, are perplexed about what is protected and what is not.

The lesson of the hot stove emerged again last week.

That is the lesson toddlers learn early and smart ones retain for a lifetime. Touch something hot and you know not to touch it again.

Educator Ian Roberts delivered a new rendition of the lesson over the past fortnight. Time will tell whether government officials take to heart the learning moment offered by the Roberts train wreck.

I spoke to two groups in recent weeks, and at both gatherings, people wanted to know about the work of the organization I lead, the Iowa Freedom of Information Council.

If I had known then what I know now, I could have been more effective. I could have advised them to wait a week or two and watch the news surrounding the arrest of Ian Roberts, superintendent of the Des Moines Public Schools since 2023, for an illustration of how secrecy breeds distrust.

Government regulates business to protect the health, safety, and welfare of the public. That is the theory behind enacting and enforcing regulations, and it is a commendable mission.

But, too often the regulators seemingly do not want the people they are supposed to protect to know which businesses fall short of the minimum expectations spelled out by these regulations. The regulators seemingly do not want people to know when and how businesses fail to meet the baseline standards.

Each time that happens, the mission of government regulations fails the public.

Lyman Dillon resides in the dusty recesses of Iowa history for his role in 1839 in one of Iowa’s earliest infrastructure projects.

Dillon’s work also figures indirectly in a modern-day lesson on how not to run a government.

This how-not-to-do-it tutorial occurred earlier this month during a Jones County Board of Supervisors meeting. A similar lesson is playing out in Storm Lake to a growing audience of discontented residents there.

One of the frustrations of being a former newspaper editor is no longer having a few dozen reporters to pursue answers to questions going unasked and unanswered each day.

Two of my go-to questions were “why?” and “why not?” And my favorite open-ended query to a newsmaker was “explain this to me.”

I never believed newsmakers owed me answers to the questions I or my reporters asked. I was curious by nature. But the most important purpose, I sometimes reminded reluctant newsmakers, was the thirst for information John Q. Public and Jane A. Citizen had about the topics at hand.

All of this is a preamble to help you understand why I am a frustrated consumer of news and information now that I no longer lead a team of information gatherers.

My family has called Davis County home for 185 years, all the way back to when William D. Evans and William Henson climbed down from their wagons in 1839 and 1840, a half-dozen years before Iowa became a state.

Evanses, Hensons, and their neighbors were on the town square in Bloomfield in 1877 when the cornerstone was nudged into place in the new county courthouse. Construction of the grand stone building with its soaring clock tower was a testament by those pioneers that this part of rural America, and the new county seat town, needed a home for local government and a fitting gathering space for meetings, speeches, elections and other civic events.

Voters demonstrated their faith in their local leaders when they authorized the building’s construction. The price tag came to about $60,000—the equivalent of about $2 million in today’s money.

Andy McKean is a charming country lawyer from Anamosa. He grew up in New York and was drawn to Iowa by his family roots.

He has owned a bed-and-breakfast, called square dances and played in a dance band named the Scotch Grove Pioneers. His tenure in the Iowa Legislature stretched for nearly 30 years, with an additional eight years shoehorned in as a Jones County supervisor.

A few weeks ago, McKean spoke to a group of grassroots community organizers from eastern Iowa who gathered in Monticello to brainstorm. He provided pointers gleaned from his years in public service, politics, campaigning, promising and compromising.

One choice nugget was his go-to strategy in those roles—listening more than talking.

One longtime truism of journalism is “Names make news.” 

That shorthand stems from the fact people better understand the significance and context of news when they learn about events and issues through the eyes and experiences of people they know or with whom they can identify.

The late Iowa Supreme Court Justice Mark McCormick described the importance of this news tenet by noting how disclosing even sensitive private facts and names offers “a personalized frame of reference to which the reader could relate, fostering perception and understanding” and lends “specificity and credibility.”

Several dozen people gathered in Monticello on June 21 for a citizen workshop the Grassroots Iowa Network organized to get more everyday Iowans engaged in the political process.

They spent the day listening to speakers (including me) and exchanging ideas and observations, without fear or reprisal. They lunched and learned.

Former officeholders and current office-seekers were there, too. So were people who have spent countless hours working on issues or on behalf of candidates.

People living in central Iowa received a wake-up call last week that should drag water quality back in front of the state’s 3.2 million residents.

Iowa’s largest water supplier, which serves a fifth of the state’s homes and businesses, ordered its 600,000 customers to immediately reduce water demand by ending lawn-watering and cutting use in other ways.

Such orders typically come during persistent drought when water supplies are short. This time, water is plentiful. But Central Iowa Water Works is struggling to remove enough nitrates to make its water safe for human consumption.

This is not just a Des Moines area problem. This is an all-of-Iowa problem.

Jane Austen’s Pride and Prejudice focused on manners and goodness, two virtues sometimes forgotten today.

Shortly before the novel was published, our Founding Fathers settled on the free exchange of ideas as one of the fundamental concepts they wanted to guarantee in the First Amendment to the U.S. Constitution.

But in 2025, an uncomfortable tug-of-war is occurring over pride and prejudice, expression and oppression.

If an opinionated old guy from southern Iowa delivered the recent commencement address at the United States Military Academy, my message would have contrasted with the one given by another opinionated old guy, one from Queens, New York, by way of the White House.

When I was a newspaper editor, I sometimes told the staff they needed to run a belt sander across an article to remove rough spots before publication. So it was with President Donald Trump’s speech to 1,000 new Army second lieutenants at West Point in May. His staff needed to take the Oval Office belt sander to his message.

Last week, the Pentagon accepted the emir of Qatar’s gift of a Boeing 747, a $400 million bauble donated for our president to enjoy by a monarch whose family has ruled the tiny Mideast nation for more than a century.

Our commander in chief said the United States would be stupid to reject the donation—a present he hopes to use as a temporary replacement for Air Force One. The key word there: a temporary replacement.

Controversy clouds this gift for a couple of reasons. And Iowa’s public gift law—which deals with freebies much less ostentatious than the Qatari jet—provides important context on the controversy.

The Iowa Supreme Court gave citizen engagement and accessibility to public meetings a much-needed boost on May 16 when ruling on an appeal of a lawsuit against the Iowa City Community School District.

The district’s practice of posting full videos of school board meetings on the internet for on-demand public viewing was at the heart of the case.

You may be experiencing whiplash this spring just trying to track the Iowa legislature’s zigzag movements. It comes from what some might charitably call a lack of consistency on a key theme.

Soon, Iowans may learn important lessons about “executive privilege” claims by the governor and whether they provide her any cover to keep staff documents in her office secret.

These teachable moments arise from two lawsuits filed within hours of each other on April 25.

As we approach the second anniversary of a tragedy that shocked the people of Davenport and brought national attention to the issue of building safety, government secrecy continues to cloud public understanding of just what happened and who to hold accountable.

The tragedy occurred a few minutes before 5 p.m. on Sunday, May 28, 2023, when the back wall of a Davenport apartment building gave way, bringing down much of the six-story residence that occupied a quarter block across the street from City Hall.

A constitutional showdown taking shape in southern Iowa’s Decatur County could put taxpayers on the hook financially to defend the county’s efforts to silence a critic of public officials there.

The Institute for Justice, a national nonprofit law firm, wrote to Decatur County Attorney Alan Wilson last week expressing its concerns about Wilson’s recent threat to Rita Audlehelm that she could be sued for defamation for her comments in a letter to the editor published in the Leon Journal-Reporter.

Growing up in the 1950s, Evans family vacations seem typical by rural Midwest standards: car trips to the Ozarks, the Black Hills, Nauvoo and New Salem in Illinois, or St. Louis for a Cardinals baseball game.

But one memorable summer trip, around 1960, occurred when we motored north through Minnesota to Canada, the only foreign country my parents ever visited and a place more exotic than the Wisconsin Dells.

As President Donald Trump, red-state governors, and legislators elevate the stress and anxiety in higher education by seeking to change how U.S. colleges and universities operate and what they teach, the contrast between how an Ivy League school and an Iowa university responded shows the courage gap among college leaders.

Iowa taxpayers provided about $104 million last school year directly to parents choosing to send their K-12 children to private schools. 

The price tag for these Education Savings Accounts, commonly known as school vouchers, is expected to climb to $294 million this school year as more families become eligible. During the 2025-2026 school year, when income eligibility standards are removed, the cost is expected to reach $344 million, the nonpartisan Legislative Services Agency estimates.

When Thomas Jefferson, James Madison, John Adams, and others discussed the need for a Bill of Rights to the U.S. Constitution, Decatur County, Iowa, was still a half century off in the future.

Now, 236 years later, the county’s top law enforcement official needs a refresher on the intent of the 45 words the Founding Fathers settled on when drafting the First Amendment.

County Attorney Alan Wilson ought to review three of the five fundamental freedoms the First Amendment protects: the freedoms of speech, of the press, and to petition the government for a “redress of grievances.”

Exercising those rights is exactly what Rita Audlehelm of Van Wert did in a letter to the editor the Leon Journal-Reporter published on February 5.

Iowa Attorney General Brenna Bird again tried to put herself in the national spotlight last week as leader of a group of Republican attorneys general who fixed their sights on Costco over the warehouse retailer’s diversity, equity, and inclusion (DEI) policies.

The state attorneys sent a stern warning letter telling the company, “We … urge Costco to end all unlawful discrimination imposed by the company through diversity, equity and inclusion (“DEI”) policies. … Costco should treat every person equally and based on their merit, rather than based on divisive and discriminatory DEI practices.”

I was in Eagle Grove last week. Like many travelers in Iowa, I stopped at Casey’s before leaving town.

Eagle Grove is a meatpacking community, and many jobs are held by Hispanic men and women. As I waited with my coffee in the check-out line, I was behind a Hispanic man whose hands showed his labors had taken a rougher toll than my life’s work at a computer has taken on mine.

A convenience store in the middle of America is not a place where one typically pauses to reflect on a church sermon given three days earlier at the National Cathedral in Washington, D.C.

Governor Terry Branstad was frustrated eight years ago with what he believed was the inability of officials to tell the public why a government employee was fired or resigned under pressure.

In 2017, the first year of the Republican trifecta, Branstad shepherded through the legislature a bill overhauling public sector collective bargaining, which also included important new language in the public records law. It brought needed transparency and accountability to state and local government. No longer would “no comment” be an acceptable response when a journalist or interested citizen asked why the school superintendent, or a local police officer, or some other government employee was pushed out.

But a case now pending before the Iowa Public Information Board has the potential to reinforce Branstad’s and the legislature’s wisdom — or to weaken this important tool.

I have been kicking myself since being reminded that procrastination comes with a price.

This lesson arrived the week before Christmas when I spotted a small obituary in the Bloomfield Democrat. Seven succinct paragraphs informed readers of the death of Titus Wagler, 66, a longtime Davis County business owner.

In 1997, Wagler and relatives began Midwest Truss Co., a small manufacturing operation whose employees produce wooden trusses for builders in southern Iowa and northern Missouri.

For several years, I had been promising myself, and Titus, that I would drop by “soon” for coffee and conversation. Unfortunately, “soon” kept getting delayed—because of work, because of the weather, because of other distractions … because … because … because.

When it comes to freedom of religion and the rights enshrined in the 45 words of the First Amendment, the devil is in the details in Iowa.

Governor Kim Reynolds’ administration recently revoked permission for the Satanic Temple of Iowa to place a display in the state capitol and host a holiday celebration around it. The Department of Administrative Services and governor’s office claimed the event would harm minors.

A year ago, the governor took the opposite stance on the Satanic Temple’s holiday display. Although she said it was “absolutely objectionable,” she explained in 2023 why the display was allowed: “In a free society, the best response to objectionable speech is more speech, and I encourage all those of faith to join me in praying over the Capitol and recognizing the nativity scene that will be on display.”

A public policy dispute over plans for about 1,000 miles of carbon dioxide pipeline across Iowa took a concerning turn last week. The pipeline company’s latest tactic demonstrates why Iowa should finally enact an anti-SLAPP statute that has been floating around the legislature for a few years.

Cami Koons reported for Iowa Capital Dispatch that Summit Carbon Solutions, an Ames company co-founded by businessman Bruce Rastetter, sent letters to six opponents of its plans to use eminent domain authority to build the pipeline. With eminent domain, Summit could force landowners along the route to sell easements to the company so it could bury the proposed 2-foot-diameter pipe across their land.

The letters demand the recipients retract what Summit claims are false and defamatory statements the six critics have made and cease making similar comments in the future. The letters warn recipients their statements have “exposed you to significant legal liability.”

Many people would rather get their teeth drilled than discuss economics. If you are one of them, dial up your dentist, because today’s topic probably will make you uncomfortable.

Some politicians like to talk about other countries “stealing” the jobs of American workers. The politicians would have us believe these countries are snatching jobs right from under the noses of unwilling, and unwitting, employers in the United States.

A menswear writer named Derek Guy recently provided an important dose of context for American consumers. The story he told shows politicians have not been completely candid about the economic realities behind this trend.

I was asked to speak this month at the annual conference of the National Freedom of Information Coalition. My remarks boiled down to a simple message: the public needs more information about their governments, not more secrecy from their governments.

I explained a troubling trend I see worming its way through local governments in Iowa. This trend cuts at the heart of the public meeting law that has served our state and its citizens well for 50 years.

Earlier this month, I bumped into an Appanoose County woman I have known for several years. She thanked me and the nonprofit organization I manage for shining the spotlight on the actions of Centerville Community School District leaders.

This mother told me I was responsible for her spending part of a recent evening listening to the recording of a closed meeting of the Centerville school board that had just been made public by order of a judge.

It’s a challenge, but not impossible, to find topics on which Republicans and Democrats share the same view these days. Here’s one: election day means we can all celebrate the end of those infernal television commercials. 

My tolerance for these ads has never been high. One reason is the way their assertions oversimplify the pluses (or the minuses) of one candidate’s or the other’s stand on some issue.

It is not really a surprise, however, because politicians have long claimed they will solve some problem or their opponent is to blame for that problem.

A family acquaintance was on Vice President Dick Cheney’s Secret Service detail during George W. Bush’s presidency. His Christmas photo one year was a portrait of him, his wife and Cheney together at a White House reception.

Back then, the agent entertained us with stories of people lining the streets as Cheney’s motorcade passed. Many greeted the vice president with their middle fingers extended.

Back then, those spectators most likely were Democrats who disagreed with Bush administration policies. Today, such roadside salutes for Cheney probably would be extended by Republicans.

Talk about lousy optics — and I am not referring to out-of-style eyeglasses. Public perception is the topic for today.

A couple of recent news nuggets illustrate in different ways an uncomfortable fact of life in Iowa: too many state and local government officials are not comfortable with the public looking over their shoulders as they perform their official duties.

One case overflowing with irony involves the Des Moines County Board of Supervisors. The other involves State Treasurer Roby Smith.

Thirty-three years ago on a snowy Friday in November, the nightmare of mass school shootings shocked Iowa like it has never been shocked before.

It was 3:40 p.m. A former University of Iowa graduate student with a brilliant scientific mind, and a .38-caliber revolver, walked into a conference room in Van Allen Hall, the home of the university’s renowned Department of Physics and Astronomy.

I have fielded a bunch of emails, text messages and phone calls in the days since the school shooting in Winder, Georgia.

Each one is from Perry, Iowa. Each one had the same question for me and the Iowa Freedom of Information Council. Each one came from a parent, teacher or other concerned person asking, why isn’t the public allowed to read the official findings by state agents about the shooting at Perry High School and Middle School last January 4?

We are in the home stretch of another presidential campaign, and it is important for voters to be alert for the unintended consequences of candidates’ promises.

Office-seekers and their supporters like to portray issues in terms of absolutes—as in, my position is the very best way to address this issue; my opponent’s way is all wrong.

Most of the time, issues are not all black, nor all white. Most of the time, issues involve many shades of gray, meaning there are no simple solutions.

Take illegal immigration, for example.

Here we go again.

Don’t be surprised if there is a hard-fought campaign between now and the November election over a guy named David May. You may not recognize his name. But you will in the weeks to come.

May is the newest member of the Iowa Supreme Court. His name will be on the ballot in November, with voters having the opportunity to weigh in on whether he should be retained as one of the high court’s seven justices.

During the 40 years I was a newspaper editor/manager, I strived to ensure the staff incorporated context into their articles. Sometimes, in a journalistic shorthand, that was described “the Iowa angle.”

If there was a mass murder in Iowa, I would dip into my stash of clippings and find the list of the worst mass killings in Iowa history. That allowed us to give context to the magnitude of the tragedy.

The same with tornadoes and floods. How does the number of deaths compare with the worst of these nightmares we have experienced in the past?

During the Vietnam war, and later during the Gulf wars, we turned to bound desk calendars where we pasted clippings to track the running tally of deaths of Iowa soldiers. 

So, over this past weekend a friend and I pawed through statistics to provide important Iowa context when Belgium’s mixed relay triathlon team pulled out of the Olympic competition in Paris.

For the past couple of years, Republicans often accused President Joe Biden of dodging the media—refusing to sit for extended interviews, declining to be questioned in regular White House press conferences, depriving the public of the opportunity to see how he thinks on his feet and articulates his views.

Critics accused Biden and his staff of avoiding unscripted events because they knew he was not mentally agile enough to keep up with the demands pointed questions bring. The president’s supporters brushed aside those assertions—although Biden’s performance during the recent debate against Donald Trump confirmed their worst anxieties.

I am not here to re-plow that political ground. Instead, I wonder why other political leaders much younger than the 81-year-old president are so reluctant to stand in front of their constituents, and journalists, and answer questions on a variety of topics.

Through the years, Iowa Supreme Court justices typically avoid harsh or overzealous language in their decisions.

That is why two separate dissenting opinions jumped out on June 28, when the court issued its long-anticipated decision on the legislature’s latest attempt to ban nearly all abortions in Iowa.

You know how some memories stick with you for no logical reason? One such memory involves my dad in the 1960s when I was a teenager.

After World War II, my father worked for the City of Bloomfield, eventually becoming operator of the city’s water treatment plant.

Pop graduated from high school on the eve of the Great Depression. His most intense period of book-learning after high school came in the 1960s when Iowa decided to require state licenses for operators of municipal water treatment plants and sewage treatment plants.

After so many years away from the classroom, this was a time of anxiety as Pop prepared for the licensing exam. He attended classes at night and had his nose in textbooks other evenings.

All of this happened about 60 years ago. More recently, a different and far larger contingent of Iowans has been experiencing anxiety over state regulations. This time, the anxious people are angry the government doesn’t address all major pollution problems the same way it approaches water treatment and sewage treatment facilities.

Five months have passed since a 17-year-old Perry High School student walked out of a school bathroom and began shooting toward students who were having breakfast before heading to their classes on the morning of January 4, 2024.

The first details about the tragedy had barely started trickling out when the first questions began. And six months later, most of those questions remain.

Where did Dylan Butler get the guns he used that day?

Who owned the guns?

Did his parents know he had access to the weapons?

Were there any signs before that morning Butler might be thinking about violence? 

Had he been the target of bullying by other students?

Most people go through life never stepping foot inside a courtroom. Most people, that is, except for attorneys, judges, journalists, the few of us chosen to be jurors, and an even more select group, those who are accused of crimes.

If I were talking now with my dear parents, may they rest in peace, I would quickly assure them that my many days spent in courtrooms have been in a professional capacity, not as a defendant trying to avoid the slammer.

As a reporter and later as the boss of reporters, I have had an up-close vantage point to watch our court system as it works. I claim no special expertise. But 50 years in a ringside seat on the judiciary have given me perspective worth sharing.

Here is a tidbit from my years as a newspaper reporter and editor:

I never voted in a primary election, never attended the Iowa caucuses, never stuck a candidate’s sign in my yard, never had a bumper sticker on my car, never signed a petition, never donated to a campaign.

When Sue and I married, she got something more in the deal than my sparkling personality. She knew she could not have any yard signs, because people driving past our home would not know which part of the yard was for her opinions and which was for mine. To eliminate any confusion, there were no yard signs. Period.

You don’t often hear anyone extol the benefits of the COVID-19 pandemic. But I did a few weeks ago—when I stood before the Storm Lake Kiwanis club and talked about government transparency in Iowa.

I did not wade into the debate over masks, social distancing or vaccinations. It was a polite audience, but I was not silly enough to needlessly venture onto that thin ice.

What I said about the pandemic was this: State and local governments embraced, even if grudgingly, the benefits of live-streaming their board meetings during the pandemic so the public could watch from wherever they were.

The events of the past six months in Israel and Gaza have me wishing it were possible to have just one more lunch with a friend who died four years ago.

My friend was Jewish. In today’s vocabulary, he would be called an ardent Zionist. He had little patience for people who disparaged Israel.

But he also was a proponent of dialogue and diplomacy. He never hesitated to call me for lunch after The Des Moines Register’s opinion pages published something he disliked. Our lunchtime conversations and debates were models of civility, even though our discussions often challenged each of us to defend and reconsider our views.

That is why I wish we could have one more lunch to talk about the massacre of 1,200 Israelis and foreign nationals by Hamas terrorists last October 7. I long to discuss Israel’s ongoing military campaign in Gaza, the home of those terrorists who were responsible for October’s bloody attacks.

The Iowa legislature took an important step last week in voting to toughen penalties for state and local officials who violate a key government transparency tool, Iowa’s open meetings law.

Unfortunately, lawmakers’ actions may not be enough to reverse the love for secrecy that too many government boards and councils demonstrate. The latest example comes from Des Moines.

“Unsustainable” is a fascinating word, especially when used in government and politics. Merriam-Webster, the dictionary folks, tell us unsustainable means something cannot be continued or supported. 

But in governmental affairs, that definition sometimes gets changed. Instead of something truly being incapable of continuing, the word often means the person using the term simply does not want that “something” to go forward.

Understanding this distinction can help us better parse the statements our politicians make. Here is a real-life example to illustrate this difference:

City officials in Davenport have managed to accomplish the impossible this year: They have gotten Republicans and Democrats in the state legislature to agree on something.

The two parties have bickered over topics like changes to the Area Education Agencies, liability protection for farm chemical manufacturers, removing gender balance requirements for state boards, and providing state tax money to arm teachers.

But the D’s and R’s came together in the House in February, voting 92-2 to increase the penalties for government officials who violate Iowa’s open meetings law. The bill, House File 2539, also requires a judge to remove a member of a government board who has twice violated the meetings law.

No problem is so big that we can’t run from it—or at least avoid thinking about it. That’s human nature.

There are many concerns that should command our attention but do not. Too often we hope or assume a serious problem will go away or will spare us.

In the aftermath of the COVID-19 pandemic, too many of us discount whatever the scientists tell us—as if the anonymous pundit on social media knows more than the people who have devoted their lives to studying a particular problem.

But there is something else I have come to realize, unfortunately. Government leaders in Iowa have shown little interest in understanding “the Big C”—the widespread presence of cancer in Iowa.

What were they thinking? That is a question I ask myself a lot lately.

Those were the first words out of my mouth when the Manhattan district attorney had to postpone Donald Trump’s New York criminal trial on the alleged hush-money payments to porn star Stormy Daniels — the delay necessitated because government lawyers had dropped the ball.

I muttered those words during several days of court hearings in Georgia into Atlanta prosecutor Fani Willis’ affair with a subordinate prosecutor — the one she chose to lead the criminal case against Trump and a dozen other defendants for trying to undo that state’s 2020 presidential election results.

And those words come to mind about bills the Iowa legislature is considering that would affect criminal cases like those brought against state university athletes for their online wagers on sporting events.

Like many people who call this state home, I have long taken an interest in the careers and achievements of people who got their start in Iowa. 

As a kid, I was fascinated to walk through that two-room cottage in West Branch, knowing a president of the United States, Herbert Hoover, was born there.

Voters have busy lives—families to care for, jobs demanding their attention, bills to worry about. 

So, they can be forgiven if they do not closely track their government leaders’ statements and actions. Sometimes voters may find discrepancies between what politicians say and what they do.

Here is one example:

These days, with political campaigns that seem to go on forever, Iowans may not recognize the significance of what occurred at polling places across the state on November 5, 1968.

Voters approved an amendment to the Iowa Constitution that day, ending the legislature’s practice of meeting only every other year. Biennial sessions had been a fact of civic life in Iowa since statehood 122 years earlier.

The increasing secrecy by Iowa law enforcement and their lawyers about identifying people by name raises important questions underlying public confidence in the critical work of first-responders.

The question deals with whether police can or should refuse to identify persons involved in incidents and crimes. Despite Iowa’s history of openness about crimes and accidents, with increasing frequency public officials refuse to provide names of people who end up in these events, whether as victims or perpetrators.

Like many Iowans, my thoughts have been rather chaotic since the horrible news from Perry High School last week.

The events were so sad and senseless. A 17-year-old student was dead, having shot himself. An 11-year-old sixth-grader, known for his big smile and cheerful outlook, was dead from three gunshot wounds. Seven other students and school employees, including the high school principal, were wounded by the teenager.

Americans are numb to the number and frequency of school shootings and other mass killings. Our leaders appear to be paralyzed. Yes, they express their sadness and concern, but thoughts and prayers are not enough.

We Iowans apparently have been kidding ourselves.

Somehow, as we focus on taxes, water quality and allegations of big-government overreach, as we wrestle with immigration, inflation, drug abuse, school choice and women’s reproductive freedom, and as we contemplate transgender issues, academic freedom, religious rights and free speech on college campuses, Iowa has missed another issue—one that appears to be gaining momentum, and controversy, in some states.

The surprising topic of debate? State flags.

I really should not be surprised by some comments that represent what passes for civic dialogue in Iowa these days. 

The latest example leaves me shaking my head, not just at the events themselves but at the reactions. Mrs. Gentry, my history and government teacher in high school, would be dismayed by intelligent people misunderstanding one of the foundations upon which the United States was established — that foundation being the desire of people for intellectual freedom.

City leaders in Davenport have forgotten that city government there belongs to the people. It does not belong to the folks who were elected to city offices.

This reminder is necessary because of a troubling series of events, unlike any I have seen in five decades of monitoring the goings-on in local governments across Iowa.

The shenanigans should have State Auditor Rob Sand knocking on the doors at City Hall. He should be asking questions on behalf of the tax-paying people of Davenport—because city leaders there are not answering questions from the public or journalists.

A few months ago, I bumped into a former aide to Governor Robert Ray. As we reminisced about the governor, our conversation turned to his nearly daily meetings with journalists.

The aide said yes, those press conferences provided reporters with access to the governor and his comments on issues the state was handling and hearing about from Iowans.

But Ray believed the daily press gatherings had another important benefit, too: Ray could do his job more effectively by listening to the journalists’ questions, the aide said.

This is my favorite time of the year. There is no late-night bombardment from infernal fireworks like there is with the Fourth of July. There is not the pressure of Christmas to choose just the right gift.

With Thanksgiving, it is about enjoying the company of family and friends—and deciding whether to scoop up pumpkin pie, apple, or banana cream. With Thanksgiving, it is a time to reflect on our blessings and to think about others who are not as fortunate.

Back during my years as a newspaper editor, I was always eager for stories that raised our spirits and warmed our hearts. Those stories were a needed antidote to the heartache that seemed too often be in the news.

The need for that antidote now is as great as it ever was. Fortunately, there are plenty of examples of uplifting news if we look for them.

The word for today is optics — but not the kind where your eye doctor is an expert.

Instead of eyeglasses, I am thinking about the kind of optics that result when the perception of some person’s or some institution’s values are contradicted by the reality of the actions they take.

The Marshalltown Public Library provided an example of poor optics.

Veterans Day is around the corner. For John and Bob, the day will be for remembering the men and women who serve in the United States military—and two service members, in particular. 

For John, it will be his son, Robert, a Marine lieutenant who will forever be 29 years old. For Bob, it will be his father, Karl, forever the face on treasured family photographs of a handsome 26-year-old Army captain.

John and Bob are patriots through and through. They are not big-government fanatics. They have something else in common, too. They both believe the American people should never forget the ultimate sacrifice paid by members of the U.S. military, and that is a reason they are disappointed with a decision made by the government they love.

They believe the federal government has made a terrible, insensitive mistake by walking away from a pledge to the families of our war dead after World War II—to make it convenient for Gold Star families to remember their 234,000 loved ones who are interred or commemorated in 26 military cemeteries and memorials in more than a dozen foreign countries.

The rationale behind Iowa’s professional licensing laws is simple: People in certain professions and skilled occupations are required to hold state licenses to work in Iowa. The purpose is to ensure they meet the minimum standard of training and skill necessary to serve consumers safely and effectively.

But a state policy change leads me to wonder whether government officials have lost sight of their obligation to act in the best interests of the public. If officials follow through with the new policy in the coming months, then state legislators should step in next year and correct this ill-conceived decision—and concerned citizens should encourage their lawmakers stick up for the public.

For many years, an Iowa State University political science professor and I met several times a year for coffee and conversation.

During our coffee klatches, I probed my friend’s thinking on world affairs, on government issues, and on politics in Iowa and across the United States. I suspect he tried to use these get-togethers to give me a something of a graduate-level seminar in American government, absent any lectures. 

Educators these days are frequently accused of trying to indoctrinate their students with a particular point of view. But what I came to realize during those sessions at the Stomping Grounds coffee shop in Ames was fundamental to excellence in teaching: The professor did not tell me what to think. He tried to get me to think more clearly and to analyze with more sophistication and depth. He helped me spot weaknesses in my own opinions and develop a better understanding of factors that may lead other people to see things differently than I did.

After retiring, my friend sold his acreage and left Iowa for a more scenic place to live. Our caffeine intake has declined, but we still stay in touch via email. Last week, the professor’s Stomping Grounds “student” field-tested the professor’s method of posing challenging questions to get people to re-examine their own opinions and see why some people have a different view than other people.

Back where I came from, you do not expect to have a bomb-sniffing dog circle your car when you pull into the parking lot for Sunday church services.

But that is what occurred. After the dog’s sensitive nose checked our car, a man on the front step gave us a quick once-over with his hand-held metal detector. Then an usher directed my wife, our youngest daughter and me into a pew in the second row of the sanctuary of the simple brick building with a thin spire. 

Of course, until that day in April 2011 I had never been to church when a former president of the United States was teaching the Sunday School lesson. It is easy to become flummoxed—even for an editor who has conversed with presidents and quizzed many wannabe’s—when Jimmy Carter and Rosalynn Carter slide into the pew beside you.

Many decades ago, Mrs. Gentry and Mr. Halferty put up with an inquisitive kid’s classroom questions about American democracy and the workings of government.

I did not imagine back then how the meaning of some words could take on such importance in government. Take, for example, a much-talked-about word in Iowa last week, vexatious. It means abrasive, aggravating, annoying, irritating or nettlesome.

Whether you vote for Democrats, Republicans or Whigs, everyone should have access to government records that are not confidential. That is a way for you to understand what your state and local government is doing.

Iowa is about as far removed from an ocean as you can get. But this state figures in recent news reports about the U.S. Navy—and not in a puff-up-our-chest-with-pride way.

One of the reports was a New York Times examination of the Navy’s largest ship-building budget in history, $32 billion this year alone, and the tug-of-war that pot of money has created inside the seagoing service.

Campaigning for public office is no picnic. Day after day there are speeches, Q&A’s, interviews and the constant need to think before you speak.

Candidates eat enough chicken to have Colonel Sanders clucking approval. But for those who speak before engaging their brains, there other item on the menu often is crow.

The miscues are not the sole province of one party’s candidates to the exclusion of the other’s. Ask 2016 presidential candidate Hillary Clinton about that “basket of deplorables.” Ask 2022 U.S. Senate candidate Abby Finkenauer if she now wishes she had chosen a different way to express displeasure with a judge’s ruling on a challenge to her nomination papers.

In recent days, Florida Governor Ron DeSantis pledged that if elected president, he will send United States military forces into Mexico to deal with the drug cartels “on day one.”

There were more disclosures in recent days in the ongoing saga involving the ethical standards of justices on the U.S. Supreme Court—or, more accurately, the lack of ethical standards.

With each new disclosure about our nation’s highest court, the reputations of Iowa Supreme Court justices take on more luster—and deservedly so.

Deanna Mahoney was like countless Iowa women through the years. She nurtured three children. She worked outside the home to supplement the family income. She loved bowling and mushroom hunting.

That is how she lived.

How she died tells us so much about the way some business owners, and too many government leaders in Iowa, have pushed aside their legal, moral and humanitarian obligations, especially to vulnerable Iowans.

Silly me. I thought I had been paying attention to the issues about which Iowans feel strongly.

You know, things like inflation, taxes, government spending, the war in Ukraine, a new farm bill, water quality, immigration, the federal debt. Those sorts of issues.

But I have spaced off a vital issue in the minds of some in Congress—an issue that apparently has been flying under the radar of Iowans. That issue is aliens from another world.

While Joe and Jane Iowan were fretting last week about drought and the effect of oppressive heat on crops, livestock, and humans, some members of the U.S. House of Representatives gathered in a hearing room on Capitol Hill.

Around the time the famous movie “The Bridges of Madison County” premiered in 1995, author Robert James Waller was at a book-signing in West Des Moines. Between scribbling his signature for fans on copies of his novel, Waller answered questions from a Des Moines Register reporter.

At one point, the persnickety Iowan became peeved by the nature of the reporter’s questions. He yanked the notebook from her hand and flipped it aside. 

That led to a letter to the editor a few days later in the Register in which a reader observed that Waller should use some of his millions in book and movie royalties to buy himself a thicker skin.

Some local government officials in Iowa show signs of needing thicker skins, too, because they have tried to silence critics at meetings of city councils and school boards for making comments they did not like.

One of the photographs of my father that I clearly remember appeared on the pages of the Bloomfield Democrat about 60 years ago.

Pop was standing chest-deep in a hole that had been hastily dug in the street on the Bloomfield city square. His face was grim. There was urgent work to be done, because much of Bloomfield was without water. 

An underground main had broken a block from the city’s water tower. Water was gushing into the street and flooding basements of nearby businesses. 

There, in that hole with water pooled at his ankles, Pop shoveled muck and mud to expose the leaking pipe so it could be repaired.

My late friend Paul was a fine Des Moines teacher. I wish the Evans girls had him for history and government. 

Judging from his ability to entertain me with descriptions of his interactions with students, parents and administrators, I am confident he could make the Peloponnesian War come alive for his history students and hold their attention.

If I live to be 100, I will never forget him relating anecdotes from parent-teacher conferences. He described one student sitting next to Mom, listening as Paul expressed concern about the kid’s sluggishness many mornings.

Then came the money quote: “You know the rules!” Mom exclaimed, looking her son in the eyes. “There’s no marijuana use on school nights!”

These are challenging times for Iowa’s 327 public school districts. 

They are being watched closely by state officials and lawmakers, by parents and by others in the community. These eyes are looking for signs schools are treading lightly on topics like racial history and sexual orientation or that schools are being distracted from dealing with unruly kids who disrupt other students’ learning.

With this heightened scrutiny, some districts are doing themselves a disservice when they try to keep the public in the dark.

Here’s a real-life example. It illustrates my belief government will never build trust and confidence with its constituents when government leaders engage in secrecy and deception. This episode is also a case study of how a state government board dealing exclusively with transparency issues can be too timid.

Forty-four years ago, the Iowa Supreme Court made an important change in the way the state courts operate, by allowing journalists to bring their cameras and audio recorders inside courtrooms during hearings and trials to better inform the public about noteworthy cases.

Iowa was a pioneer in making its court proceedings more accessible and transparent to those who could not be there in person.

It is long overdue for the federal courts to follow Iowa’s lead and swing open the doors of federal courtrooms across the country to provide similar access. The coming proceedings in Florida in the case of United States of America vs. Donald J. Trump cry out for making this change.
