State Auditor Mary Mosiman continues to defend her failure to ask tough questions as an ex officio member of the board that was supposed to oversee the scandal-plagued Iowa Communications Network.

Mosiman had a spotty attendance record for meetings of the Iowa Telecommunications and Technology Commission, which didn’t notice “misspending, cronyism and self-dealing” at ICN for years. Whistleblowers came forward last summer, prompting a special investigation that led to the firing of three top officials.

During a recent meeting with state lawmakers, Mosiman contended she had no reason to believe the ICN was being mismanaged and indicated she didn’t see her board role as relevant to her job as state auditor. She also revealed she hadn’t been aware that voting members were paid to serve on the technology commission, even though their salaries were written into Iowa Code.

Senate Republicans dropped Senate Study Bill 3197 on February 21, scheduling a subcommittee on the tax plan first thing the following morning and a full Ways and Means Committee to consider the bill shortly after lunch. They had employed a similar shock-and-awe tactic last week to get Senate Study Bill 3193 through the legislature’s “funnel” on the last possible day. That bill, modeled after a Florida law deemed unconstitutional, called for drug testing Medicaid and food assistance (SNAP) recipients, along with quarterly instead of yearly recertification and work requirements.

In opening comments on his tax proposal, Senate Ways and Means Chair Randy Feenstra said SSB 3197 was “bold” and would save Iowans an average of $1,000 in taxes. You can watch the whole meeting on video here.

Senator Pam Jochum, the ranking Democrat on the committee, said she was looking forward to input from EMS and firefighters, among others, since this bill would end deductions. She was also concerned that there was no fiscal impact statement and wanted to be sure it fit the budget. Jochum asked Feenstra if he had any data he could share.

The official Iowa Senate Republican tax plan would repeal the state’s popular Solar Energy Systems tax credit later this year.

Ways and Means Committee Chair Randy Feenstra introduced Senate Study Bill 3197 on February 21 and scheduled a subcommittee meeting on the 130-page bill for 8:00 am the following morning. Sweeping changes to individual and corporate income tax rates could reduce state revenue by more than $1 billion annually, though the details are unclear, because no fiscal analysis is publicly available.

Although the bill would create a new legislative committee to “comprehensively review and evaluate each tax credit” (pages 31-2), it also calls for scaling back or eliminating some tax credits, with the solar incentive the first to go.

How many unscrupulous practices can one member of Congress engage in with one small business in less than two years?

Quite a few, as Ryan Foley showed in a scoop with an incredible lede: “A congressman from Iowa violated House ethics rules by failing to disclose his role in a company that he formed, a mysterious outfit that uses his top federal staffer in a false testimonial promoting its services, an Associated Press review shows.”

In the last few years I have found myself politically active and seem to be trying to make up for years of not having the right to vote and taking it for granted when I did participate. I would like to share where my focus is and relate how I came to feel so intensely about these issues. You never know when you may find your voice, and if it took me until my 50s, so be it.

Doctors affiliated with Mercy Cedar Rapids and The Iowa Clinic are refusing to sign paperwork their patients need to register for the Iowa Department of Public Health’s medical cannabis program. Iowa law requires applicants to obtain their doctor’s signature attesting that the patient has a “qualifying debilitating medical condition.” But the law stipulates that health care practitioners have “no duty to provide” written confirmation of the patient’s diagnosis.

Mercy Cedar Rapids appears to have instructed its 503 physicians not to sign the IDPH paperwork, according to two sources with qualifying conditions, who receive health care at different facilities in that network. Most if not all of the 250-plus health care providers at The Iowa Clinic, a doctor-owned group in the Des Moines area, are also refusing to sign medical cannabis card applications.

Without cooperation from a primary care provider, Iowans cannot start the process of receiving authorization to use cannabidiol legally. The number of patients affected by their health care group’s policies is unknown but potentially large. Mercy Cedar Rapids handled 451,400 outpatient visits last year at offices around Iowa’s second largest metro area. The Iowa Clinic averages 450,000 visits annually, serving about 148,000 unique patients across its central Iowa locations.

There is only one word to use when surveying the damage the Republicans are doing to Iowa and America: depressing. We need to keep our eye on the ball, though, and avoid being diverted into competitive name-calling with Republicans. We need to elect Democrats until we regain a majority at every level of government. In the present crisis, any Democratic victory is a win, no matter how awful the Democrat.

In addition to issuing an “all hands on deck” call to elect Democrats, we should also have a discussion about how we got into this mess of being a minority party at every level of government. We could do worse than look back to a period of history when Democrats were the natural party of government, the half century beginning in 1932.

Iowa’s metropolitan areas are growing, a few quite smartly, but a majority of Iowa’s nonmetropolitan areas are declining, several quite sharply. These changes have implications for the vitality of and outlook for much of rural Iowa. They also have implications for dominant rural political attitudes.

As rural economies and populations transform, so too do their collective public policy preferences. Recent statewide and federal election results show clearly that nonmetropolitan Iowa has become more conservative than its historically-conservative norm. And current indications give us no reason to expect that trend to abate.

Iowa Democrats are in a deep hole, controlling only 20 of the 50 seats in the state Senate and 41 of 100 in the House. On the plus side, strong candidate recruitment and a wave of Republican retirements are giving Democrats plenty of opportunities to pick up House seats. (The 2018 Iowa Senate map is less promising.)

Raising money can be challenging for leaders of a minority party, who don’t call the shots on legislation. Furthermore, Iowa Republicans have a natural advantage, since the policies they promote are often tailored to suit wealthy individuals or corporate interest groups. While money doesn’t always determine campaign outcomes, quite a few Democratic lawmakers and challengers lost in 2016 after being massively outspent on television commercials and direct mail (see here, here, and here for examples).

Yet the latest campaign financial disclosures reveal little sense of urgency among Democratic incumbents who could do much more to help others win competitive districts this November.

After yet another mass murder involving an assault weapon made national news, Senator Chuck Grassley told reporters on February 15, “we have not done a very good job of making sure that people that have mental reasons for not being able to handle a gun getting their name into the FBI files and we need to concentrate on that.” Similarly, Senator Joni Ernst said today that the U.S. needs more “focus” on mental illness, not gun control. (Not that she has any ideas on how to address that problem.)

The talking point is bogus, because people with mental illness aren’t more likely than others to commit violent crimes, and mental illness isn’t any more prevalent in the U.S. than in other countries that experience far fewer mass shootings.

But let’s leave that aside for the moment. A year ago, all of Iowa’s Republicans in Congress voted with their GOP colleagues to overturn “a sensible Obama administration rule designed to stop people with severe mental problems from buying guns.”

With less that three weeks remaining until the Deferred Action for Childhood Arrivals program expires, the U.S. Senate voted today on four immigration proposals. Three of them contained language to protect “DREAMers,” who were brought to this country without authorization as children. No proposal received the 60 votes needed to overcome a filibuster. The only bill to fall short of 50 votes was Senator Chuck Grassley’s legislation, modeled on President Donald Trump’s demands.

Iowa’s senators have talked a good game about the DREAMers, but today Grassley and Joni Ernst rejected bipartisan plans in order to be rubber stamps for the president and immigration hard-liners.

Word to the wise: don’t assign Republican State Senator Dennis Guth any task that involves fact-finding.

The Senate Local Government Committee is set to take up a bill aimed at legalizing discrimination against our LGBTQ friends and neighbors. Such an effort is certainly reprehensible and ought to be soundly defeated. But Senate Study Bill 3171 doesn’t do just that.

The architects of this so-called “Religious Freedom Restoration Act” have created language so vague and broad that it would go far beyond allowing wedding venues, bakeries, or floral shops to refuse service to same-sex couples – the apparent “problem” this bill aims to address, based on subcommittee testimony. The bill would allow people to challenge any law or action of any state or local government on the basis that it infringes on their religious beliefs. The government would then have to satisfy a difficult legal standard to justify that infringement.

Fifty-three years after a Democratic-controlled legislature and Democratic governor abolished the death penalty in Iowa, Republicans lack the support to bring back capital punishment, despite large majorities in both chambers.

Did you know there are 28 million Americans and approximately 430,000 individuals in the state of Iowa who are Deaf or hard of hearing? Did you know that Iowa’s Deaf and hard of hearing children ages 0-5 are not showing up as kindergarten ready due to lack of language acquisition?

The Language Equality & Acquisition for Deaf Kids to be kindergarten ready (LEAD-K) bill is needed because a majority of Deaf and hard of hearing children are academically very far behind when compared with their peers. This is a serious national education concern, which some states are beginning to address. Iowa’s children are no exception, but the State Department of Education has a long way to go to make changes.

Senator Rob Hogg introduced Senate File 2076, and State Representative Art Staed introduced the companion bill, House File 2140. We are writing to correct some misperceptions about this bill, which have been brought to our attention.

“Are you excited to have someone to rally around to send to Des Moines?” former Maryland Governor Martin O’Malley asked a packed room in Clive at the February 12 kickoff for Kenan Judge‘s candidacy in Iowa House district 44. The past and probably future presidential candidate said nothing about his own record during his brief remarks. Later, he explained why he will devote much of 2018 to campaigning for other Democrats.

The Iowa Senate Judiciary Committee has advanced a bill that would ban nearly all abortions after a fetal heartbeat can be detected. Senate Study Bill 3143 is the most extreme anti-abortion bill to clear an Iowa legislative committee in decades. Any physician terminating a pregnancy in the absence of a “medical emergency”–narrowly defined to include only life-threatening conditions–could be charged with a class D felony. All eight Republicans on the panel voted for the legislation, while all five Democrats opposed it. Committee approval on February 12 keeps the bill alive for at least another month, until the second “funnel” deadline on March 16.

Less than a year ago, Senate Judiciary Chair Brad Zaun was disappointed not to have the votes on his committee to advance a “personhood” bill, which declared that life would be protected from the moment of conception. The same eight Republicans who supported the heartbeat bill this week served on Judiciary during the 2017 session.

Which minds changed is not clear, nor is it apparent whether the bill will gain final approval in either chamber. Not every bill that comes out of committee receives a vote in the full Senate. Republican leaders blocked an effort to force a floor vote on personhood last year.

However, the shift among at least two Republicans on Judiciary suggests that GOP leaders may feel pressure to fire up the social conservative base.

The subcommittee hearing on Senate Study Bill 3093 was scheduled for room 315 on the south side of the capitol. Although it is a good-sized room, and the temperature was 15 degrees outside on February 1, lobbyists were packed in like sardines, and it was suffocating. Iowa Senate Commerce Committee vice chair Senator Michael Breitbach joked before the meeting, “if anyone passes out you can just lean on” the people crammed in next to them.

It would not be an exaggeration to say there were sixty people in that room. Seventy five even. SSB 3093 has more than a hundred lobbyist declarations already.

Committee chair Jake Chapman was late; you could hear the groans when someone said he was getting on the elevator and would be a few minutes. Chapman was seated and vice chair Breitbach was running the meeting. He said we would go through the legislation by section and would be considering only objections, because of time constraints. That suggested lobbyists backing the bill would keep quiet. It was also a clue that a trap was being set.

A majority of Iowans think mental health services, student loan debt, child welfare services, state university tuition, and the state budget are either a “crisis” or a “big problem” for Iowa, according to the latest Selzer poll for the Des Moines Register and Mediacom. Among nine issues tested in the survey of 801 Iowa adults in late January, mental health services registered as the top concern: 35 percent of respondents described the situation as a crisis, 38 percent as a big problem. No other topic registered above 20 percent for “crisis.”
