The American Civil Liberties Union of Iowa, Planned Parenthood of the Heartland, and the Iowa City-based Emma Goldman Clinic filed suit today to block the new state ban on almost all abortions after a fetal heartbeat can be detected. I enclose below the full statement from the groups and will post the court filing once that document becomes available. The Polk County District Court is certain to put a stay on Senate File 359 (which would have taken effect July 1) while litigation is pending.

Attorney General Tom Miller “has disqualified himself from representing the state” in this case, Solicitor General Jeffrey Thompson informed Iowa’s Executive Council today. Miller took that step after determining “he could not zealously assert the state’s position because of his core belief that the statute, if upheld, would undermine rights and protections for women.” The attorney general recommends that the Executive Council authorize the Thomas More Society to defend the law. That conservative group has offered its legal services at no cost to the state.

Miller’s decision is telling, because a few years ago, the Iowa Attorney General’s office defended the state administrative rule seeking to ban the use of telemedicine to provide medical abortions at Planned Parenthood clinics around the state. The Iowa Supreme Court unanimously found that policy created an “undue burden” for women seeking an abortion. You can read that decision in full here.

Continuing a series on Iowa legislative happenings that attracted little notice while the House and Senate were in session.

State officials will be barred from “any outside employment or activity that requires the person to register under the federal Foreign Agents Registration Act,” under a new law that takes effect on July 1. In addition, applicants for state jobs or nominees for any position that requires Iowa Senate confirmation will have to disclose whether they have ever registered as foreign agents.

Running for office is time-consuming and expensive. Even a local race involves so many tasks, only some of which can be delegated to staff or volunteers. Some political junkies aren’t cut out for knocking thousands of doors, asking supporters for money, and attending community events several nights a week. Others have strong skills, work ethic, and the desire to serve, but can’t see a way to juggle the demands of a campaign with family responsibilities.

Some Iowa candidate has an opportunity to make running for office a more realistic option for them.

Iowa lawmakers went home for the year on May 5. In the coming weeks, Bleeding Heartland will catch up on some of the legislature’s significant work that attracted relatively little attention.

Two proposed state constitutional amendments passed both chambers and could appear on the 2020 general election ballot, if the House and Senate approve them in the same form during either 2019 or 2020.

Three other constitutional amendments cleared one chamber in 2017–in one case unanimously–then stalled in the other chamber as lawmakers completed this two-year session. Those ideas may resurface next year. But since changes to the state constitution must be passed by two consecutively elected legislatures before landing on the general election ballot (the last step in the process), Iowa voters would not be able to ratify those proposals until November 2022 at the earliest.

I have been undecided on who I will support for the Iowa gubernatorial race for a long time. There are just so many great candidates to choose from. There was a point where I was wondering if I would ever be able to choose before election day.

But as this race has gone on, one candidate has stood out from the crowd, and that candidate is John Norris. The first time I met John was at a gubernatorial forum in Des Moines last June. He made a strong impression on me as being an honest and genuine person, who isn’t afraid to tell it like it is.

While controversial issues like abortion and tax reform grabbed the headlines last week, a number of bills impacting education saw last-minute approval before the Iowa House and Senate adjourned for the year on May 5.

The Iowa Department of Human Services “cannot ensure the accuracy, completeness, or reliability” of data released to the public about any programs administered by Iowa Medicaid Enterprise, including the managed-care system for some 600,000 Iowans on Medicaid.

When responding to all requests for information about Medicaid or related programs, the DHS also warns users that “there may be errors, omissions, or inaccuracies in the data provided.” Leading Iowa Senate Democrats were unaware of the disclaimer, which they described as “odd,” “troubling,” and “unacceptable.”

Iowa Supreme Court Justice Bruce Zager will retire effective September 3, he announced late last week. By leaving the bench at the start of the high court’s 2018/2019 term, Zager guarantees that Governor Kim Reynolds will select his successor, regardless of who wins the November election.

One weekend in early April the tourists showed up in town. They were thicker than flies around here. I’ll admit that most of them were here for a new beer release at one of the local breweries, but I also spotted some wild plant tourists tromping around the woods in search of skunk cabbage.

Skunk cabbage is not the first plant to bloom each spring. That award almost always goes to the silver maple trees. And, it is certainly not as cute as the pussy willow buds. So, why are the tourists coming to see skunk cabbage in the mucky swamps around northeastern Iowa?

Republican lawmakers made big promises last year that Iowans would have “more access” to family planning services under a new state program that excluded Planned Parenthood.

As anyone could have foreseen, the opposite was true. In the first nine months of the State Family Planning Program’s existence, the number of Iowans enrolled dropped by a third. The number who obtained at least one reproductive health care service fell by more than 40 percent from the first quarter to the second quarter the program was operating. The number of health care providers billing the program also declined by 40 percent during the same time frame.

Republican lawmakers don’t want to hear how poorly the new system is serving their constituents. Even worse, GOP state senators voted unanimously last week to compound the mistake by blocking Planned Parenthood from participating in sex education programs.

On April 16, members of the LGBTQ community lost one of our most passionate and impactful trailblazers. Donna Red Wing passed away after a courageous battle with lung cancer on that day.

Donna’s legacy of service for the LGBTQ community is unparalleled. She was a national leader in the fight for LGBTQ equality, dedicating over three decades of her life to advocating for our community. Over the years, she held leadership roles at organizations like Human Rights Campaign, GLAAD, the Gill Foundation, Interfaith Alliance, and others. While directing the Lesbian Community Project in Oregon, she was featured in a Sundance Award-winning film about the 1992 struggle (and victory) against Ballot Measure 9, a proposed amendment to Oregon’s constitution that, among other things, compelled public schools to teach youth that being LGBTQ is “abnormal, wrong, unnatural and perverse”. She also advised both President Barack Obama and Howard Dean on LGBTQ issues.

Donna moved to Iowa in 2012 to begin her tenure as One Iowa’s executive director. Despite living here for a relatively short time, she made an enormously positive impact in the fight for LGBTQ equality in our state. In addition to leading One Iowa for four years, she launched an LGBT Advisory Council while serving as a Des Moines Civil and Human Rights Commissioner and briefly served as director of the Eychaner Foundation during her time in Iowa. The Des Moines Civil and Human Rights Commission recently renamed their Lifetime Achievement award after her to honor her extraordinary work championing equality for all in our state.

Over the past few weeks, One Iowa staff who worked with Donna during her time with our organization have been reflecting on our work with her, the enormous impact she had on our community, and our personal connection with her. We’d like to share some of those reflections with you:

“Republicans led on tax reform in 2018,” Governor Kim Reynolds asserted in a news release after lawmakers adjourned for the year on May 5. “As a result, hardworking, middle class Iowa families, farmers, small business owners and workers get meaningful relief, all while Iowa’s budget priorities in future years are protected.”

None of those claims withstand scrutiny.

Those who read my posts have come to expect conclusions based on data, some level of quantification of a process, phenomenon, or proposal. There are plenty of data with respect to abortion that might inform our views, but this is simply my spiritual and moral view with respect to two claims.

1) Choosing to terminate a pregnancy is not a moral question.

2) The right of a woman to have an abortion should not be infringed.

A year ago I ran for city council in Solon, a town of 2,000 in eastern Iowa. I vividly remember the only sex-ed class I ever took in high school. A woman who worked for Planned Parenthood came to teach our class. I remember eyeing her with distrust as she talked about things absolutely forbidden to me. I didn’t listen because I felt like I wasn’t supposed to listen.

The top Republican appropriator for the justice system wanted to get some things off his chest last night. So State Representative Gary Worthan turned a speech about a budget bill into an extended rant about Democratic Attorney General Tom Miller.

Governor Kim Reynolds has an important decision to make in the next 48 hours: sign or veto Senate File 2311, a top legislative priority for utility companies.

Whether she cares about energy policy or is primarily concerned with her political image, this bill presents the perfect opportunity for the governor to exercise her veto power for the first time.

It’s a mystery. It’s a phenomenon. It’s the political black hole. Where do those fired up well-meaning school board candidates go after they are elected? The black hole sucks them in and dampens their resolve and fortitude.

What causes this bad thing to happen to good people? It’s caused by lack of independent information, group speak, with a little magical thinking added. Combine all three, and you have the ingredients for a black hole, so deep the escape is difficult.
