Why Dave Loebsack's retirement makes IA-02 a toss-up race

All four Iowa Congressional districts will likely be competitive in 2020. Republicans were already targeting the first and third districts, where Representatives Abby Finkenauer and Cindy Axne defeated GOP incumbents last November. Democrats could make a play for IA-04, if Representative Steve King wins the GOP nomination again (as I expect).

Representative Dave Loebsack announced on April 12 that he will retire from Congress after completing his seventh term, rather than running for re-election in the second district. Both Sabato’s Crystal Ball and the Cook Political Report immediately changed their ratings on IA-02 from “likely Democrat” to “toss-up.”

Iowa House bill would ensure more absentee ballots are counted

The controversial 2018 election result in Iowa House district 55 has inspired two legislative proposals related to late-arriving absentee ballots. The House State Government Committee on March 5 advanced a bill designed to enfranchise more Iowans who voted by mail, with uniform rules for all 99 counties.

The leader of the Iowa Senate State Government Committee would move in the opposite direction, excluding all ballots that arrive after election day, even if envelope markings could prove voters mailed them on time. That approach appears to be a non-starter for House Republicans.

It was impossible to miss the sea of white the Democratic women of the U.S. House wore to the State of the Union address on Tuesday. It was a nod to the suffragettes, who paved the way to winning the right to vote on August 26, 1920, and a celebration of the record-breaking diversity of the 116th United States Congress sworn in on January 23, 2019, almost one hundred years later.

Yet reminders of how far there still is to go echoed throughout the chamber. While President Donald Trump acknowledged the record-breaking number of women legislators elected, it took a moment for the modern-day suffragettes to stand and applaud. His praise was unwelcome, due to his history of misogyny.

The Iowa Senate convened for its 2019 session on January 14 with 32 Republicans and 18 Democrats. A record eleven senators are women (six Democrats and five Republicans), up from six women in the chamber at the start of the last legislature’s work.

I enclose below details on the majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Iowa Senate committees. Where relevant, I’ve mentioned changes since last year’s legislative session. Note that Democratic Senator Nate Boulton will serve on committees after all. Minority Leader Janet Petersen had declined to assign him to any committees last month.

A few words about demographics: all current state senators are white. To my knowledge, the only African American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa legislature; in 2014, Nathan Blake fell 18 votes short of becoming the first. No Asian American has served in the Iowa Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 Iowa senators include two Smiths (a Democrat and a Republican) and two Taylors (both Democrats). As for first names, there are three Marks, three Zachs, and two men each named Dan, Jim, Tim, Tom, and Jeff.

Key GOP lawmaker not interested in limiting state auditor's subpoena power

Republicans in Wisconsin and Michigan responded to recent election losses by limiting the powers of some Democratic statewide officials. GOP lawmakers are rumored to be considering similar legislation in Iowa, where Rob Sand just took office as the first Democrat to serve as state auditor in more than 50 years.

But Republican State Representative Bobby Kaufmann, who chairs the Iowa House State Government Committee, told Bleeding Heartland he has no interest in revoking or curtailing the subpoena power of Sand’s office.

Final look at nine Iowa Senate races to watch, with ratings

Few Iowa politics watchers doubt that Democrats will gain ground in the state House today–the only question is how much will the Republican majority shrink.

In contrast, the Iowa Senate landscape could shift in either direction. Republicans now hold 29 seats and are unopposed in Senate district 1, where independent Senator David Johnson is retiring. They are also outspending several Democratic incumbents in districts Donald Trump carried in the last presidential election. Democrats currently hold 20 Senate seats, but they could add to their ranks today, despite a difficult map and a couple of bad breaks over the summer.

GOP outspending Democrats in almost every competitive Iowa Senate race

As was the case two years ago, Democratic candidates are at a financial disadvantage in almost all of the Iowa Senate districts both parties are targeting.

The disparity adds another challenge to a party already facing a difficult path to gaining ground in the upper chamber. Republicans currently hold 29 of the 50 Senate seats and are guaranteed to pick up the district independent Senator David Johnson is vacating.

Iowa legislative recap: Constitutional amendments

Iowa lawmakers went home for the year on May 5. In the coming weeks, Bleeding Heartland will catch up on some of the legislature’s significant work that attracted relatively little attention.

Two proposed state constitutional amendments passed both chambers and could appear on the 2020 general election ballot, if the House and Senate approve them in the same form during either 2019 or 2020.

Three other constitutional amendments cleared one chamber in 2017–in one case unanimously–then stalled in the other chamber as lawmakers completed this two-year session. Those ideas may resurface next year. But since changes to the state constitution must be passed by two consecutively elected legislatures before landing on the general election ballot (the last step in the process), Iowa voters would not be able to ratify those proposals until November 2022 at the earliest.

Iowa Senate backs governor's power to appoint new LG

The Iowa Senate has taken the first step toward preventing a repeat of last spring’s controversy over whether Kim Reynolds would have the authority to name a new lieutenant governor following Terry Branstad’s resignation.

With broad bipartisan support, senators approved on March 7 a constitutional amendment designed to give future generations “a clear and explicit understanding of the line of succession for Iowa’s governors.”

Six hints Iowa Senate Republicans didn't fire Kirsten Anderson over work product

Iowa taxpayers are on the hook for $2.2 million dollars after former Senate Republican communications director Kirsten Anderson won a huge sexual harassment lawsuit last week.

If Senate Republican leaders had any sense of accountability, they would resign, or at least offer to raise money to cover the cost of the verdict, so the general fund doesn’t take another hit while the state budget is in terrible shape.

But Majority Leader Bill Dix refuses to admit any wrongdoing by his colleagues or his staff. He is sticking to his story: “Kirsten Anderson was terminated for her work product and for no other reason.” Dix’s top aide Ed Failor, Jr. has been saying the same thing for years.

The jury didn’t buy the official line, and you shouldn’t either.

Dr. Christopher Peters announced today that he will visit all 24 counties in Iowa’s second Congressional district next week “to speak with Iowans about his plans for the 2018 election.” Since I’ve never heard of someone holding more than two dozen events to publicize a decision not to run for office, it’s a safe bet the Coralville surgeon will be launching his second attempt to defeat Democratic Representative Dave Loebsack.

Iowa Democrats face incredibly difficult path back to legislative majorities (part 1)

Many Iowa Democrats expect to have the wind at their backs for the 2018 elections, due to surging progressive activism, an unpopular Republican president, and backlash against GOP lawmakers who used their power this year to take rights away from hundreds of thousands of workers, lower wages for tens of thousands more, and undermine protections for those who suffer workplace injuries.

It’s too early to predict the political climate next fall, but Democrats need to hope for favorable external conditions as well as strong recruits and well-run campaigns. New calculations of last year’s presidential election results by state legislative district point to a very steep climb back to 51 seats in the Iowa House and 26 seats in the Senate. This post will survey the terrain in the upper chamber.

Journalists, stop validating Republican spin on voter ID

Later today, Iowa Senate Republicans will give final approval to a bill that could prevent thousands of eligible voters from casting ballots. A broad coalition of groups oppose House File 516, because common sense and research on similar laws in other states overwhelmingly point to one conclusion: voter ID and signature verification requirements will create barriers to the exercise of a fundamental constitutional right, disproportionately affecting students, the poor, the elderly, and people of color.

Republicans don’t acknowledge any of the expert testimony. They pay no attention to the conservative judge who regrets his ruling on Indiana’s voter ID law, having concluded that such laws are “a means of voter suppression.” They keep insisting their so-called “election integrity” bill won’t block a single citizen from voting.

They offer up false equivalencies, saying in their newsletters and on the Senate floor that Iowa Democrats also passed a voter ID law when they controlled both legislative chambers.

These tactics can be effective because most news reports on contentious issues give equal weight to both sides, even if one side is not credible. The “he said/she said” frame with no effort to evaluate competing claims is one of my major journalism pet peeves.

But I realized last Friday that when a politician stretches the truth, a reporter’s incompetent fact-check is worse than no fact-checking at all.

Absurd reasoning in action as Iowa Senate approves voter ID bill

On Thursday the Senate passed along party lines the controversial voter ID bill, House File 516, and sent it to the House for approval.

Forget about Democratic amendments to accept other forms of ID such as Social Security, Medicaid or Medicare cards. Republicans voted that down.

Forget about the amendment that would restore the early voting window to the current 40 days instead of 29 days. Republicans voted that down.

Forget about the amendment that would remove the need for signatures to be examined by poll workers, which will reduce access to the polls by creating long lines and the potential for biased decision making by poll workers.

And forget about the provision that would allow two persons in the booth, since we only print ballots in English, and non-native speakers may need help understanding the ballot.

And forget about the claim that provisional ballots will be provided if you have no ID. You will have 48 hours to show up at your auditor’s office with a photo ID anyway.

And forget about the fact that the education and contacting of eligible voters is woefully underfunded.

But don’t forget about Senator Nate Boulton’s comments during closing arguments, or those of other senators disgusted by social injustice. (You should go to the archived footage and watch.)

Read Iowa Secretary of State Paul Pate's draft voter ID and election reform bills

The Legislative Services Agency has drafted three bills fleshing out Iowa Secretary of State Paul Pate’s proposals on voter ID and other changes to election administration, such as signature verification and wider use of electronic poll books. Bleeding Heartland obtained copies of the documents, which I enclose below.

Important caveats:

These drafts are not the final versions of Pate’s bills.

The voter ID plan is consistent with Pate’s comments at an early January press conference and talking points the Secretary of State’s Office distributed the following week. As far as I can tell, these drafts have not incorporated feedback from the four county auditors who testified at a January 26 Iowa House hearing. Many election administrators have reservations about signature verification requirements as well as voter ID. Legislative staff may rewrite some provisions before the bills are assigned numbers and formally introduced in the Iowa House and Senate.

Republican lawmakers will alter Pate’s bills, if they run them at all.

Departmental bills often die in Iowa legislative committees. State Representative Ken Rizer and State Senator Roby Smith, who lead the State Government Committees in their respective chambers, told Barbara Rodriguez of the Associated Press last week “they’re working together on possible changes” to Pate’s plan. Rizer described the secretary of state’s recommendations as “a starting point for an election reform bill.” I expect Pate will end up playing “good cop,” with the “bad cops” in the House and Senate passing more restrictive ID requirements as well as steps to limit early voting, which Pate has not endorsed.

These bills do not yet come with a price tag.

Eventually, the Legislative Services Agency will produce a fiscal note estimating the cost of enacting each bill. Pate initially suggested his plans would require $1 million, roughly half to make electronic poll books universally available, and half to provide voter ID cards to about 140,000 registered Iowa voters lacking a driver’s license or other valid identification. More recently, he has said only about 85,000 current Iowa voters would need a new ID card to bring to the polls, reducing the cost to the state.

How Paul Pate is spinning county auditors on his voter ID plan

Nearly three weeks after Iowa Secretary of State announced plans to push for new voter ID requirements, Pate still hasn’t produced a draft bill that would answer important questions about how his scheme would work. Skeptics including John Deeth, Gavin Aronsen, Pat Rynard, the Des Moines Register editorial board, the Quad-City Times editorial board, and I have posited that the proposal would disenfranchise a significant number of eligible voters, largely from groups that tend to lean Democratic. Pate strenuously objects, claiming that his only concerns are for the “integrity” of Iowa elections and voter confidence in the system.

In addition to arguing his case on social media and in “a public relations tour of Iowa newsrooms,” Pate has sought to enlist support from county auditors, many of whom “aren’t fans of voter ID” requirements.

Never let it be said that the 2016 Iowa legislature accomplished nothing

In four months of work this year, Iowa lawmakers made no progress on improving water quality or expanding conservation programs, funded K-12 schools and higher education below levels needed to keep up with inflation, failed to increase the minimum wage or address wage theft, let most criminal justice reform proposals die in committee, didn’t approve adequate oversight for the newly-privatized Medicaid program, opted against making medical cannabis more available to sick and suffering Iowans, and left unaddressed several other issues that affect thousands of constituents.

But let the record reflect that bipartisan majorities in the Iowa House and Senate acted decisively to solve a non-existent problem. At a bill-signing ceremony yesterday, Governor Terry Branstad and supporters celebrated preventing something that probably never would have happened.

Iowa Democrats trying to add autism insurance coverage to budget bill

Medicaid oversight bill passes Iowa Senate with bipartisan support

Since Terry Branstad returned to the governor’s office, the overwhelming majority of Iowa Senate votes on contentious political issues have fallen along strict party lines: 26 Democrats one way and 24 Republicans the opposite. However, the Branstad administration’s rush to privatize Medicaid has created space for bipartisanship, as a growing number of Republicans acknowledge the dangers of shifting to managed care for a program through which one in six Iowans access health services.

Last month, three GOP senators joined their Democratic colleagues to vote for a bill that would have halted Iowa’s Medicaid privatization. That legislation is going nowhere in the Republican-controlled state House, and federal officials recently approved waivers to allow the Iowa Department of Human Services to implement the managed care policy as of April 1.

Yesterday a quarter of the GOP state senators voted with all 26 Democrats for a Medicaid oversight bill that had cleared the Senate Human Resources Committee unanimously. In her remarks to open floor debate on Senate File 2213, Human Resources Committee Chair Amanda Ragan said the bill was designed “to safeguard the interests of Medicaid members, encourage the participation of Medicaid providers, and protect Iowa taxpayers.” She told colleagues, “we must require DHS and the managed care companies to protect consumers, preserve provider networks, address the unique needs of children and assure accountability.”

The Iowa legislature’s 2016 session began on Monday. For the sixth year in a row, the 50 state senators include 26 Democrats and 24 Republicans. Just seven senators are women (six Democrats and a Republican), down from a high of ten women serving in the chamber during 2013 and 2014. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

I enclose below details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Little has changed since last year, in contrast to the Iowa House, which saw some big changes in the majority Republican caucus since the legislature adjourned in June.

Term limits are a terrible idea generally but would be especially awful if applied to the Iowa Senate, as the longest-serving current senator bizarrely advocated last year. The experience gap between Democrats and Republicans is striking. As detailed below, only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Iowa AG Miller to GOP lawmakers: No authority to investigate fetal tissue transfers

Iowa Attorney General Tom Miller has informed 56 Republican state legislators that his office has neither “jurisdiction over transfers of fetal tissue” nor the “authority to investigate or demand information about the transfer of fetal tissue.” In a letter dated today, Miller noted that “Iowa does not have any state laws governing the transfer of fetal tissue,” which means that only offices of U.S. Attorneys are able to enforce federal laws in this area.

Last month, the GOP lawmakers asked Miller’s office “to investigate current and planned abortion operations within Iowa to ensure compliance with the law.” Their letter set out ten detailed questions regarding the disposal, donation, or possible sale of body parts following abortions. Miller directed the legislators to contact U.S. attorneys’ offices in Iowa if they “have reliable information that federal laws relating to fetal tissue are being violated.”

I enclose below the August 24 letter from Iowa House and Senate Republicans, today’s written response from Miller, and a two-page letter Planned Parenthood of the Heartland provided to the Attorney General’s Office regarding the lawmakers’ query. Planned Parenthood’s response noted that the organization “does not now, and has not in the past, participated in” any fetal tissue donation programs but adheres to “rigorous standards of care” and “compliance with all applicable laws and regulations” in every area of its work, including abortion services.

Many Iowa Republicans will be furious, not only because Miller will not act on their unfounded suspicions, but also because the Attorney General’s Office responded to their query in what appears to be a textbook late-afternoon, pre-holiday-weekend news dump.

Also worth noting: Iowa House Speaker-select Linda Upmeyer and incoming House Majority Leader Chris Hagenow did not sign the August 24 letter to Miller, but House Speaker Pro-Tem Matt Windschitl, incoming Majority Whip Joel Fry, and Assistant Majority Leaders Zach Nunn, Jarad Klein, and Walt Rogers did. Iowa Senate Minority Leader Bill Dix did not sign the letter, but Minority Whip Jack Whitver and Assistant Minority Leaders Rick Bertrand, Randy Fenestra, Charles Schneider, and David Johnson did.

Iowa Senate, House approve gas tax increase

A bill that would raise Iowa’s gasoline tax by 10 cents a gallon is on its way to Governor Terry Branstad’s desk after approval today by both chambers in the Iowa legislature. The Iowa Senate passed Senate File 257 this morning by 28 votes to 21. Sixteen Democrats and twelve Republicans voted for the bill, while ten Democrats and eleven Republicans opposed it. Senate Majority Leader Mike Gronstal had reportedly insisted on at least half the GOP caucus supporting a gas tax increase as a condition for bringing the bill to the floor.

A few hours later, the Iowa House took up the Senate bill (rather than the bill that cleared two House committees last week). Thirty Republicans and 23 Democrats voted yes, while 26 Republicans and 20 Democrats voted no.

Only two state legislators missed today’s votes: Republican State Senator Mark Chelgren and Republican State Representative Chip Baltimore. Baltimore voted against the House version of this bill in committee last week, while Chelgren doesn’t serve on the committees that approved the bill in the Senate. Chelgren appears to have been absent for all of today’s votes, while Baltimore was at the Capitol but left the chamber when the gas tax bill came up. Speaking to reporters later, he tried to make a virtue out of his absence: “I refuse to legitimize either the bill or the process with a vote.” Weak sauce from a guy who is widely expected to seek higher office someday.

Conservative groups are urging Branstad to veto Senate File 257, but that seems unlikely, given the governor’s recent comments on road funding. Branstad’s spokesman said today that the governor will carefully review the final bill before deciding whether to sign it.

Final note: several of the “no” votes came from lawmakers who may face competitive re-election campaigns in 2016. Those include Democrats Chris Brase (Senate district 46), Steve Sodders (Senate district 36), and Mary Jo Wilhelm (Senate district 26), and Republicans Dennis Guth (Senate district 4) and Amy Sinclair (Senate district 14).

Iowa legislative state of play on raising the gas tax

Iowa House and Senate members have taken several steps toward raising the state gasoline tax for the first time since 1989. Follow me after the jump for details on where the legislation stands and the latest signals from the governor.

One big political question was answered today, as House Speaker Kraig Paulsen not only endorsed the gas tax bill but personally intervened to make sure it would clear the House Ways and Means Committee. His support may bring some reluctant House Republicans on board. Conservative advocacy groups such as Americans for Prosperity and Iowans for Tax Relief are pushing hard against any gas tax increase. Governor Terry Branstad or Iowa Senate Minority Leader Bill Dix appear ready to back this bill but may need to spend more political capital to get it passed.

Two important policy questions remain unanswered. First, what will be done to lessen the blow on low-income Iowans, who would be disproportionately affected by any increase in a regressive tax? Iowa’s tax system is already stacked against people with lower incomes.

Second, will the gas tax hike turn out to be a giant bait and switch? From business groups to road builders to heavyweights in the agricultural sector, advocates of a tax increase cite the poor condition of many Iowa roads and bridges. However, to my knowledge the pending legislation would not guarantee that any new Road Use Tax Fund revenues from gasoline taxes or vehicle fees be spent on repairing torn-up roads or structurally deficient bridges. Unless “fix it first” language or a change to the funding formula is added to the bill, the lion’s share of additional revenues from a gas tax hike could go toward building new roads or new lanes on existing roads, such as U.S. Highway 20 in northwest Iowa or any number of local “economic development” projects. If crumbling roads and bridges are used to justify a gas tax hike, lawmakers should stipulate that most of the new money raised would go toward existing infrastructure rather than new roads and lanes, which only increase future maintenance costs.

Who's who in the Iowa Senate for 2015

The Iowa legislature’s 2015 session begins today. Democrats maintained their 26 to 24 majority in the upper chamber. After the jump I’ve posted details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Where relevant, I’ve noted changes from the previous committee assignments. Click here for a similar post on the new Iowa House.

I’ve also enclosed below details on the tenure of all 50 Iowa senators. The experience gap between the caucuses is striking, even more so since three of the longest-serving GOP state senators retired in 2014. Only seven of the 24 Republicans have served in either the state House or Senate for more than four years, whereas nineteen of the 26 Democrats have more than four years of legislative service. Only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Just seven of the 50 senators are women, down from ten women in the chamber two years ago. The Democratic caucus includes 20 men and six women; the Republican caucus 23 men and one woman.

All current Iowa senators are white. To my knowledge, no African-American has ever served in the Iowa Senate. CORRECTION: Bleeding Heartland reader northwest points out that I forgot Tom Mann, who represented part of Des Moines in the Iowa Senate during the 1980s.

No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 state senators include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

New thread on competitive Iowa Senate races

It’s been a while since Bleeding Heartland posted a thread dedicated to the Iowa Senate races. Democrats go into the election with a 26 to 24 majority in the upper chamber, where 25 of the 50 districts are on the ballot this year. Only a handful of those races appear to be competitive.

Carolyn Fiddler, who blogs about state legislative races here, has rated the Iowa Senate as a “Tossup/Tilt D” chamber on her list of state legislative chambers most likely to flip. In those terms, I consider the Iowa Senate a “lean D” chamber, as a lot has to break for Republicans to get them to 26 seats.

In theory, Democrats are defending six seats: five incumbents have challengers, and one Democratic-held seat is open. In reality, Republicans have failed to mount strong challengers against Amanda Ragan in Senate district 27 or Tod Bowman in Senate district 29. Moreover, the Iowa GOP is not putting significant money behind Jeremy Davis, its challenger in Senate district 23. Davis has just started running some positive radio ads in the Des Moines area, whereas radio commercials were launched more than a month ago in the targeted races.

The Democratic incumbent who appears to be most at risk is Daryl Beall in Senate district 5. His territory changed quite a bit with redistricting, and Mitt Romney carried it in the 2012 presidential election. Republicans are also making a strong play for the open Senate district 15. Both parties have been running radio ads since late September, but as of last week only Democrats were on television in Senate district 15, with a positive spot about Chaz Allen. To a lesser extent, Republicans have put money behind Brian Schmidt’s campaign in Senate district 49, but the demographics of that district favor incumbent Senator Rita Hart.

Republicans could win two of the Democratic-held Iowa Senate seats, but that won’t get them to the magic 26 unless they hold all of their current seats. Two of those are heavily targeted. In the open Senate district 39, both parties have been advertising on the radio for more than a month. Democrats have invested far more in television ads (all positive for Kevin Kinney) than Republicans have for Mike Moore.

The other Republican-held Senate seat most at risk appears to be Senate district 41. By voter registration and top of the ticket performance, this should be a Democratic seat. The best thing going for State Senator Mark Chelgren is that Mariannette Miller-Meeks is the Republican nominee in Iowa’s second Congressional district. She’s an underdog against Representative Dave Loebsack, but a strong turnout for her in the Ottumwa area would benefit Chelgren, as it did in 2010.

Carolyn Fiddler encouraged readers to keep an eye on Senate district 47, but even though Barack Obama carried that district in 2012, it would be an upset for Maria Bribriesco to defeat incumbent Roby Smith. That said, Democrats have hit SD-47 with quite a bit of direct mail.

UPDATE: Forgot to mention that surrogates have gotten involved with many of these races. Senator Tom Harkin headlined an October 27 rally in Fort Dodge for Beall. Maryland Governor Martin O’Malley did an event earlier this month for Steve Siegel in Senate district 41. On the Republican side, Governor Terry Branstad has been in Ottumwa recently to help Chelgren and plans events for the GOP candidates in Senate districts 15 and 39 soon.

SECOND UPDATE: Tim Kraayenbrink, the GOP challenger to Beall in Senate district 5, has just started running a positive television commercial in the Des Moines market. The gist is that he’s a small business owner, unlike “career politicians in Des Moines.” I haven’t caught it on tape yet but am fairly certain he did not mention Beall by name.

Highlights from this year's Iowa Senate votes on Branstad nominees

During the 2014 legislative session, the Iowa Senate confirmed all but a handful of Governor Terry Branstad’s more than 200 nominees for state boards and commissions. It’s not unusual for senators to vote down one or two appointees, but this year the Senate confirmed everyone who came up for a vote on the floor.

The only close call was former Iowa House Republican Nick Wagner, confirmed to the Iowa Utilities Board last month with just one vote to spare. Branstad originally named Wagner to the three-member utilities board in 2013 but pulled his nomination when it became clear that senators would not confirm him. Branstad named Wagner to that board anyway, right after the Senate adjourned for the year in 2013. By the time his nomination came up for consideration this year, a couple of factors that worked against him were no longer relevant. Former State Senator Swati Dandekar had resigned from the board to run for Congress, so there would no longer be two of three members from Marion (a Cedar Rapids suburb). Furthermore, Branstad named attorney Sheila Tipton to replace Dandekar, so senators could no longer object to the lack of a lawyer on the Iowa Utilities Board.

Still, most of the Democratic caucus opposed Wagner’s nomination. State Senator Rob Hogg cited the nominee’s support for a bad nuclear power bill that the legislature considered a few years back. Meanwhile, State Senator Matt McCoy (who incidentally wanted to pass the nuclear bill) noted that as a key Iowa House Republican on budget matters, Wagner “was not willing to listen” and “took very difficult and very hard-line positions.” After the jump I’ve posted the roll call on the Wagner nomination; 11 Democrats joined all 24 Republicans to confirm him.

As in recent years, the governor withdrew a handful of nominees who were not likely to gain at least 34 votes (a two-thirds majority) in the upper chamber. A few nominees for low-profile boards had to go because of party imbalance issues. Chet Hollingshead, one of seven Branstad appointees to the Mental Health and Disability Services Commission, never came up for a vote, presumably because of a theft incident Bleeding Heartland user Iowa_native described here.

I am not sure why Senate Majority Leader Mike Gronstal informed Branstad that Jason Carlstrom was unlikely to be confirmed as chair of the Iowa Board of Parole. The governor first appointed Carlstrom to that position in the summer of 2012, to fill out the remainder of someone else’s term. The Iowa Senate unanimously confirmed him during the 2013 legislative session. When Branstad reappointed Carlstrom to the parole board this year, I didn’t expect him to run into any trouble. I will update this post if I learn more details.

The highest-profile nominee withdrawn by Branstad was former Iowa House Republican Jamie Van Fossen, whom the governor wanted to chair the Public Employment Relations Board. Cityview’s Civic Skinny described the backstory well; I’ve posted excerpts after the jump. Van Fossen still serves on that board, having been confirmed to a full term in 2012. But the new chair will be Mike Cormack, a Republican who served four terms in the Iowa House and later worked for the State Department of Education. Senators unanimously confirmed Cormack last month. The outgoing Public Employment Relations Board chair, Jim Riordan, has alleged that the board faced political pressure from Branstad staffers to hire an employer-friendly administrative law judge.

Iowa Senate approves cannabis oil bill

Yesterday the Iowa Senate approved by 36 votes to 12 a bill to legalize the use of medical cannabis oil for treating certain seizure conditions. You can read the full text of Senate File 2360 here. After the jump I’ve posted State Senator Joe Bolkcom’s floor statements in support of the bill, which summarize its key points and limited scope. An Iowa Senate Democratic research staffer provided a more detailed analysis of the bill here (pdf).

The roll call in the Senate Journal shows that all 26 Iowa Senate Democrats voted for the cannabis oil bill, joined by the following ten Republicans: Mike Breitbach, Mark Chelgren, Minority Leader Bill Dix, Joni Ernst, Hubert Houser, David Johnson, Tim Kapucian, Charles Schneider, Amy Sinclair, and Brad Zaun. The twelve Republicans who voted no were Bill Anderson, Jerry Behn, Rick Bertrand, Nancy Boettger, Jake Chapman, Randy Feenstra, Julian Garrett, Sandy Greiner, Dennis Guth, Ken Rozenboom, Roby Smith, and Jack Whitver. Republicans Mark Segebart and Dan Zumbach were absent.

During the floor debate, several Republicans warned that passing the bill would send the wrong message to teenagers, leading to more recreational use of marijuana. That’s hard to fathom, since the bill does not legalize smoking marijuana, even for terminally or chronically ill Iowans who could benefit from medical cannabis in that form.

Key Iowa House Republicans and Governor Terry Branstad have made clear that for now, they would consider only a bill to allow access to medical cannabis oil. I hope a study committee on broader use of medical marijuana will go forward. Senate File 2360 is a step in the right direction and will give families like this one options other than moving to Colorado. However, the bill leaves out too many suffering people.

P.S.- A sign of how far the political ground has shifted in the medical marijuana debate: Joni Ernst and Brad Zaun are in fiercely competitive GOP primaries (for U.S. Senate and IA-03, respectively). Both of them voted for this bill.

IOWA FAMILIES DENIED ACCESS TO EVIDENCE-BASED CARE

Friends of Iowa Midwives has worked with legislators to present companion bills in the House and Senate that would allow for safe and legal access to Certified Professional Midwives (CPMs) in Iowa.  For 15 years Friends of Iowa Midwives has worked toward licensure for CPMs. In 1999 the Iowa Legislature conducted a scope of practice review, the result of which was a recommendation to the legislature that the CPMs should be licensed through the Iowa Department of Public Health.  The bills propose that a license be created for the already trained and nationally certified midwives who seek to provide quality and safe care to Iowa women.

Every year in Iowa, more than 500 women choose to give birth outside of the hospital.  This number is on the rise both in Iowa and nationally.  A study published last month in the Journal of Midwifery and Women’s Health again demonstrated that for low-risk women out-of-hospital birth with skilled providers is a safe option.  This study found that almost 94% of the nearly 17,000 participants had a spontaneous vaginal birth.  The cesarean rate for this study was 5.2%.  The national average cesarean rate is 33%.  The in-labor transfer rate for this study was between 8-23%.  The most common reason for a transfer of care was prolonged labor or what is commonly called failure to progress. This study was one of among several that have demonstrated that out-of-hospital birth is a safe option for low-risk women.

Mike Gronstal sees eight competitive Iowa Senate races

Iowa Senate Majority Leader Mike Gronstal is “fairly confident” going into this year’s state legislative elections, he told Mike Glover in a recent interview. He cited a “pretty good message” to take to voters as well as a “a slight advantage on the map” that will allow Democrats to play “a little less defense and a little more offense,” compared to 2012.

I agree with Gronstal that Democrats are better positioned now to hold their 26 to 24 majority in the upper chamber than they were at the same point two years ago. Follow me after the jump for a quick look at the eight districts the Senate majority leader expects to be targeted this fall.

Maria Bribriesco will challenge Roby Smith in Iowa Senate district 47

Maria Bribriesco announced today that she is running for Iowa Senate district 47 in 2014. The district covers parts of Scott County, including Bettendorf, some neighborhoods in Davenport, and several small towns. Before retiring, Bribriesco was a longtime civilian attorney with the U.S. Army at Rock Island Arsenal, a major employer in the Quad Cities. I’ve posted her campaign press release containing more biographical information after the jump, along with a detailed map of the district. In 2012, Bribriesco unsuccessfully ran against State Representative Linda Miller in House district 94, which covers half of Senate district 47.

The Republican incumbent in Senate district 47 is Roby Smith, who defeated the previous senator Dave Hartsuch in the 2010 GOP primary. Although I haven’t heard anything official and Smith hasn’t updated his campaign website, I assume he will seek re-election next year. I enclosed the bio from his 2010 campaign website below. Smith is an assistant Senate minority leader and serves on the Senate committees on Appropriations, Ways & Means, State Government, and Education (where he is the ranking member).

I consider Smith favored to hold Senate district 47, which contained 13,959 registered Democrats, 15,667 Republicans, and 19,813 no-party voters as of October 2013. However, last year Barack Obama defeated Mitt Romney in Senate district 47 by 50.65 percent to 48.31 percent.

The Daily Kos Elections team has been compiling 2012 presidential election results by state legislative district as well as by Congressional district. Yesterday the Iowa numbers were added to the database. You can view Google documents with raw vote totals and percentages for Barack Obama and Mitt Romney by Iowa Congressional district here, by Iowa Senate district here, and by Iowa House district here.

Looking closely at the presidential vote in the legislative districts provides some insight about where the competitive Iowa statehouse races might be next year. Last-minute Iowa legislative scramble is nothing to brag about

The Iowa Senate wrapped up its work for the year shortly after midnight on May 23, and Iowa House members adjourned about 11 hours later. Lawmakers in both parties have been congratulating themselves for compromising on some big issues that ended in stalemate the previous two years. Rod Boshart compiled an excellent list of what the legislature did and didn’t approve during 2013.

We all can appreciate the desire to finish a big project before a holiday weekend, and since legislators stopped receiving per diem payments weeks ago, they understandably wanted to get out of town as quickly as possible. However, I found it disturbing that votes were held before most lawmakers, let alone members of the public, had time to digest final conference committee deals on education reform, an alternative to Medicaid expansion, property taxes, and the health and human services budget. Transparency isn’t just a buzzword. Had journalists and advocacy groups been able to look over the last-minute compromises, people might have discovered problematic language or even simple drafting errors, which could produce unintended consequences after Governor Terry Branstad signs these bills into law.

I have a lot of questions about the final education reform bill and the plan to provide health insurance to low-income Iowans, particularly those earning between 101 percent and 138 percent of the poverty level. I also need more time to sort through the budget numbers and final changes to the standings bill. After the holiday weekend Bleeding Heartland will examine the important results of the legislative session in more detail. For now, I’ve posted after the jump details on who voted for and against the major bills approved this week.

UPDATE: In the May 24 edition of the On Iowa Politics podcast, statehouse reporters Mike Wiser and James Lynch discussed how the big issues came together “behind closed doors,” with no public scrutiny or oversight. Lynch commented that to his knowledge, the conference committee named to resolve the impasse over Medicaid expansion never formally met, except perhaps for one organizational meeting. Lynch recounted one occasion when Iowa House Republican Dave Heaton was briefing journalists about the health care talks, and the journalists asked when that happened, since there hadn’t been any public notices of conference committee meetings. According to Lynch, Heaton replied, “We’re not having meetings, but we’re meeting.” Senate President Pam Jochum said that negotiations between Democratic State Senator Amanda Ragan and House Majority Leader Linda Upmeyer produced the “key to Iowa’s health care compromise.” Notably, Upmeyer didn’t have a prominent role in passing the House health insurance plan, nor was she named to the conference committee assigned to merge the House and Senate proposals.

Speaking to journalists on May 22, Senate Majority Leader Mike Gronstal and Jochum weren’t able to answer a specific question about compromise wording reached regarding Medicaid coverage of abortions. That was no minor issue–it was the last sticking point holding up approval of the health and human services budget. In effect, Gronstal told journalists, you can see the wording after the final bill is published.

Another Iowa legislative victory for Big Ag

Factory farm advocates failed in 2009 to circumvent the Iowa DNR’s rulemaking on applying manure over frozen and snow-covered ground. Then they failed in 2010 to win passage of a bill designed to weaken Iowa’s newly-adopted regulations on manure storage and application.

But this year, the Iowa Pork Producers Association succeeded in convincing state lawmakers to relax requirements for CAFO operators to be able to store their own manure properly. All they had to do was dress up their effort as an attempt to help families with aspiring young farmers.
