Democratic legislators, environmental organizations, and consumer advocates warned in 2018 that a bill backed by Iowa’s major utilities would destroy our state’s decades-long tradition of being a “national leader in energy efficiency.” But Republican members of the Iowa House and Senate didn’t listen, and Governor Kim Reynolds ignored calls to veto Senate File 2311.

That law is the main reason Iowa dropped sharply in a new review of state policies on energy efficiency.

The U.S. Census Bureau is unlikely to deliver state population totals on its usual timetable, Michael Wines and Emily Bazelon reported for the New York Times on November 19. The news was encouraging for those who support an accurate, complete census, because a delay beyond January 20 would stop the Trump administration’s unconstitutional plan “to remove unauthorized immigrants from the count for the first time in history, leaving an older and whiter population as the basis for divvying up [U.S.] House seats […].”

I wondered how an adjusted timetable could affect Iowa’s redistricting. Could Republicans who retained control of the Iowa House and Senate use a delay as a pretext for bypassing our state’s current nonpartisan process?

Not without changing state law.

On November 16, Governor Kim Reynolds signed a new public health disaster emergency proclamation that recognizes the increasing severity of the COVID-19 pandemic in our state. In it, the governor ordered that all “social, community, business, or leisure gatherings or events of more than 15 people” be prohibited in all indoor locations, barring some exceptions.

Republican State Representative Steven Holt plans to review possible changes to the governor’s emergency powers, “including requiring legislative approval for declared emergencies lasting over a certain period of time,” he posted on Facebook November 17. Holt has been a vocal critic of business closures to reduce spread of COVID-19 and is unhappy with several aspects of Governor Kim Reynolds’ latest emergency proclamation.

First elected to the legislature in 2014, Holt has chaired the House Judiciary Committee since 2019. Republican leaders have not yet announced committee assignments for the 2021 session, when their majority will grow to 59-41.

The non-profit 50-50 in 2020 dissolved early this year after working for a decade to increase women’s representation in Iowa politics. Although our state has elected a woman governor, a woman to the U.S. Senate (twice), and will have women representing three of the the four Congressional districts for the next two years, we have a long way to go toward parity in the Iowa legislature.

When lawmakers convene in Des Moines in January, women will make up one-quarter of the Iowa Senate for the first time. However, the number of women serving in the House will drop below one-third of the chamber.

Bleeding Heartland will analyze the Iowa election results from many perspectives in the coming weeks. For now, let’s review the big picture: just like in 2016, the outcome was more devastating than any Democrat’s worst nightmare.

Turnout set a new record: Iowans cast at least 1,697,102 ballots, roughly 107,000 more than the high water mark of 1,589,951 people voting in the 2012 presidential election.

But as we learned in November 2018, high turnout doesn’t only help Democrats.

Politics watchers from around the country are watching Iowa’s U.S. Senate race today, but arguably the battle for the Iowa House is more important for our state’s future. Democrats need a net gain of four seats for a majority or three seats for a 50-50 chamber that would block the worst excesses of the Republican trifecta.

The 2020 playing field is even larger than usual, in part because Democrats finally have the resources to compete with Republicans in the battleground House districts.

I enclose below a brief final look at each House district, with the latest voter registration figures (as of November 2), absentee ballot totals (as of November 3), campaign spending by both parties, and recent voting history. This post from early October has more background on each campaign, which influenced my ratings.

Democrats have good prospects to win control of the chamber, with many potential targets. If Republicans cling to a majority, it will probably be with only 51 seats.

Iowa — and the country — is suffering from a leadership deficit.

In this election, we can send a clear message.

In Iowa House district 39, first-term State Representative Karin Derry has shown integrity in leadership where others have not.

Democratic activists are highly motivated to take back the Iowa House majority, judging from the latest round of campaign finance reports for legislative candidates.

Iowa has never seen anything like this kind of fundraising for state House races.

If you’re among the hundreds of thousands of Iowans who received absentee ballots in the mail this week or voted early in person, you may have noticed that one party’s candidates were listed first on all of the races for federal and state offices. Perhaps the ballot order differed from your expectations; Republican candidates got top billing in several large, Democratic-leaning counties.

How did that happen?

It’s been too long since Bleeding Heartland took a comprehensive look at the Iowa House landcsape. Democrats need a net gain of four seats to gain control of the chamber, where Republicans have held a 53-47 majority since they stopped ballots from being counted in the closest race from the last election cycle.

Thanks to our state’s nonpartisan redistricting system, at least a quarter of the House races could become competitive, and more than a dozen will be targeted by both parties and some outside groups. This post covers 28 House districts that could fall into that category. One or both parties spent significant funds on twenty Iowa House races in 2018.

The playing field has changed somewhat since Bleeding Heartland last reviewed the House landscape in March. A few new contenders have declared; click here for the full list of general election candidates. In addition, some races look less competitive or more competitive now than they did six months ago.

An election is an opportunity for the two dominant political parties to show us their visions for the future, explain the policies they hope to enact, and present us with two competent people to choose from. In theory, the candidates representing the Republicans and the Democrats should be the best the parties can come up with for the districts they will represent.

That is the ideal, but then there is the real world. In the race for Iowa House District 52 Representative, the Republican candidate is so far from ideal that his own party tried to keep him off the ballot.

Retail sales of medical cannabis products began in Iowa on December 1, 2018, implementing Iowa House File 524, which lawmakers passed on the final day of the 2017 legislative session.

Iowans for Medical Marijuana submitted an application to the U.S. Drug Enforcement Administration in January 2019, seeking to exempt Iowa’s Medical Cannabis Program from federal drug laws. That application used the process in Title 21, Code of Federal Regulations, Chapter 1307, 21 C.F.R. §1307.03. I then began to lobby the state legislature and the Iowa Department of Public Health to support the application.

Governor Kim Reynolds directed that nearly $450,000 in federal funding the state of Iowa received through the Coronavirus Aid, Relief and Economic Security (CARES) Act be used to cover salaries and benefits for staff working in her office.

According to documents Bleeding Heartland obtained from the Iowa Department of Management through public records requests, the funds will cover more than 60 percent of the compensation for 21 employees from March 14 through June 30, 2020.

Reynolds has not disclosed that she allocated funds for that purpose, and reports produced by the nonpartisan Legislative Services Agency have not mentioned any CARES Act funding received by the governor’s office. Nor do any such disbursements appear on a database showing thousands of state government expenditures under the CARES Act.

The governor’s communications director Pat Garrett did not respond to four requests for comment over a two-week period.

State Auditor Rob Sand had “great news” to share with members of the Iowa House and Senate Appropriations Committees in May. Federal officials had agreed not to demand repayment for alleged overbilling, provided that Iowa changed its billing practices for future audits. The savings to the state would amount to tens of thousands of dollars for each fiscal year.

Documents Bleeding Heartland obtained through a public records request confirm that key Reynolds administration officials were on board with the reform plan, and Iowa Senate appropriators took it up in June as the legislature was completing its work.

The records also show that State Representatives Gary Mohr and John Landon refused to move the fix through the Iowa House.

What they don’t explain is why.

At least six minor party or unaffiliated presidential candidates have qualified for Iowa’s general election ballot, according to the official list published on August 14. (Petitions for a seventh, Kanye West, are still under review in the Iowa Secretary of State’s office.)

One of the little-known presidential contenders, Ricki Sue King, set out to make history with her candidacy and succeeded. But she doesn’t want Iowans to vote for her.

President Lyndon Johnson signed the Older Americans Act into law on July 14, 1965. It responded to the need for community services, evidence-based health promotion, disease prevention programs, civic engagement, and elder justice for senior citizens. America’s seniors require a similar response to the COVID-19 pandemic.

The Iowa Alliance for Retired Americans believes that seniors must have relevant and accurate information about preventing and treating the coronavirus. Seniors and retirees are becoming more desperate looking for security and a cure. We should be able to trust President Donald Trump’s pronouncements. However, he repeatedly shows us that we cannot believe his statements.

The Iowa quarter, printed in the latter part of 2004, is based upon a Grant Wood painting depicting a group of students and their teacher planting a tree outside of a county school. The statement on the coin says, “Foundation In Education.” For many decades, Iowa was noted for its first-in-the-nation education status. Likewise, Iowa has been a consistent leader in civil rights.

In fact, Iowa established some standards of equality long before the federal government or other states.

But racial disparities continue to affect Iowans in many areas of life. A reform the Democratic-controlled legislature enacted more than a decade ago has only slightly mitigated the problem.

State Representative Ashley Hinson didn’t miss a roll call vote as the Iowa House wrapped up its work in June, legislative records show. But the two-term Republican mostly stayed out of the House chamber while colleagues debated controversial bills.

The tactic allowed Hinson, who is also the GOP challenger in Iowa’s first Congressional district, to avoid public questioning about policies she supported. Notably, she was absent during most of the House deliberations on imposing a 24-hour waiting period for abortions, establishing a barrier to voting by mail, and giving businesses near-total immunity from lawsuits related to COVID-19.

Neither Hinson nor her Congressional campaign responded to Bleeding Heartland’s repeated inquiries about those absences.

Governor Kim Reynolds has signed into law provisions that would make it harder for county auditors to process some absentee ballot request forms.

Democratic election lawyers have signaled plans to challenge the new restrictions, which copy an administrative rule struck down in court last year.

It took them long enough.

After federal courts blocked two laws designed to suppress unauthorized access to livestock production facilities, Iowa lawmakers approved and Governor Kim Reynolds signed a third attempt to keep animal rights activists from filming or photographing conditions inside farm buildings or slaughterhouses. This time, the legislature finally took the path state attorneys recommended way back in 2011: beef up the trespassing law as applied to agriculture, without reference to speech or expression.

The new law has a realistic chance to survive a court challenge.

Secretary of State Paul Pate will need approval from the Legislative Council in order to use his emergency powers to alter election procedures, under a bill Governor Kim Reynolds signed on June 25.

While Republicans have a majority on that legislative body, it’s not clear they would use that power to prevent Pate from repeating steps that led to record-breaking turnout for the June 2 primary.

Top Iowa House Democrats advised members of the caucus to get tested for novel coronavirus this week, House Minority Leader Todd Prichard confirmed on June 19.

“In addition to wearing masks, socially distancing, and going through the health screenings daily during session, we did recommend members get tested following session,” Prichard said via email. He added that his team was “not aware of any members or staff” exposed to COVID-19 at the capitol as legislators wrapped up their work for the year.

Prichard had no comment on Bleeding Heartland’s other questions, related to Republican State Representative Gary Worthan’s absence from the Iowa House chamber beginning on June 5.

Spirits lifted in the pro-choice community when Iowa House Majority Leader Matt Windschitl did not call up a constitutional amendment on abortion shortly after the legislature reconvened this month.

Republican leaders wanted to pass the amendment, which had advanced from committee months earlier. When a high-profile bill doesn’t come to the floor, it often means the majority party doesn’t have the votes for final passage.

Indeed, at least three of the 53 House Republicans resisted immense pressure to vote for legislation designed to overturn an Iowa Supreme Court ruling protecting “the constitutional right of women to terminate a pregnancy.”

Unfortunately, the holdouts agreed to a last-minute abortion restriction that may provide a faster way to undo the high court’s work.

UPDATE: Governor Kim Reynolds signed this legislation on June 30.

Iowa Republicans have perfected the art of sneaking attacks on constitutional rights or the rule of law into budget bills shortly before adjourning for the year.

Last-minute budget amendments in 2019 sought to shorten the Iowa Supreme Court chief justice’s term, increase the governor’s influence over selecting judges, restrict medical care for transgender Iowans, and stop Planned Parenthood from obtaining sex education grants. Those measures spawned four lawsuits.

Judges will surely hear challenges to legislation Republicans enacted while burning the midnight oil this past weekend. A forthcoming post will address a 24-hour waiting period for abortion, approved during the session’s closing hours.

This post focuses on provisions that would make it harder for Iowans to vote by mail. Marc Elias, one of the country’s most prominent Democratic election lawyers, promised on June 14, “This will not stand. We will sue.”

Don’t bet against him. A Polk County District Court already struck down similar language in an administrative rule as “irrational, illogical, and wholly unjustifiable.”

“Let them vote! Let them vote!” Black Lives Matter protesters chanted a few minutes after Governor Kim Reynolds signed a police reform bill on June 12. Reynolds did not acknowledge hearing them, continuing to pass out pens to advocates of the legislation, which the Iowa House and Senate had unanimously approved the night before.

The protesters want the governor to sign an executive order automatically restoring voting rights to Iowans who have completed felony sentences. Iowa has the country’s strictest felon voting ban, which disproportionately disenfranchises African Americans. Reynolds has resisted calls to issue an executive order, saying she wants the legislature to approve a state constitutional amendment on felon voting instead.

The Iowa legislature adjourned for the year on June 14 without the constitutional amendment clearing the Senate.

For many thousands of Iowans with felony convictions, an order from Reynolds provides the only path to voting before 2024. She should issue one as soon as possible.

Most bills lawmakers introduced this year to address Iowa’s notorious racial disparities didn’t get far before the Iowa House and Senate suspended their work in mid-March, due to the COVID-19 pandemic. By the time the legislature got back to work on June 3, large protests were underway daily in Iowa and across the country, in response to the horrific killing of George Floyd at the hands of Minneapolis police.

Democratic lawmakers unveiled a “More Perfect Union plan” designed to prevent “violent conflicts between law enforcement and Iowa residents” on June 4. A bill incorporating their proposals sailed through both chambers unanimously a week later, with a group of Black Lives Matter protesters watching from the public gallery.

House members approved the amended bill by 95 votes to 2 on the evening of June 11. The Senate took up the bill around 12:45 am on June 13. Following a brief debate, during which three Democratic senators spoke against the House version, senators concurred with the House amendment and approved the bill by 31 votes to 16. However, some of the disenfranchising provisions related to absentee ballots surfaced again on June 14, attached to a budget bill. Bleeding Heartland covered that debate here.

After a contentious debate on June 10, the Iowa Senate approved by 30 votes to 19 a bill including controversial changes to election law. The proposal has drawn extensive local and national media coverage for a provision that would ban Iowa’s secretary of state from sending absentee ballot request forms to any voter who did not request one.

House File 2486 now goes to the lower chamber, where an amendment filed the evening of June 10 suggests Democrats and Republicans have agreed to strip out much of Senate State Government Committee Chair Roby Smith’s handiwork.

As a member of the Urbandale City Council, I have a responsibility to ensure the safety of residents, employees, and visitors to Urbandale. In that capacity, I implore Governor Kim Reynolds to veto House File 2502, because it interferes with our state’s long history of local control and makes our communities less safe.

Running against a sitting office-holder from your own party is always an uphill battle. Many Iowa House or Senate members have faced primary challengers during the past decade, but only a handful have failed to win their party’s nomination.

Christina Bohannan beat the odds on June 2, taking 66 percent of the vote against 20-year State Representative Vicki Lensing in Iowa’s most Democratic House district.

No one can write off the outcome as a fluke of a low-turnout environment. Statewide turnout set a new record for an Iowa primary, and voter participation in Johnson County was sky-high as well. Unofficial results showed 6,687 residents of House district 85 cast ballots for either Bohannan or Lensing.

Bohannan’s win and in particular the margin of victory should put every Iowa legislator on notice: you have to keep earning your constituents’ support.

UPDATE: As of August, people of color who will appear on the general election ballot as candidates for the Iowa legislature include nine Democrats, seven Republicans, one Libertarian, and one independent. I’ve added details in the original post, which follows.

After a decade of little change in the racial breakdown of the Iowa House and Senate, more people of color are running for the state legislature this year.

Candidates appearing on today’s primary ballot include eight Democrats and seven eight Republicans, which to my knowledge is a record for the Iowa GOP.

In addition, three people of color representing minor parties have filed as general election candidates in state legislative districts.

Two strong candidates are seeking the Democratic nomination in a top-targeted Iowa House seat.

Staff at Iowa’s State Hygienic Laboratory have been working around the clock to process tests that reveal the scope of the novel coronavirus epidemic. Governor Kim Reynolds has often lauded their “yeoman’s work” at her daily news conferences.

But as former Vice President Joe Biden famously said, “Don’t tell me what you value, show me your budget, and I’ll tell you what you value.” In real terms, state support for a facility critical to Iowa’s COVID-19 response dropped considerably over the last decade.

The Iowa legislature hasn’t increased dollars allocated to the State Hygienic Lab since 2013, when Senate Democrats insisted on doing so. Not only has state funding failed to keep up with inflation since then, the laboratory’s annual appropriation has yet to recover from a mid-year budget cut in 2018.

One of the country’s largest Democratic-aligned political action committees announced its first Iowa legislative endorsements for the 2020 cycle this week.

Democratic State Representative Bruce Bearinger will not seek re-election after all.

According to an April 28 news release from Iowa House Democrats, Bearinger “has been selected as the new Dean of Agriculture, Animal Science, and Business Technologies at Northeast Iowa Community College.” He will serve out his current term in the legislature but will withdraw his candidacy after the June primary.

House district 64 was already a top-tier target for Republicans, who recruited a strong candidate in Chad Ingels. When I previewed this race last month, I gave a slight edge to Bearinger, who has consistently outperformed the top of the Democratic ticket.

UPDATE: Bennett received about 94 percent of the vote in the June 2 primary.

A Republican would have no prayer of winning Iowa House district 65. Two-thirds of the voters in this part of Cedar Rapids (map enclosed below) supported President Barack Obama’s re-election in 2012, and more than 61 percent backed Hillary Clinton in the last presidential election.

State Representative Liz Bennett defeated her last two Republican opponents, Harry Foster in 2016 and George Olmstead in 2018, by two to one margins. Fred Hubbell likewise more than doubled the vote for Governor Kim Reynolds in the House district 65 precincts. The area contains 9,265 active registered Democrats, 3,711 Republicans, and 5,848 no-party voters, according to the latest official figures.

No one is seeking the GOP nomination in House district 65 this year. Instead, lifelong conservative Foster is trying to sneak into the seat by masquerading as a Democrat.

Now that the deadline for candidates to qualify for the June primary ballot has passed, it’s time to revisit the 2020 Iowa House landscape. (A separate overview of state Senate races is in progress.)

Republicans now hold a 53-47 majority in the lower chamber, meaning Democrats need a net gain of four seats for control. Thanks to our state’s nonpartisan redistricting system, more than a dozen House districts should be highly competitive. This post covers 22 House districts that could fall into that category. One or both parties spent significant funds on twenty Iowa House races in 2018, not counting House districts 82 or 16, where Republican candidates ended up winning by small margins.

Since Bleeding Heartland first reviewed the House landscape last May, both parties have had some recruiting successes, while other districts still lack a top-tier challenger. The Secretary of State published the full list of Democratic and GOP primary candidates here. In some races that are currently uncontested, major parties may get candidates on the ballot later by holding a special nominating convention.

Better late than never. Governor Kim Reynolds recommended on March 15 that Iowa schools close for four weeks to slow the spread of novel coronavirus (COVID-19). The same day, Republican legislative leaders announced the House and Senate will suspend operations for at least 30 days after meeting on March 16 “to consider resolutions regarding continuity of government to ensure delivery of essential services to Iowans.” Clerks and secretaries have been told they will be paid through April 21, but “March 16 will be your last day of employment.”

While several state legislatures around the country hit the pause button last week, Iowa House Speaker Pat Grassley and Senate Majority Leader Jack Whitver waited for recommendations from the governor or the Iowa Department of Public Health.

As recently as the late afternoon on March 13, Reynolds was assuring the public, “At this time, Iowa is not experiencing community spread of the virus.” Such a definitive statement was not warranted, given how few people had been tested for COVID-19.
