What’s going on with early voting in Iowa after new Republican-backed laws restricted the practice in many ways?

Overall numbers are way down compared to the same point in the previous two midterm election cycles, and Iowa Republicans are further below their early voting benchmark than are Democrats.

Governor Kim Reynolds continues to take victory laps for how she has managed the COVID-19 pandemic. She touts her efforts to be the first state to command kids back to school and to keep Iowa “open for business,” as Iowans were filling hospital beds and clinging to life on ventilators.  

When Governor Kim Reynolds made news in May by pleading with supporters to help her get her “own” attorney general and a state auditor who wouldn’t scrutinize her actions, Republican Party of Iowa state chair Jeff Kaufmann defended the appeal. In a written statement, Kaufmann said the governor “should be promoting Republican candidates up and down the ticket,” because “Iowans know how worthless our current state auditor, state treasurer and attorney general have been.”

But since Mary Ann Hanusa (the insiders’ pick for state auditor) unexpectedly lost the GOP primary in June, top Iowa Republicans have done virtually nothing to support the party’s nominee Todd Halbur. He goes into the home stretch of the campaign with little money or media exposure. Meanwhile, the incumbent Rob Sand is on track to spend more than a million dollars on various forms of advertising.

Halbur did not respond to phone or email messages seeking comment on the lack of support from his party, and whether it’s related to the whistleblower lawsuit he filed, naming one of Reynolds’ appointees.

I try to stay atop the day’s news. But I must have dozed off last week — because I missed the response from Iowa Republican leaders to the Biden administration’s announcement of $1.3 billion in debt relief to 36,000 farmers who have fallen behind on their farm loan payments.

In making the announcement, U.S. Agriculture Secretary Tom Vilsack said, “Through no fault of their own, our nation’s farmers and ranchers have faced incredibly tough circumstances over the last few years. The funding included in today’s announcement helps keep our farmers farming and provides a fresh start for producers in challenging positions.”

I am not here to question the wisdom of the federal assistance. But the silence from Governor Kim Reynolds and U.S. Senators Chuck Grassley and Joni Ernst is markedly different from their criticism after President Joe Biden announced in August that the government would forgive up to $10,000 in federal student loans for most borrowers.

“You can’t handle the truth!”

Many Bleeding Heartland readers will recall those words of contempt that U.S. Marine Colonel Nathan R. Jessup—played by Jack Nicholson— shouted from the witness stand in the 1992 movie, A Few Good Men.

Col. Jessup was alluding to the death of a young Marine, a killing that “saved lives,” he claimed. Those outside the U.S. Marine Corps supposedly couldn’t handle his distorted view of “the truth.”

That contempt called to mind the political commercials that contaminate our television viewing these days. Judging by the smears and deception in so many ads, the phrase “Iowa nice” (like many of the targeted candidates or policies) would now be considered “too liberal for Iowa.”

You have to hand it to Deidre DeJear.

Governor Kim Reynolds has all the advantages of incumbency. She has spent most of the year avoiding unscripted questions and taking credit for projects that President Joe Biden and a Democratic Congress made possible. While the challenger has struggled to get her message in front of voters, Reynolds enjoys free media coverage almost daily and has blanketed the state with (sometimes racist) television commercials for the past six weeks.

The day before the only scheduled debate between the candidates for governor—Reynolds would not agree to the traditional three—the Des Moines Register published a new Iowa Poll by Selzer & Co showing the incumbent ahead by 52 percent to 35 percent among likely voters.

In other words, the odds facing DeJear could hardly be longer.

Nevertheless, the challenger spoke with clarity and confidence throughout the hour-long “Iowa Press” appearance, using facts and personal stories to great effect. She refused to take the bait when Reynolds fell back on divisive talking points about what “they” (Democrats) supposedly want to do.

I hope voters will take the time to watch the whole program, or read the transcript on the Iowa PBS site. Eight exchanges struck me as particularly revealing.

Iowans who qualify for federal food assistance received $141 million less in benefits from April through August, due to Governor Kim Reynolds’ action earlier in the year, according to data the Iowa Hunger Coalition released on October 12.

After Reynolds ended the state’s public health emergency related to the COVID-19 pandemic, Iowans lost access to the emergency allotments in the Supplemental Nutrition Assistance Program (SNAP), formerly known as food stamps. The Iowa Hunger Coalition calculated that the total amount Iowans received through SNAP dropped by 43 percent from March to April.

Without the emergency allotments, the coalition reported, “On average, households have been receiving $200 less in benefits every month. The average SNAP benefit per meal for individuals in Iowa was $1.56 in August 2022.”

The federal government entirely funds the SNAP program, so the state of Iowa saved no money by depriving food-insecure Iowans of extra benefits.

On the contrary: the U.S. Department of Agriculture’s Economic Research Service has calculated that each $1 issued in SNAP benefits generates $1.54 in economic impact. (When people in need receive more food assistance, they can spend more of their limited resources on other goods and services in their community.) So the $141 million Iowans did not receive from April through August could have increased Iowa’s gross domestic product by $217 million.

“If elected, will you commit to weekly press conferences?” a moderator asked during the first debate between Iowa’s candidates for governor in October 2018. “I do it all the time,” Governor Kim Reynolds replied.

Asked again during that campaign’s third debate whether she would hold weekly press conferences, Reynolds claimed to have already made that commitment, adding, “If there’s any ambiguity, I will.”

Bleeding Heartland’s review of the governor’s public schedule reveals she has not come close to keeping that promise for most of the past four years. After a period of greater accessibility during the COVID-19 pandemic, Reynolds held just four formal news conferences during the second half of 2021. More than 40 weeks into this year, she has held only ten news conferences, the last occurring on July 12.

Reporters with access have sometimes been able to ask the governor a few questions at a “gaggle” after a bill signing or another public event. But most weeks, Reynolds has not scheduled even an informal media availability.

Avoiding unscripted questions on camera gives Reynolds greater control over news coverage of her administration, and keeps awkward moments mostly out of public view.

Anyone who watches television has seen the Progressive Insurance commercial where Dr. Rick helps young homeowners becoming their parents. He gives advice like, “We don’t need a line monitor.” “You don’t need to clap after a movie because no one in the theater made the movie.” “Don’t leave a long message on an answering machine, just text.”

I had three thoughts when I first saw this commercial. First, I was amused. Second, the old guy in me thought, young people would benefit quite a bit from becoming their parents. But the rational guy in me questioned, in a fast-changing world, do we really want young people becoming their parents? The answer was an emphatic no.

My third thought was that Iowa Governor Kim Reynolds might benefit from a little advice on how not to become Donald Trump.

Governor Kim Reynolds’ re-election campaign continues to air a television commercial that plays on racist tropes in order to boost the governor among the largely white Iowa electorate.

Reynolds’ campaign spokesperson Pat Garrett has not replied to Bleeding Heartland’s inquiries about the commercial. But after Iowa Democratic Party chair Ross Wilburn denounced the ad as “a cheap, racist and dangerous stunt using harmful stereotypes to score political points,” Garrett told some other reporters that the spot “contrasts the failed policies supported by liberal Democrats across the country with the common sense leadership of Gov. Reynolds.”

Visual evidence shows the ad-makers were determined to create negative associations with Black women. The tactic would undermine the governor’s Democratic challenger Deidre DeJear.

The Iowa Democratic Party’s Progressive Caucus adopted a resolution that calls for Democrats and the state party to “reclaim” the label “pro-family.”

That resolution (enclosed in full below) is in direct response to Governor Kim Reynolds’ rhetoric implying that only the Republican Party believes “parents matter” and that Republicans are leading a “pro-family” agenda.

Every time we turn around, another article or report describes the child care crisis in Iowa. I’ve followed the statewide debate, participated in multiple local forums, and have been a child care consumer for the past four years.

When Governor Kim Reynolds convened her child care task force, I hoped that we would make progress, since this issue affects every zip code and county. Instead, we have continued to go around in circles, creating grants for centers and pushing “solutions” that fail to get to the heart of the issue.

Child care is an economic issue, a workforce issue, a childhood development issue, a child welfare issue, an equity issue, a women’s issue, an education issue, a state development issue – and more. It’s an “all of the above” issue. And since it’s foundational, it’s worth tackling.

Iowa’s Public Employment Relations Board (PERB) is transferring most of its staff and caseload to the state Department of Inspections and Appeals.

Since the mid-1970s, PERB members and administrative law judges have adjudicated labor disputes within state and local government or school districts. Following the changes, administrative law judges now working for PERB will handle other matters, while other employees at Inspections and Appeals will hear cases that were previously in PERB’s jurisdiction.

State officials have not announced the changes, which are scheduled to take effect on September 30. It’s not clear who initiated or authorized the plan. Staff in the governor’s office and Department of Inspections and Appeals did not respond to any of Bleeding Heartland’s inquiries over the past three weeks. PERB members Erik Helland and Cheryl Arnold likewise did not reply to several emails.

State Senator Nate Boulton, a Democrat with extensive experience as a labor attorney, has asked Attorney General Tom Miller for an official opinion on whether “it is an illegal shift of an essential PERB duty” to assign its responsibilities “to an unrelated state agency.”

Boulton also asked Miller to weigh in on the legality of Governor Kim Reynolds’ recent appointments to PERB. As Bleeding Heartland previously reported, Reynolds has circumvented the Senate confirmation process by keeping one of the three PERB positions unfilled, so she can name her preferred candidates to a vacant slot while the legislature is not in session.

Nothing happens in a campaign commercial by accident. Strategists plan every word and image, with the candidate’s approval. Directors may film many takes to get the perfect cadence for every line.

So Iowans should understand: the racist tropes in Governor Kim Reynolds’ latest tv ad are deliberate.

The home stretch of this midterm election campaign is unfolding in in 3-D format — Dire, Divisive, and Despairing. That’s particularly true of the U.S. Senate race between Republican incumbent Chuck Grassley, seeking his eighth term at age 89, and Democrat Michael Franken, a retired U.S. Navy admiral, who will be 65 on election day, November 8.

That 3-D nature of our Iowa politics was illustrated well in one of the Grassley campaign’s recent television commercials.

In a backhanded way, Grassley acknowledged why it is time for Iowans to vote him out of office.

The ACLU of Iowa filed new legal arguments last week in Iowa’s most important pending abortion rights case. Governor Kim Reynolds is seeking to reinstate a near-total abortion ban, which a Polk County District Court found unconstitutional in 2019.

Last month, private attorneys representing the state in this litigation (since Attorney General Tom Miller declined to do so) gave the District Court one big reason to lift the permanent injunction on a 2018 law that would ban almost all abortions after about six weeks.

In a response brief filed on behalf of Planned Parenthood of the Heartland, the ACLU gave the District Court several paths to reject the state’s request.

When former Republican Governor Terry Branstad signed executive order 85 in March 2014, he stated, “transparency provides Iowans the necessary access to information to hold our government accountable and our Open Records Act is essential to ensuring openness,” adding, “Our administration has maintained a steadfast commitment to a transparent government.”

Branstad held weekly press briefings to answer journalists’ questions.

However, when Kim Reynolds became governor in 2017, a few months after Republicans gained full control of the legislature, transparency went out the window. Accessing many kinds of government data has become more difficult.

Education

Iowans know our kids need a strong education to succeed in the future. But Governor Kim Reynolds wants to send more of our tax dollars to private schools, excluding certain children from opportunities by denying their public schools the resources they need.

Democrats want to invest $300 million in Iowa schools, but Corporate Kim Reynolds wants to give it to her wealthy donors and divert public education funds to private schools. We need a leader who will choose kids over corporations and support public schools so that every kid gets the education they deserve.

In another end run around the Iowa Senate confirmation process, Governor Kim Reynolds has named Cheryl Arnold to serve on Iowa’s Public Relations Board (PERB), which adjudicates labor disputes within state and local government or school districts.

The governor’s office has not publicly announced the nomination, and at this writing, the board’s website lists only one member (Erik Helland) on what Iowa law designates as a three-person board. Reynolds informed Secretary of the Iowa Senate Charlie Smithson about Arnold’s appointment in a letter dated August 15, which Smithson provided to Bleeding Heartland.

Arnold previously served as chair of the PERB for a little more than a year. She left the position after Iowa Senate Democrats voted against her nomination near the end of the 2020 legislative session. Appointments subject to Senate confirmation need a two-thirds vote for approval, giving Democrats the power to block nominations while in the minority.

The Iowa Ethics and Campaign Disclosure Board gave advance approval of Governor Kim Reynolds’ plan to deliver a nationally-televised speech on behalf of Republicans from state government property.

Reynolds delivered the GOP response to President Joe Biden’s State of the Union address from the terrace of the State Historical Building in downtown Des Moines. That part of the facility has been closed to the public all year due to renovations.

The Iowa Department of Cultural Affairs did not charge the governor’s office for the space, which previously cost thousands of dollars to rent. However, documents Bleeding Heartland obtained through public records requests show the Kim Reynolds for Iowa campaign and the CNN television network covered some other costs associated with the State of the Union response.

Iowa law prohibits “the expenditure of public moneys for political purposes.” But a few days before the March 1 speech, the ethics board’s executive director Zach Goodrich assured the governor’s senior legal counsel that based on his understanding of the facts, Reynolds “would not be in violation” of that code section if she spoke from the State Historical Building.

Iowa’s filing period for the 2022 general election closed on August 27 with no third-party candidate qualified for the ballot in any federal race, or any statewide race other than for governor and lieutenant governor.

The landscape could hardly be more different from four years ago, when the Libertarian Party of Iowa fielded a full slate of federal and statewide candidates, and no-party candidates also competed in three of the four U.S. House districts.

The lack of a third-party presence could be important if any of Iowa’s Congressional or statewide elections are close contests.

Like their counterparts across the country, top Iowa Republicans howled on August 24 when President Joe Biden rolled out a three-pronged student loan relief program.

Speaking at a town hall meeting, Senator Chuck Grassley asserted that it’s “unfair” to forgive some student loans but not help other people who struggle to repay their obligations.

U.S. Representative Ashley Hinson denounced the plan as a “handout to the wealthy and a total slap in the face” to working people who didn’t go to college or already paid off their student loans.

The outrage over student debt relief was striking, since Grassley and Hinson have not objected to some other federal government handouts, which benefited their own families.

Tom Barton wrote an excellent article for the Cedar Rapids Gazette about what’s at stake in this November’s vote on a pro-gun amendment to the Iowa Constitution. Republicans who pushed for the amendment have downplayed its potential impact on existing gun regulations. But legal experts told Barton some laws, such as a broad prohibition on firearms ownership by people with felony convictions, might not survive a court challenge if voters approve the constitutional amendment.

In a little-noticed passage tucked into a recent decision on abortion rights, a majority of Iowa Supreme Court justices suggested that existing gun regulations could be doomed under a “strict scrutiny” standard.

Politicians love spending time at the Iowa State Fair, and many candidates for state and federal offices made multiple visits this year. But in a break with a long-running practice, Republicans seeking statewide and federal offices mostly shunned the Des Moines Register’s Political Soapbox.

Just three of the eleven GOP candidates invited to the Soapbox were willing to devote 20 minutes of their state fair visit to a public speech outlining their agenda. Every elected Republican official steered clear.

Avoiding the Register’s platform is another sign of growing Republican hostility toward traditional Iowa media. Other recent examples: some GOP candidates refused to meet with high-profile editorial boards in 2018 and 2020, and Iowa Senate leaders abandoned more than a century of tradition to kick reporters off the chamber’s press bench this year.

More than four years after signing into law a ban on using public funds to promote the name, likeness, or voice of Iowa’s statewide elected officials in a “paid exhibit display at the Iowa state fair,” Governor Kim Reynolds continues to spend part of her office budget on an Iowa State Fair booth plastered with her name and picture.

Neither the Republican-controlled legislature nor the state board charged with enforcing the self-promotion law have taken any steps to remedy the situation.

Lawyers representing Governor Kim Reynolds have taken the first step toward reinstating a 2018 law that would ban nearly all abortions in Iowa. A Polk County District Court struck down that law in 2019, and Reynolds did not appeal the decision. A motion filed on August 11 asks the court to lift the permanent injunction, which was founded on Iowa and U.S. Supreme Court rulings that have since been reversed.

In a written statement amplified on her social media, Reynolds promised, “As long as I’m Governor, I will stand up for the sanctity of life and fight to protect the precious and innocent unborn lives.”

Left unsaid by the governor, but made clear by the legal brief her team filed: pregnant Iowans’ interests have almost no value in the eyes of the state.

Will four Iowa Supreme Court justices balance competing concerns the same way?

Iowa Republican politicians rarely question the actions of law enforcement officers in any context. But forced to choose between giving federal agents the benefit of the doubt and knee-jerk loyalty to former President Donald Trump, it wasn’t a close call.

People in the health care field have worked their tails off since the COVID-19 pandemic hit Iowa with a vengeance in 2020.

Doctors, nurses, and all manner of technicians and support staff have performed heroically under circumstances that often were trying.

But the death this year of a patient at a Centerville care center has struck a chord with many Iowans — and not just because COVID claimed another life. The reaction has ranged from sadness to anger because the person’s treatment was unprofessional, uncaring and incompetent, if not bordering on criminal.

The ACLU of Iowa and Planned Parenthood North Central States announced on August 5 that they will not pursue litigation challenging Iowa’s mandatory 24-hour waiting period before all abortions. The Iowa Supreme Court allowed that 2020 law to go into effect in June, when a 5-2 majority reversed the court’s abortion rights precedent and sent Planned Parenthood’s case back to District Court.

In a written statement, ACLU of Iowa legal director Rita Bettis Austen described the decision to dismiss the case as “extremely difficult.”

But the move was wise in light of Iowa’s current legal landscape. Dropping this challenge could push back by years any ruling by the conservative-dominated Iowa Supreme Court to establish a new legal standard for reviewing abortion restrictions. That could strengthen the position of Planned Parenthood and the ACLU as they fight grave threats to Iowans’ bodily autonomy.

As a kid, I loved fishing off the dock because it assured immediate action, since I could catch tiny fish as fast as my worm hit the water.

But my dad practiced real fishing. He’d pack a lunch and fish in a small boat all day, even if nothing but mosquitoes were biting. He was in it for the long term, and it paid off with big catches. If he didn’t catch anything one day, he’d try again the next. He understood big catches took patience.

Like my dad’s long-term fishing, Republicans understand culture wars aren’t about instant gratification. The best example is their 49-year battle against Roe v Wade. They eventually found a right-wing majority on the Supreme Court brazen enough to overturn settled law and rob women of privacy and thus choice.

But the new front in the culture war is clearly public education. The hard right seems determined to chip away through multiple avenues of attack. 

For a second straight year, Governor Kim Reynolds has reappointed Erik Helland to Iowa’s Public Employment Relations Board (PERB) after Helland failed to win Iowa Senate confirmation. In an apparent effort to circumvent the legally required confirmation process, Reynolds appointed Helland to a different position on the three-member board, which adjudicates labor disputes within state and local government or school districts.

She used the same maneuver last summer to name Helland as PERB chair after the Iowa Senate did not confirm him during the 2021 legislative session.

The governor has not filled the now-vacant position of PERB chair, saying in a recent letter to the top Iowa Senate staffer that her administration “has initiated, but has not yet completed, the selection process.” That leaves the board with no quorum; Reynolds has kept one position unfilled since August 2020.

The long-running vacancy allows the governor’s preferred nominees to remain on the board, even if they don’t receive a two-thirds confirmation vote in the state Senate. Asked for comment on Helland’s reappointment, the Democratic senators who reviewed the PERB nominees accused the governor of “a partisan power grab” and “rigging the appointment process so she can get her way.”

Reynolds’ spokesperson Alex Murphy did not respond to eight inquiries about the PERB appointments between late May and July 28.

In 2019 I wrote a Bleeding Heartland article about the growing disparity between administrative and teacher salaries. At the time I didn’t anticipate that the situation would get much worse. I hoped that Iowa’s ever-increasing rainy day funds might be used when pay became more of a problem. 

Regrettably, here I am again three years later, encouraging Iowans to focus on what has become a major issue.

Question: Should “We the people” of Iowa pay for our government not telling us what it is doing?

Answer: The question is rhetorical, because we already do so—even though as a matter of principle and given the intent of Iowa’s Sunshine laws, we should not.

The center of this Q&A is the Iowa Public Information Board (IPIB). When created in 2012, after years of work with state lawmakers, the board was heralded. The concept was, challenges to government secrecy would be subject to quick, inexpensive answers. No need to hire a lawyer to represent your concerns.

But two good commentaries illustrate how those dreams were more like delusions.

Top Iowa Republicans crowed this month when the state’s official figures showed the GOP had expanded its voter registration lead over Democrats. At this point in the 2018 election cycle, registered Republicans outnumbered Democrats in Iowa by around 24,000. The current disparity is more than three times as large. According to the latest numbers released by the Secretary of State’s office, Iowa has 681,871 active registered Republicans, 597,120 Democrats, and 555,988 no-party voters.

The voter registration totals should concern Democrats, but two other trends facing the party’s candidates in this midterm election should worry them more.

Longtime advocates for access to public records in Iowa expressed concern this week about new administrative rules proposed by the Iowa Public Information Board.

The draft rules would spell out requirements for acknowledging and responding “promptly” to public records requests, but would also create a new excuse for government bodies that fail to provide timely access to records. Nothing in Iowa’s open records statute, known as Chapter 22, authorizes the board’s proposed language on “unforeseen circumstances,” nor is that concept consistent with Iowa Supreme Court precedent.

The Iowa Supreme Court has rejected Governor Kim Reynolds’ request that it quickly green-light any and all abortion restrictions the state might enact.

The action means that it could be years before the high court determines whether the state constitution guarantees any level of bodily autonomy for pregnant Iowans.

New restrictions on absentee voting prevented hundreds of Iowans from having their ballots counted in the June 7 primary election, Bleeding Heartland’s review of data from county auditors shows.

About 150 ballots that would have been valid under previous Iowa law were not counted due to a bill Republican legislators and Governor Kim Reynolds enacted in 2021, which required all absentee ballots to arrive at county auditors’ offices by 8:00 pm on election day. The majority of Iowans whose ballots arrived too late (despite being mailed before the election) were trying to vote in the Republican primary.

Hundreds more Iowans would have been able to vote by mail prior to the 2021 changes, but missed the new deadline for submitting an absentee ballot request form. More than half of them did not manage to cast a ballot another way in the June 7 election.

The new deadlines will trip up many more Iowans for the November election, when turnout will likely be about three times the level seen in this year’s primary, and more “snowbirds” attempt to vote by mail in Iowa from other states.

In the immediate aftermath of the January 6, 2021 coup attempt, Governor Kim Reynolds condemned the attack on the U.S. Capitol and called for prosecuting those who incited violence “to the full extent.”

But as a U.S. House Select Committee uncovers more evidence of former President Donald Trump’s apparent criminal conspiracy to subvert the peaceful transfer of power, Reynolds is “not paying any attention” to the investigation, she told reporters this week.

Governor Kim Reynolds announced on June 28 that she will seek to lift an injunction on a 2018 law that would have banned almost all abortions in Iowa. After that law was struck down in early 2019, Reynolds opted not to appeal the decision, due to an Iowa Supreme Court precedent that is no longer operative.

The governor will also ask the Iowa Supreme Court to rehear a recently-decided abortion case, taking into account the U.S. Supreme Court’s majority opinion that overturned the Roe v Wade and Casey precedents.
