In a highly unusual move, the Iowa Department of Public Health (IDPH) announced on the afternoon of April 12 that the Medical Cannabidiol Advisory Board had rescheduled its planned meeting. Instead of convening for two and a half hours on May 3, the board would meet for one hour on April 16.

Members called the shorter, rushed meeting in order to discuss recommendations on the tetrahydracannabinol or THC cap and purchase limits in a bill the Iowa House approved last month.

As state lawmakers wrap up their work for 2019, one of the biggest question marks surrounds MidAmerican Energy’s push to make future solar development unaffordable for most Iowa homeowners and small businesses.

Four weeks after the bill cleared the Iowa Senate, it is still hung up in the House, where a group of Republicans recently took an unusual step to signal their opposition.

Republican attacks on working Iowans have received less attention this year than in 2017, when new laws shredded public employee collective bargaining rights, blocked local governments from raising the minimum wage, and reduced workers’ compensation benefits, especially for those who hurt their shoulder on the job.

But below the radar, GOP lawmakers have moved several bills lately that would make life harder for working people, including some facing the difficult circumstances of unemployment or workplace injury.

It is a common canard among the anti-property taxers that city and county governments, those closest to the electorate, are gouging unsuspecting taxpayers. It is their rallying lament, and it requires no substantiation, just confident assertion.

As is frequently the case with made-up woes like this, Iowa House Republicans have a solution. The remedy is House Study Bill 165, a bill to place limits on city and county government property tax growth.

Key lawmakers said for months the 3 percent tetrahydrocannabinol (THC) cap would never be lifted unless Iowa’s Medical Cannabidiol Advisory Board recommended doing so. Nevertheless, the Iowa House mysteriously decided to lift the 3 percent cap on THC shortly before the first legislative funnel deadline on March 8.

Only three months in, 2019 is already the most significant year for transgender equality in Iowa since 2007, when state lawmakers and Governor Chet Culver added sexual orientation and gender identity to the list of protected classes in the Iowa Civil Rights Act. That 1965 law hadn’t been significantly amended in decades.

The crucial Iowa House and Senate votes on the civil rights law happened during the first year since the 1960s that Democrats controlled both legislative chambers and the governor’s office. Support for LGBTQ equality is often taken for granted now in Democratic circles, but the issue was seen as more politically volatile twelve years ago. The bill amending the civil rights act came late in the 2007 legislative session and could not have passed without some Republican votes.

UPDATE: The Iowa House approved an amended version of Senate File 548 on a mostly party-line 52 to 44 vote. The Senate approved the bill by 33 votes to 17. Governor Kim Reynolds signed the bill on May 9.

Iowans are dealing with the aftermath of receding flood waters this week. Heart-wrenching stories have emerged about returning to decimated homes, topsoil-choked streams headed for the Gulf of Mexico, and the sad task of removing lifeless bodies of young calves who couldn’t withstand the deluge.

Commentators and elected officials are missing the point – or at least failing to bring proper attention to – the obvious and science-based solution to not only water quantity but water quality crises facing our state. We must adopt policy and pass laws that slow down the water running off of our farm fields. That task starts with the federal Farm Bill but ends here at home with efforts to replace Iowa’s lax environmental rules with meaningful protections for land and water.

Senate File 548, the bill that would restrict the use of loans from the State Revolving Fund to purchase land for water quality projects, is a step in the wrong direction.

The Des Moines Register reported on March 29 that a member of the Iowa Medical Cannibidiol Advisory Board had resigned over comments made on the floor of the House during debate on House File 732. (Bleeding Heartland covered that bill’s passage here.)

Two years ago, State Senator Jake Chapman’s Republican colleagues slapped down his efforts to force a Senate vote on language declaring that life begins at conception, with every fertilized egg “accorded the same rights and protections guaranteed to all persons.”

This week, Republicans helped Chapman accomplish what he failed to do then: sneak “personhood” language into a bill during Senate floor debate.

“Is it perfect? No, it’s not perfect. Are we moving in the right direction? Absolutely,” Democratic State Representative Wes Breckenridge said shortly before Iowa House members approved a bill to improve our state’s medical cannabis program.

House File 732 would allow some Iowans to use more potent products and would make it easier for some patients to apply for a registration card. The House passed the bill by 96 votes to three after Breckenridge and Republican State Representative Jarad Klein praised each other’s consensus-seeking.

But for a suspenseful few minutes during the March 26 floor debate, the future of the bill was in doubt because of a first-term Republican’s far-reaching amendment.

You don’t hear this every day: in an Iowa House speech on March 21, Democratic State Representative Kirsten Running-Marquardt repeatedly thanked GOP colleagues for their work on a bill she opposed. House File 531 changed some aspects of our state’s unemployment insurance and benefits system. The first draft was much worse than the legislation House Republicans approved on a party-line vote this week.

The bill’s floor manager, State Representative Gary Worthan, warned that next year, lawmakers may return to a idea jettisoned following intense opposition from Democrats and labor groups.

Children supervised by a responsible adult would be able to hunt deer with a “pistol or revolver” under a bill the Iowa House approved on March 20, mostly along party lines.

House members rejected a Democratic effort to restore language that had gained bipartisan support in committee and would have required minors to complete a hunter education course before using such weapons for hunting.

The Associated Press is reporting today that 50 people, including several television celebrities, have been charged in connection with a scheme to get their children accepted to college athletic teams after offering bribes to college coaches and other collegiate insiders.

While not directly on point, this is very concerning in light of the state legislature’s apparent desire to legalize sports betting in Iowa casinos, not to mention the extremely arrogant position taken by Prairie Meadows to construct a facility before the enabling legislation was even introduced.

Have you heard legislators saying they are authorizing federal criminal activity here in Iowa? It’s true.

A bill that would provide state “education savings grants” to families of some children attending private schools lacks the support to move forward in either the Iowa House or Senate, state Senate President Charles Schneider told constituents at a March 9 legislative forum.

MidAmerican Energy’s effort to crush small-scale solar generation made it through the Iowa legislature’s first “funnel” and will be eligible for floor debate in both chambers. The House Commerce Committee on March 4 approved House Study Bill 185 (now renamed House File 669) without amendment on a party-line 12 to 10 vote. The Senate Commerce Committee amended the companion Senate Study Bill 1201 before advancing it on March 7.

The bill will likely pass the upper chamber, where Republicans have a 32 to 17 majority. Although Republicans outnumber Democrats by 54 to 46 in the House, and MidAmerican’s political action committee donated to dozens of incumbents’ campaigns last year, getting the solar bill through the lower chamber will be no easy task. A utility-backed bill to undercut energy efficiency programs was one of the heaviest lifts during the 2018 session. Only after several concessions did supporters cobble together 52 Republican votes in the House. The GOP held 59 seats at that time.

More than three dozen corporations, industry groups, or advocacy organizations have lobbyists registered for or against MidAmerican’s solar bill. While it’s not unusual for a high-profile bill to draw that kind of attention, the two camps seeking to persuade legislators on this issue reflect alliances rarely seen at the statehouse.

Iowans were up in arms this week in reaction to two bad bills aimed at restricting acquisition or expansion of public lands. House File 542, introduced by Republican State Representative David Seick, and Senate Study Bill 1221, introduced by GOP State Senator Ken Rozenboom, would severely limit the ability for state agencies, cities and counties, and private citizens to acquire or donate land for public projects.

In a state with just 2 percent of land in public holding, these bills were a drastic overreach to answer a problem that doesn’t exist.

The Iowa House Judiciary Committee unanimously voted on March 6 to advance a state constitutional amendment on automatic restoration of voting rights after an offender has completed a felony sentence. The action indicates one of Governor Kim Reynolds’ priorities for the 2019 legislative session should clear the lower chamber with little resistance.

Very difficult but not impossible. That was what we knew about getting Karin Derry elected.

In 2016, the Republican incumbent Jake Highfill won with 57 percent of the vote. Going into 2018, 36 percent of voters in our district were registered as Republicans, compared to 25 percent registered as Democrats.

Bleak numbers, but when you believe that what you want is what most people want – a strong public education system, accessible and affordable healthcare, reasonable environmental protections, sensible policies to make taxation fair and the economy grow – then it simply becomes a matter of getting the word out. Talking to voters. Being real. Karin would speak of how her wonderful father had been a Reagan Republican, but that party is not today’s party. I think that fact resonated with many people across the political spectrum.

The controversial 2018 election result in Iowa House district 55 has inspired two legislative proposals related to late-arriving absentee ballots. The House State Government Committee on March 5 advanced a bill designed to enfranchise more Iowans who voted by mail, with uniform rules for all 99 counties.

The leader of the Iowa Senate State Government Committee would move in the opposite direction, excluding all ballots that arrive after election day, even if envelope markings could prove voters mailed them on time. That approach appears to be a non-starter for House Republicans.

Looks like the utilities and electric cooperatives are up to no good. A new “dark money” organization just launched ads on Facebook.

The “REAL” Coalition began advertising on Facebook on March 1, arguing for legislation that would undermine net metering. The REAL Coalition is doing this under the guise of promoting renewable and clean energy.

Republican State Representative Dean Fisher has less than one week left to do the right thing for Iowa’s rural communities, independent farms, and water quality.

Fisher has a choice to make this week. As chair of the House Environmental Protection committee, he is single-handedly holding up progress on a bill that would enact a moratorium on new and expanding factory farms. We aren’t talking about a floor vote or even a committee vote– we’re talking his outright refusal to even assign the bill to a subcommittee so that it could be debated.

As bad-faith political arguments go, it would be hard to top a headline from a recent Iowa House Republican newsletter, amplified on Twitter: “Congressional Democrats Plan to Overturn Nonpartisan Redistricting in Iowa.”

U.S. House Resolution 1 was designed to ban gerrymandering nationwide “by requiring independent commissions instead of state legislatures to draw congressional maps.” But in the Iowa GOP’s fun-house-mirror view, the federal bill would “inject politics into an already nonpartisan redistricting process.”

The good news is, this stunt puts House Republicans on record opposing any change to the system in use since the 1980s. “There’s no reason to change a process in Iowa that is respected throughout the country and is working well,” the newsletter argues.

The next step is getting top lawmakers and Governor Kim Reynolds to promise not to exploit a little-known provision in state law to enact a gerrymander in 2021.

Envelopes containing 29 absentee ballots that Winneshiek County voters mailed on time will likely remain sealed forever. Time has run out for Democratic candidate Kayla Koether to sue over how Iowa House Republicans handled her contest of the 2018 election result in House district 55.

It is also too late for any disenfranchised voter to challenge a process that placed an administrative rule about mail barcodes above the fundamental right to vote guaranteed by Article II of Iowa’s constitution.

This week the U.S. House approved the most significant regulations on gun sales to pass the lower chamber of Congress in 25 years.

Meanwhile, Republicans in the Iowa legislature advanced a constitutional amendment that could invalidate nearly every state-level restriction on firearms ownership or sales.

The Iowa legislature must clarify the law that determines the timeliness of absentee ballots. Some 41 percent of Iowans who participated in the 2018 election voted early, according to the Secretary of State’s certified results. That’s 547,205 ballots!

Those are the known, counted absentee ballots. Some of them may not have complied with the postmark requirement, but were counted anyway. In the very tight election for Iowa House district 55, where only nine votes separated the candidates, Winneshiek County rejected 29 late-arriving absentee ballots without a postmark. But those ballots did have an intelligent mail barcode, proving they entered the postal service before election day. The dispute centered on what kind of mail barcode.

The 2019 legislative session started off with a whimper as Republicans approved inadequate public education funding once again. Governor Kim Reynolds’ 2.3 percent budget request for K-12 funding was meet with an even less impressive proposal in the House and Senate – 2.06 percent. The House and Senate Democrats and Iowa State Education Association all suggested 3.0 percent and were voted down in short order.

Let me be clear: 2.06 percent is below the rate of inflation and not adequate. The result will be more layoffs, program cuts and more desperation to make ends meet in school districts all over the state.

Ever since the 2009 Iowa Supreme Court decision legalizing same-sex marriage, conservative groups and legislators have attempted to reign in what they describe as an “activist” court. Never mind that that opinion, Varnum v. Brien, was a deliberate and thoughtful walk through equal protection analysis. Conservatives simply didn’t like the decision because it wasn’t the result they wanted.

A new bill backed by MidAmerican Energy would devastate the ability of Iowans to install solar panels for their homes or businesses. House Study Bill 185 would undo a longstanding policy of net metering, which “allows residential and commercial customers who generate their own electricity from solar power to feed electricity they do not use back into the grid.”

Iowans served by monopoly providers MidAmerican or Alliant Energy have been able to use net metering since the 1980s, under rules adopted by the Iowa Utilities Board.

In recent years, MidAmerican has periodically sought to subvert net metering in various ways. Environmental advocates have been concerned the policy would become the next target for Republican lawmakers who destroyed Iowa’s decades-old, successful energy-efficiency programs last year at the behest of utility companies.

State Representative Gary Carlson introduced House Study Bill 185 this morning in his capacity as leader of the Iowa House Commerce Committee. MidAmerican’s lobbyist immediately registered in favor–often a sign that an interest group or company had a hand in writing legislation. The utility’s media relations staff did not respond to an inquiry about why the company is pushing this bill.

Some Republicans have encouraged State Representative Jon Jacobsen to run for Congress in Iowa’s third district, and he’s not ruling it out, though he will not decide anytime soon.

Republican lawmakers and Governor Kim Reynolds are poised to give GOP officials and their proxies control over what has been a mostly non-partisan system for choosing Iowa judges since 1962.

Until a couple of months ago, I didn’t realize the Republican trifecta could blow up our judicial selection process in a matter of weeks. The Iowa Constitution spells out how vacancies on the bench are filled, and altering any language in our state’s founding document takes years.

Unfortunately, a time bomb has lurked in Article V, Section 16 for more than five decades. While most elements of the system can be changed only through a constitutional amendment, the manner of forming judicial nominating commissions (half appointed by the governor, half elected by attorneys) is specified only “Until July 4, 1973, and thereafter unless otherwise provided by law.”

How did that language end up in the constitution? A Linn County Democrat offered a fateful amendment 60 years ago.

Republican lawmakers have unveiled their plan to replace Iowa’s merit-based system for choosing judges with a process dominated by politicians from their own party. Governor Kim Reynolds quickly gave the bill her blessing, just weeks after she said of judicial selection, “we don’t want it to be political.”

Despite record low temperatures outside, the room was packed for the January 31 Iowa House Judiciary subcommittee meeting to consider House Study Bill 68, a constitutional amendment proposed by Governor Kim Reynolds.

The first Iowa House floor votes of 2019 are in the books, and they played out exactly as you’d expect. On two straight party-line votes, 53 Republicans rejected a Democratic effort to allow legally cast absentee ballots to be counted, then dismissed Kayla Koether’s contest of the House district 55 election result.

The chamber’s January 28 debate was enlightening. If you have a few hours to spare, I recommend watching the videos of the afternoon and evening sessions on the legislative website.

My takeaways:

Every Iowa House Republican will likely vote on January 28 to dismiss Democrat Kayla Koether’s contest of the House district 55 election. She trails State Representative Michael Bergan by nine votes according to certified results, but 29 absentee ballots that voters in Winneshiek County mailed on time remain uncounted.

Although Republicans on a special House election contest committee insist “there exists no legal authority to open and count the twenty-nine ballots in question,” they are wrong about the law. Dismissing the contest without allowing Koether to call witnesses, take depositions, or have the ballots opened will open the door to judicial review.

It’s also terrible politics.
