U.S. Senator Joni Ernst told Iowa reporters in October that if articles of impeachment were referred to the Senate, she would “evaluate the facts” as a “jurist.”

Senator Chuck Grassley voted to allow deposition of witnesses in President Bill Clinton’s impeachment trial, explaining at the time he was supporting “a tightly disciplined legal process to get the information needed to help clear up important discrepancies on the record. Witnesses will not be called simply for the sake of calling witnesses. Seeking this information is important to a process that is judicious.”

Yet Iowa’s senators joined all of their Republican colleagues on January 21 to prevent senators from examining any documents the White House is withholding and from hearing any witness testimony about President Donald Trump’s conduct.

U.S. Senator Joni Ernst has brushed off as “moot” a new finding that the Trump administration broke federal law by withholding security assistance to Ukraine during the summer of 2019.

The U.S. Government Accountability Office said in a January 16 report that the Office of Management and Budget (OMB) violated the Impoundment Control Act when it withheld funds from the Defense Department. “Faithful execution of the law does not permit the President to substitute his own policy priorities for those that Congress has enacted into law.”

Ernst has long advocated increasing our country’s military support for Ukraine. But speaking to Iowa media this morning (audio), she suggested the GAO findings were not relevant, since Ukraine eventually received the assistance Congress approved.

Before the new political year kicks off with the Iowa legislature convening and Governor Kim Reynolds laying out her agenda, I need to take care of some unfinished business from 2019.

When I reflect on my work at the end of each year, I like to take stock of not only the most popular posts published on this website and the ones I worked hardest on, but also the projects that brought me the most joy. I’ve found this exercise helps guide my editorial decisions on the many days when I have time to write up only one of several newsworthy stories.

After interviewing twelve applicants, the State Judicial Nominating Commission forwarded three names to Governor Kim Reynolds on January 9 to fill the vacancy created by Iowa Supreme Court Chief Justice Mark Cady’s passing in November.  Reynolds has 30 days to appoint one of the finalists, but there’s no suspense here: she will almost certainly choose Matthew McDermott.

A computer program couldn’t generate a more ideal judicial candidate for a Republican governor seeking to move Iowa courts to the right.

Iowa experienced enormous natural disasters in 2019, and climate change accelerated the devastation. 

The National Wildlife Federation released an interactive national climate disaster report in November, which illustrated that Iowa’s historic floods and extreme heat were attributable to climate change. The report also predicted continued disastrous weather conditions as the effects of climate change continue to build.

Chasing traffic never has been and never will be my primary goal for Bleeding Heartland. If it were, I’d publish weekly posts about puppies or Casey’s pizza instead of Iowa wildflowers.

And anyone who has worked on an online news source can vouch for me: a writer’s favorite projects are often not the ones that get the most clicks.

Still, people do ask me from time what posts tend to do well, and I find it fun at year-end to recap the pieces that were particularly popular with readers. Since I started this exercise a few years ago, I’ve always uncovered some surprises.

After the wipeout of 2016, I questioned whether Iowa’s top races of 2018 and 2020 would be foregone conclusions for the Republican incumbents. But amid unusually high turnout for a midterm election, Democratic challengers flipped two U.S. House seats and fell only a few points short against Governor Kim Reynolds and Representative Steve King.

One of my goals for 2019 was to provide in-depth reporting on Iowa’s federal and state legislative races. Thanks to our nonpartisan redistricting system, none of our four Congressional districts are considered safe for either party in 2020. While U.S. Senator Joni Ernst is still favored to win a second term, she is increasingly seen as a vulnerable GOP incumbent.

Five Democrats are now competing for the chance to take on U.S. Senator Joni Ernst next November. After making low-key appearances at Democratic events around Iowa for about six months, Cal Woods made his candidacy official on December 17.

Assuming all five candidates file nominating petitions in March, the crowded field increases the chance that no one will win the nomination outright in the June 3 primary.

The U.S. House and Senate managed to wrap up their work for the year without shutting down the government, an improvement on the state of affairs when the fully Republican-controlled Congress left for the winter holiday break in 2018.

The two huge bills contained about $1.4 trillion in spending, which will keep the federal government open through the end of the current fiscal year on September 30, 2020. President Donald Trump signed the legislation.

Governor Kim Reynolds and U.S. Senators Chuck Grassley and Joni Ernst praised President Donald Trump in October, when the administration gave assurances corn growers and the ethanol industry would get what they wanted from the Environmental Protection Agency’s 2020 Renewable Fuel Standard (RFS) guidelines. The governor and senators were among Midwest Republicans who had lobbied Trump on the issue in September.

When the final rule released this week didn’t match the promises, biofuels advocates slammed Trump for not keeping his word to farmers. But top Iowa Republicans let the president off the hook by shifting the blame to the EPA.

A new poll commissioned by a Democratic-aligned political action committee suggests President Donald Trump and U.S. Senator Joni Ernst are vulnerable in Iowa, which voted for Trump by more than 9 points in 2016 and last turned out a sitting U.S. senator in 1984.

How worried should these Republican incumbents be?

U.S. Senator Joni Ernst introduced a potential major donor to one of her campaign’s fundraisers, who later asked that person for a “an investment of $50,000” in a dark money group backing Ernst’s re-election, Brian Slodysko reported for the Associated Press on December 6.

Slodysko’s scoop uncovered what may be illegal coordination between the Ernst campaign and the Iowa Values group, which can accept unlimited contributions without disclosing donors.

It wasn’t the first time Ernst’s campaign ventured into a gray area.

Being in Iowa, it won’t take long to hear U.S. Senator Joni Ernst talk about the importance of trade.

While Ernst has made good points about the United States Mexico Canada Agreement and ongoing talks with China, the junior senator’s actions on another trade-related issue are a different story. She has dismissed and disregarded the Paris Climate Agreement and all its trade potential.

President Donald Trump has finally admitted that he illegally used a Des Moines fundraiser for veterans to boost his 2016 campaign.

Months of work on reauthorizing the Violence Against Women Act, which lapsed in February, “came to a screeching halt” this week, U.S. Senator Joni Ernst announced on the Senate floor on November 7.

For 25 years, that federal law has supported “criminal justice and community-based responses to domestic violence, dating violence, sexual assault and stalking in the United States.” Congress has reauthorized it three times, each time with improvements. By Ernst’s telling, “Democrats are putting politics ahead of people,” rejecting a bipartisan approach to revive the law in favor of “non-starter” legislation the U.S. House approved in April.

Some salient facts were missing from Ernst’s narrative. The House bill to reauthorize the Violence Against Women Act was bipartisan: 33 Republicans voted for it.

Ernst also left out a few relevant words: guns, firearms, and National Rifle Association.

The U.S. House voted mostly along party lines (232 votes to 196) on October 31 to approve rules for an impeachment inquiry. Iowa’s four House members split as one would expect: Democratic Representatives Abby Finkenauer (IA-01), Dave Loebsack (IA-02), and Cindy Axne (IA-03) voted for the resolution, while Republican Steve King (IA-04) opposed it.

The New York Times explained that the resolution

authorizes the House Intelligence Committee — the panel that has been leading the investigation and conducting private depositions — to convene public hearings and produce a report that will guide the Judiciary Committee as it considers whether to draft articles of impeachment against President Trump.

The measure also gives the president rights in the Judiciary Committee, allowing his lawyers to participate in hearings and giving Republicans the chance to request subpoenas for witnesses and documents. But the White House says it still did not provide “basic due process rights,” and Republicans complain that their ability to issue subpoenas is limited. They would need the consent of Democrats, or a vote of a majority of members. That has been standard in previous modern impeachments. The majority has the final say over how the proceedings unfold.

I enclose below statements from Finkenauer, Loebsack, and U.S. Senator Chuck Grassley. I will update this post as needed with comments from the other members of the Congressional delegation. Grassley’s mind appears to be made up: “This entire process has been contaminated from the beginning and the Senate may have a difficult time taking seriously an impeachment founded on these bases.” That’s comical, given that Iowa’s senior senator voted to remove President Bill Clinton from office on charges stemming from an investigation into unrelated property transactions.

U.S. Senator Joni Ernst repeatedly insisted today that she will evaluate any evidence about President Donald Trump’s wrongdoing as a “jurist.” But in her first conference call with Iowa reporters since mid-September, Ernst didn’t sound like a juror with an open mind about the case.

On the contrary, the senator expertly echoed White House talking points, from denouncing a “political show” and unfair process to using Trump’s derisive nickname for a key House committee chair.

U.S. Representative Steve King (IA-04) was among House Republicans who interrupted a secure hearing on October 23 to protest the Democrats’ impeachment process.

Iowans haven’t voted out a sitting U.S. senator since 1984, but several recent events have caused political observers to question Senator Joni Ernst’s strengths going into her first re-election bid.

Inside Elections changed its rating on Iowa’s 2020 U.S. Senate race from “likely Republican” to “lean Republican” this month. (Sabato’s Crystal Ball already rated the IA-Sen race “lean R,” while the Cook Political Report still sees a GOP hold likely.) Writing at the National Journal on October 20, Josh Kraushaar cited several “major red flags suggesting Iowa is a much bigger battleground than Republicans anticipated at the beginning of the year.”

Ernst told supporters at a closed-door fundraiser with Vice President Mike Pence this month that she is the fifth most-vulnerable senator, according to Jennifer Jacobs of Bloomberg News.

What’s going on?

Well, you have to wonder when a farmer from Rippey decides that it is time to challenge the statistical findings of an economist (and a well known and very well-respected economist like Dave Swenson), but here is my mighty swing at explaining why the ethanol industry’s problems are a demand-driven crisis, not a supply-driven crisis as Mr. Swenson contends.

My initial premise is that the sky is NOT falling. Rather, the ceiling has been lowering itself at a steady rate since Donald Trump took office and installed his EPA leadership. The demise of three Iowa ethanol plants during the past month are merely the first indications of the straw that broke the camel’s back.

The sky is falling and Midwest rural economies are in danger of collapse. So say the nation’s ethanol producers, corn farmers, and like-minded politicians.

Their collective fingers are pointing at the federal Environmental Protection Agency’s granting of 31 waivers to U.S. refineries lowering the amount of biofuels they are required to blend into the petro-fuels they distribute. The waivers, the stakeholders claim, are the cause of a string of biorefinery closings and idlings.

Working through this, however, does not lead one to necessarily conclude that the infamous 31 waivers are the chief culprits.

2019 has been a disappointing year for environmental protections, from the Trump administration allowing drilling in the Arctic Circle to Congress failing to renew the Endangered Species Act.

This year’s Iowa Climate Strike was a march of hope, and we hope a majority of Iowans can unite in support of environmental protection. In climate strikes across Iowa and all over the world, people marched in solitary with scientists who have gone from sounding alarm bells to screaming from the roof tops that our climate cannot sustain the amount of pollution we are putting into the atmosphere.

For the second time this year, the U.S. Senate has approved a resolution terminating the national emergency President Donald Trump declared in February in order to start building a border wall without Congressional authorization. Eleven Republicans joined all Democrats present in the September 25 vote (roll call). The rest of the GOP caucus, including Iowa’s Senators Chuck Grassley and Joni Ernst, voted against it.

After weeks or months of avoiding public comment on the topic, all three Iowa Democrats in the U.S. House expressed support for a formal impeachment inquiry on September 24, the same day House Speaker Nancy Pelosi announced, “I’m directing our six committees to proceed with their investigations under that umbrella of impeachment inquiry.”

U.S. Senator Joni Ernst is among Ukraine’s most vocal supporters in Congress. While in college, she visited the Ukrainian Republic of the USSR as part of an agricultural exchange. Now a member of the bipartisan Senate Ukraine Caucus, she has met with high-level Ukrainian officials in Washington and Kyiv, advocating for the U.S. to “make it clear to Russia that we will stand by Ukraine in the face of unjustified aggression.”

Yet Iowa’s junior senator has been silent this week as multiple news organizations reported that President Donald Trump abused his power to seek political assistance from his Ukrainian counterpart.

Labor Day traditionally marks the beginning of the most intense phase of campaigning in election years. This holiday is also a good time to review the state of play in races for federal offices in odd-numbered years. Though new candidates could emerge at any time before Iowa’s March 2020 filing deadline–Patty Judge was a late arrival to the Democratic U.S. Senate field in 2016–it’s more typical for federal candidates here to kick off their campaigns by the end of summer the year before the election.

Thanks to Iowa’s non-partisan redistricting system, all four U.S. House races here could be competitive in 2020, and our Senate race is on the map–in contrast to 2016, when Senator Chuck Grassley’s re-election was almost a foregone conclusion.

A fourth Democrat officially entered the U.S. Senate primary this morning. Retired three-star Admiral Mike Franken introduced himself to voters by recalling his opposition to the Iraq War nearly seventeen years ago.

Congress enacted the Violence Against Women Act (VAWA) in 1994 as part of a large crime bill. The law created a system to provide support and programs for victims of sexual assault and domestic violence, as well as a framework of legal enforcement against perpetrators.

In the ensuing 25 years, VAWA has been strengthened and expanded, as policy-makers recognized gaps in the law and changing societal needs. Sadly, this legislation fell victim to the budget battles of late 2018 and lapsed without reauthorization by Congress in December.

The National Republican Senatorial Committee put up a billboard on a busy Des Moines street this week, seeming to attack Democrat Kimberly Graham. It’s part of a strategy to elevate the profiles of “lower-tier candidates” for U.S. Senate in states including North Carolina, Maine, Colorado, and Georgia, Nathan Gonzales reported for Roll Call on August 14.

Despite flooding that devastated the state of Iowa this Spring, our junior U.S. Senator Joni Ernst continues to ignore the climate crisis and to support President Donald Trump’s toxic agenda, which is harming Iowa’s health and economy.

At a recent town hall in Denison, Ernst heard from a Manning constituent, Peter Leo, about the need to act on the climate crisis. Instead of finding common ground, Ernst made the concern a laughing matter and suggested that combating climate change would “crater our economy.”

Matt Whitaker will become a managing director for the Kansas City-based Clout Public Affairs consulting firm, Jennifer Jacobs of Bloomberg News was first to report on August 1. Whitaker served as chief of staff for U.S. Attorney General Jeff Sessions for a little more than a year before President Donald Trump named him acting attorney general in November 2018, flouting a federal law and a constitutional requirement that anyone holding that position be confirmed by the U.S. Senate.

Whitaker stepped down as acting attorney general in February, after the Senate confirmed William Barr. He was “counselor in the associate attorney general’s office” for just a few weeks before leaving the Justice Department in early March. Jacobs tweeted on August 1, “There was speculation Trump would appoint Whitaker to another admin job, but the president so far hasn’t made any moves to do so, I’m told.”

Two more horrific gun crimes devastated American cities this weekend. Hours after an attacker fueled by anti-immigrant hate killed 20 and wounded dozens at a shopping center in El Paso, Texas, a shooter using a high-capacity magazine in Dayton, Ohio killed nine people and injured 26 in less than a minute. Last weekend, a famous annual garlic festival in California joined the long list of venues where shooters have killed many people in minutes.

While no one law would would end all mass shootings in the United States, a few gun violence prevention policies could reduce the carnage that is almost unknown in countries with stricter limits on firearms ownership or access.

Iowa’s U.S. Senators Chuck Grassley and Joni Ernst have consistently opposed those policies.

U.S. Senator Joni Ernst made headlines in Iowa and national media this week when she told reporters on a conference call she “will not be endorsing anyone” for the Republican nomination in the fourth Congressional district.

Strictly speaking, her announcement wasn’t news. Within days of State Senator Randy Feenstra’s campaign launch in January, Ernst said she didn’t plan to endorse in the IA-04 primary, Bret Hayworth reported for the Sioux City Journal at the time.

Many commentators have viewed Ernst’s distancing as a political blow to King, whom she enthusiastically endorsed the first time he faced a GOP primary challenger. Similarly, Governor Kim Reynolds and Senator Chuck Grassley backed King in that 2016 race but have vowed to stay neutral before next June’s primary.

While King would surely welcome the backing of Republican heavyweights for what may be the toughest race of his career, Feenstra likely needs that boost more.

Some incumbency advantages in campaigns are inevitable, like higher name ID and greater ability to raise money from interest groups.

Others are undeserved.

Bleeding Heartland has noted before that Iowa members of Congress, especially U.S. Senators Chuck Grassley and Joni Ernst, greatly influence media coverage of their activities. If these elected officials don’t brag about it in a news release or conference call with reporters, Iowans are unlikely ever to hear that it happened. As a result, stories that would shine an unflattering light on the senators largely stay out of the news.

Articles about campaign fundraising shouldn’t suffer from the same dynamic. Journalists can easily do original reporting without being on the ground in Washington. Anyone can access filings on the Federal Election Commission website and convey the key figures to readers.

Yet too often, what Iowans learn about political fundraising is largely written by campaign strategists.

Like many others across the nation, Iowans are eager to hear what Special Counsel Robert Mueller will say in his Congressional hearing, now rescheduled for July 24. All eyes and ears will be tuned in to hear the normally tight-lipped Mueller as he is questioned by both the House Judiciary and Intelligence Committees.

The Justice Department has warned Mueller that his testimony “must remain within the boundaries of your public report.” Will he provide more answers than questions about evidence pointing to obstruction of justice by the president?

The U.S. House voted on July 17 to kill a new resolution seeking to impeach President Donald Trump for “racist comments that have legitimized and increased fear and hatred of new Americans and people of color […].”

Iowa’s Representatives Abby Finkenauer (IA-01), Dave Loebsack (IA-02), and Cindy Axne (IA-03) were among 137 Democrats who voted to table the resolution (roll call). So did all 194 Republicans present, including Steve King (IA-04), and independent Justin Amash, even though Amash has previously said Trump engaged in impeachable “conduct satisfying all the elements of obstruction of justice.”

Iowa’s first Congressional district will be among the country’s top-targeted U.S. House races next year. Both the Cook Political Report and Sabato’s Crystal Ball rate this district a toss-up, for good reason. Although voter registration numbers slightly favor Democrats, voters in northwest Iowa swung heavily to Donald Trump and to Republicans for down-ballot offices in 2016.

Three Republican candidates have announced plans to challenge first-term U.S. Representative Abby Finkenauer, but at this writing, only State Representative Ashley Hinson appears relevant to the conversation. Thomas Hansen announced his candidacy on May 1, but his first Federal Election Commission filing shows just one donation from the candidate and one expenditure for gas, leaving $18.36 cash on hand. (FEC staff have already dinged Hansen for not filing his campaign’s statement of organization on time.) The third GOP candidate, Darren White, filed a statement of candidacy with the FEC last month but has not filed a July quarterly, indicating that he has not raised or spent any significant sum.

Former U.S. Representative Rod Blum, who lost to Finkenauer in 2018, raised nothing during the second quarter and spent only a token amount to keep campaign e-mail accounts working. Blum paid for some polling during the first quarter and has not ruled out running for Congress again. Republican insiders appear to prefer Hinson, for reasons Bleeding Heartland discussed in detail here.

For the second year in a row, Iowa’s U.S. Senators Chuck Grassley and Joni Ernst voted to advance a budget plan that would require massive cuts to most federal government programs in the coming decade. Senator Rand Paul’s plan was so extreme that only 22 Senate Republicans–less than half the GOP caucus–supported the motion to proceed with considering the legislation.

By not drawing attention to the June 3 vote, Iowa’s senators successfully kept the story out of the news in their home state.

It was another example of a phenomenon Bleeding Heartland has flagged before: if our members of Congress don’t brag about it in a press release or a conference call with reporters, Iowa newspaper readers and television viewers are unlikely ever to learn that it happened.

Iowans awaiting federal flood relief money will have to wait a little longer.

Congressional leaders thought they had a deal to approve $19.1 billion in disaster aid before the Memorial Day recess. The U.S. Senate passed the bill on May 23 by 85 votes to 8. (Senators Chuck Grassley and Joni Ernst both supported the measure and said they’d worked to secure “specific relief for farmers whose grain bins busted because of flooding.”) President Donald Trump was willing to sign the legislation. House passage seemed assured, so most representatives left town for the holiday weekend.

Then a first-term Republican from Texas used a procedural move to hold up the bill on May 24. While most of the blame lies with U.S. Representative Chip Roy and the GOP leaders who failed to dissuade him, top House Democrats should not have put themselves at the mercy of any member of the minority.
