A new bill backed by MidAmerican Energy would devastate the ability of Iowans to install solar panels for their homes or businesses. House Study Bill 185 would undo a longstanding policy of net metering, which “allows residential and commercial customers who generate their own electricity from solar power to feed electricity they do not use back into the grid.”

Iowans served by monopoly providers MidAmerican or Alliant Energy have been able to use net metering since the 1980s, under rules adopted by the Iowa Utilities Board.

In recent years, MidAmerican has periodically sought to subvert net metering in various ways. Environmental advocates have been concerned the policy would become the next target for Republican lawmakers who destroyed Iowa’s decades-old, successful energy-efficiency programs last year at the behest of utility companies.

State Representative Gary Carlson introduced House Study Bill 185 this morning in his capacity as leader of the Iowa House Commerce Committee. MidAmerican’s lobbyist immediately registered in favor–often a sign that an interest group or company had a hand in writing legislation. The utility’s media relations staff did not respond to an inquiry about why the company is pushing this bill.

Across the country, Republicans have tried to win elections by limiting opportunities for Democratic-leaning constituencies to vote. Governor Kim Reynolds stuck to the playbook yesterday when she scheduled the special election in Iowa Senate district 30 for March 19, the only Tuesday during the University of Northern Iowa’s spring break.

Iowa state senators have amended their chamber’s ethics code following a high-profile complaint against Democratic Senator Nate Boulton, which was dismissed late last year.

The new language cover actions occurring outside the capitol building and allows citizens to file a complaint more than three years after an incident. However, the updated code would still lead to dismissal of a complaint like Sharon Wegner’s allegations against Boulton.

Interfaith Alliance of Iowa jumped into the business of protecting Iowa’s fair and impartial courts upon the announcement by the religious right in the summer of 2010 that they intended to unseat three highly qualified Supreme Court justices. They were politicizing the retention elections simply because they were mad the court ruled for the marriage rights of same-sex couples based on equal protections under our constitution.

The thought of a special interest group seeking revenge on our courts for a constitutionally-based and unanimous decision was unprecedented and frightening. Iowans wondered if this was where the division in our country was really taking us? Would extremist, special interest groups actually go after highly qualified justices committed to the constitution and the rule of law as retribution? The answer was yes.

It was impossible to miss the sea of white the Democratic women of the U.S. House wore to the State of the Union address on Tuesday. It was a nod to the suffragettes, who paved the way to winning the right to vote on August 26, 1920, and a celebration of the record-breaking diversity of the 116th United States Congress sworn in on January 23, 2019, almost one hundred years later.

Yet reminders of how far there still is to go echoed throughout the chamber. While President Donald Trump acknowledged the record-breaking number of women legislators elected, it took a moment for the modern-day suffragettes to stand and applaud. His praise was unwelcome, due to his history of misogyny.

Republican lawmakers and Governor Kim Reynolds are poised to give GOP officials and their proxies control over what has been a mostly non-partisan system for choosing Iowa judges since 1962.

Until a couple of months ago, I didn’t realize the Republican trifecta could blow up our judicial selection process in a matter of weeks. The Iowa Constitution spells out how vacancies on the bench are filled, and altering any language in our state’s founding document takes years.

Unfortunately, a time bomb has lurked in Article V, Section 16 for more than five decades. While most elements of the system can be changed only through a constitutional amendment, the manner of forming judicial nominating commissions (half appointed by the governor, half elected by attorneys) is specified only “Until July 4, 1973, and thereafter unless otherwise provided by law.”

Three college guys decided to head to my hometown of Shellsburg, Iowa for a weekend. We threw three bags of dirty laundry in the trunk for my unsuspecting Mom, and we left Pella in Carl’s very used Toyota. In 1977, Toyotas in Iowa were about as rare as a Democrat in Pella. There were some, but they were hard to spot.

Things went fine, until it died. It was not a prolonged death with symptoms. It was sudden. We were three guys with a dead car on a county road outside of Kellogg, Iowa. We knew a lot. After all, we were sophomores in college. Unfortunately, our sophomore smarts didn’t extend to fixing dead Toyotas.

Every Iowa House Republican will likely vote on January 28 to dismiss Democrat Kayla Koether’s contest of the House district 55 election. She trails State Representative Michael Bergan by nine votes according to certified results, but 29 absentee ballots that voters in Winneshiek County mailed on time remain uncounted.

Although Republicans on a special House election contest committee insist “there exists no legal authority to open and count the twenty-nine ballots in question,” they are wrong about the law. Dismissing the contest without allowing Koether to call witnesses, take depositions, or have the ballots opened will open the door to judicial review.

It’s also terrible politics.

On the Iowa House State Government Committee’s agenda for January 22, a presentation by Iowa Public Employees Retirement System (IPERS) CEO Donna Mueller and a special announcement by the committee’s Republican chair Bobby Kaufmann was scheduled for 11:00 am.

Kaufmann had stated at a forum in December, “There will be zero IPERS bills, period. End of story. End of discussion. No tweaks, no changes.” James Q. Lynch from the Cedar Rapids Gazette reported that Kaufmann also plainly stated in his newsletter, “I said it before the election and I will say it again: There will unequivocally not be changes to IPERS.”

There are two main reasons Iowa makes the national political news: (1) The Iowa caucuses, and (2) Congressman Steve King (R, late-1800s). The caucuses operate on a regular, predictable, four-year cycle, while King’s hateful rhetoric runs on its own erratic time table.

Governor Kim Reynolds asked Iowa lawmakers today to start the process of amending the state constitution to remove the lifetime ban on voting by those who have committed “infamous crimes,” which under current law are defined as all felony offenses.

A constitutional amendment would be the best long-term fix for an unfair system that disproportionately affects racial minorities and those lacking the funds to navigate the restoration process. So the Iowa House and Senate should certainly heed the governor’s call. But it’s difficult to get a constitutional amendment through both chambers of the legislature, and the soonest an amendment could be enacted would be November 2022.

Reynolds and state lawmakers can and should take immediate steps to allow tens of thousands of Iowans to participate in this year’s local elections, the 2020 caucuses, and the primary and general elections of 2020 and 2022.

The Iowa Senate convened for its 2019 session on January 14 with 32 Republicans and 18 Democrats. A record eleven senators are women (six Democrats and five Republicans), up from six women in the chamber at the start of the last legislature’s work.

I enclose below details on the majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Iowa Senate committees. Where relevant, I’ve mentioned changes since last year’s legislative session. Note that Democratic Senator Nate Boulton will serve on committees after all. Minority Leader Janet Petersen had declined to assign him to any committees last month.

A few words about demographics: all current state senators are white. To my knowledge, the only African American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa legislature; in 2014, Nathan Blake fell 18 votes short of becoming the first. No Asian American has served in the Iowa Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 Iowa senators include two Smiths (a Democrat and a Republican) and two Taylors (both Democrats). As for first names, there are three Marks, three Zachs, and two men each named Dan, Jim, Tim, Tom, and Jeff.

The Iowa House opened its 2019 session today with 54 Republicans and 46 Democrats. State Representative Michael Bergan was sworn in for a second term, even though his Democratic opponent Kayla Koether is contesting the outcome. A special committee will consider her complaint in the coming weeks.

The new state representatives include 66 men and 34 women (24 Democrats and ten Republicans, record numbers for both parties).

Four African Americans (Democrats Ako Abdul-Samad, Ruth Ann Gaines, Ras Smith, and Phyllis Thede) will serve in the legislature’s lower chamber; the other 96 lawmakers are white. No Latino has ever been elected to the Iowa House, and there has not been an Asian-American member since Swati Dandekar moved up to the state Senate following the 2008 election. Democratic State Representative Liz Bennett is the only out LGBTQ member of the lower chamber. To my knowledge, Abdul-Samad (who is Muslim) is the only lawmaker in either chamber to practice a religion other than Christianity.

“[A]ll of our work has been wiped away,” Iowa Firearms Coalition President Kurt Liske wrote in an e-mail to supporters on the evening of January 13. “Because of the Secretary of State’s complete failure, we must now go back to square one of the constitutional amendment process.”

Pro-gun advocates thought they were halfway toward amending Iowa’s constitution to include expansive language on gun rights, which could invalidate many existing regulations.

But Republican lawmakers will have to start over this year, because Secretary of State Paul Pate dropped the ball.

Iowa Senate Minority Leader Janet Petersen has reversed her decision last month not to assign Senator Nate Boulton to any committees. The day before the Iowa legislature will convene for its 2019 session, Petersen said in a written statement,

The notion of religious freedom — what it is, what it isn’t and what it should be — is being tested here in Iowa.

In April 2017, the Iowa House of Representatives respected my religious rights when I delivered the first atheistic invocation in that body’s history. The Iowa Senate, however, has denied my repeated requests to perform a similar invocation. In so doing, the Senate is not only directly discriminating against me, but also violating the Constitution, which protects all faiths equally.

As shutdowns abound and federal workers around the country continue to celebrate the holidays without their paychecks, the fiscal practices of our state and federal government continue to destabilize economic outlook. Day after day, elected officials in Washington bicker about spending cuts and public expenditures with no end in sight, all from the supposed guardians of fiscal responsibility.

The stories linked below weren’t the most popular pieces to appear on this site during 2018. Some of them weren’t as newsworthy as the work I’m proudest of from last year. But of the 355 posts I wrote for this website in 2018, these ones fueled the fondest memories.

Republicans in Wisconsin and Michigan responded to recent election losses by limiting the powers of some Democratic statewide officials. GOP lawmakers are rumored to be considering similar legislation in Iowa, where Rob Sand just took office as the first Democrat to serve as state auditor in more than 50 years.

But Republican State Representative Bobby Kaufmann, who chairs the Iowa House State Government Committee, told Bleeding Heartland he has no interest in revoking or curtailing the subpoena power of Sand’s office.

The Bleeding Heartland community lost a valued voice this year when Johnson County Supervisor Kurt Friese passed away in October. As Mike Carberry noted in his obituary for his good friend, Kurt had a tremendous amount on his plate, and I was grateful whenever he found time to share his commentaries in this space. His final post here was a thought-provoking look at his own upbringing and past intimate relationships in light of Dr. Christine Blasey Ford’s allegations against Judge Brett Kavanaugh.

Democratic candidate Kayla Koether filed notice late last week that she is contesting the Iowa House district 55 election. According to the certified result following a recount, Republican State Representative Michael Bergan received 6,924 votes to 6,915 for Koether. However, 29 absentee ballots from Winneshiek County were never tallied, even though the U.S. Postal Service confirmed that they were mailed on or before the legal deadline.

Koether had hoped Polk County District Court Judge Scott Beattie would order the disputed ballots to be opened and counted. But on December 20 he dismissed her lawsuit on jurisdictional grounds, saying the state constitution and Iowa Code give the legislative branch–not the courts–power to rule on contests of elections for state House or Senate seats.

A few thoughts on what should happen next, what will happen instead, and what might have happened if Democrats had pursued a different legal strategy.

Iowa Senate Minority Leader Janet Petersen has not assigned State Senator Nate Boulton to serve on any committees during the 2019 legislative session. In a written statement released on December 7, Petersen said, “I will defer making any committee assignments for Senator Boulton until the Senate Ethics Committee completes its ongoing investigation into the complaint filed against him.” In that complaint, filed last month, Sharon Wegner alleged sexual misconduct occurring in 2015, when Boulton was a candidate for the legislature.

Much of the legislature’s work happens in committees, so Petersen’s action will significantly limit Boulton’s ability to influence bills next year.

The move also indicates that Democratic leaders are unlikely to ask Boulton to lead the opposition to high-profile Republican bills during Senate floor debate, as happened several times in 2017 and 2018.

Money couldn’t buy a sixth term for State Representative Peter Cownie. Republicans spent more trying to hold his district than on any other Iowa House race, by far. Nevertheless, Democratic challenger Kristin Sunde defeated Cownie by nearly 1,200 votes in House district 42.

The loss must sting. Cownie would have led the House Ways and Means Committee next year, a powerful position as Republicans in full control of state government plan more tax cuts skewed toward corporations and wealthy people.

But in this season of giving thanks, Cownie can be grateful he will continue to be well-compensated. In contrast, Iowans with career-altering shoulder injuries are experiencing tremendous hardship under a 2017 law Cownie introduced and fast-tracked.

Three-term State Representative Todd Prichard became the new Iowa House minority leader today. Despite suffering a net loss of seats in the upper chamber, Senate Democrats opted last weekend not to change their leadership team.

The largest group of women ever to run for the Iowa legislature has produced the largest contingent of women lawmakers in state history.

For the first time, women will make up more than a third of Iowa House members and a majority of the lower chamber’s Democratic caucus.

The number of women serving in the Iowa Senate will exceed the previous record set in 2013 and 2014. In a major shift from the recent past, the women senators will include almost as many Republicans as Democrats.

Republicans have controlled the Iowa House since 2011 and will continue to set the agenda in the lower chamber for the next two years. However, the GOP majority will shrink from 59-41 to either 54-46 or 53-47, depending on whether one lawmaker’s eight-vote lead holds up.

Few Iowa politics watchers doubt that Democrats will gain ground in the state House today–the only question is how much will the Republican majority shrink.

In contrast, the Iowa Senate landscape could shift in either direction. Republicans now hold 29 seats and are unopposed in Senate district 1, where independent Senator David Johnson is retiring. They are also outspending several Democratic incumbents in districts Donald Trump carried in the last presidential election. Democrats currently hold 20 Senate seats, but they could add to their ranks today, despite a difficult map and a couple of bad breaks over the summer.

Here’s how the key races look going into election day, based on voter registration totals, recent voting history, absentee ballot numbers, and where Democratic or Republican leaders have made large expenditures.

In some states, gerrymandering predetermines the outcome of most legislative races. But many Iowa House and Senate districts are in play every election year, thanks to our non-partisan redistricting system.

Drawing on voter registration totals, recent voting history, absentee ballot numbers, and where Democratic or Republican leaders have made large expenditures, I’ve identified the state House seats most likely to indicate whether Democrats can win control of the lower chamber, where Republicans now enjoy a 59-41 majority.

The districts are grouped in four categories: Democratic-held open seat, Republican-held open seats, Democratic incumbents facing strong challengers, and GOP incumbents facing strong challengers.

I met Jodi Clemens when I was door knocking in the primaries. From the first time of meeting her, I knew she was a special candidate. Since then, we’ve become very close through local organizing and this is why I’m writing this.

I support Jodi Clemens because she will keep her progressive message and doesn’t let anyone scare her away from being strong on issues. She inspires me, as a young woman who wants to eventually run for office herself, and I think she is exactly the kind of candidate we need to be a role model to future elected officials who will run in the future.

Another reason I support Jodi is because she sincerely cares for her friends and community. She stands up for the most vulnerable and lifts their voices up. That is why I encourage everyone in Iowa House district 73 to go vote for Jodi Clemens, because she is a voice for real progress and is a person who you can count on!

Can I introduce you to my friend and co-worker? His name is Jason Moats. Jason is running for Iowa House district 84, left open by retiring Republican State Representative Dave Heaton. This district includes Mount Pleasant, where I live and work.

As was the case two years ago, Democratic candidates are at a financial disadvantage in almost all of the Iowa Senate districts both parties are targeting.

The disparity adds another challenge to a party already facing a difficult path to gaining ground in the upper chamber. Republicans currently hold 29 of the 50 Senate seats and are guaranteed to pick up the district independent Senator David Johnson is vacating.

Five weeks before the general election, the Republican Party of Iowa has begun airing television commercials to promote Senate Majority Leader Jack Whitver and State Senator Julian Garrett.

The advertising suggests that Republican internal polling shows Democrats Amber Gustafson and Vicky Brenner within striking distance in Senate districts 19 and 13, respectively. Democratic internal polling presumably shows competitive races too, since former President Barack Obama included Gustafson and Brenner on his list of Iowa endorsements this week. Only five state legislative candidates made the cut.

Let’s say you are a state senator with strong political aspirations and no moral compass. You can rise to power quickly, if you play your cards correctly. State Senator Charles Schneider (Senate District 22) demonstrated how it pays to sell out your constituents:

On Thursday, September 20, the Iowa Board of Pharmacy moved to dismiss my petition for the religious use of medical cannabidiol, in Olsen v. Board of Pharmacy, No. CVCV056841 (Iowa District Court, Polk County).  The Board says the petition should have been filed with the Iowa legislature instead of the board.

The problem with the board’s position is that the legislature has given the board the duty of recommending changes in the schedules of controlled substances and medical cannabidiol is a controlled substance in Iowa.  There is also an existing exemption for the religious use of peyote, a Schedule 1 controlled substance.  Iowa Code § 124.204(8) (2018).

A New York Times poll of Iowa’s first Congressional district this week found Democratic challenger Abby Finkenauer leading two-term Representative Rod Blum by 51.5 percent to 37 percent. Finkenauer led by double digits in every turnout model the pollsters applied to the raw data. Blum’s favorability of 35 percent was even lower than President Donald Trump’s 39 percent approval rating among respondents.

As national Republican strategists and GOP-aligned advocacy groups write off Blum and election forecasters increasingly view IA-01 as a probable Democratic pickup, I’ve been thinking about how a Blum implosion could affect down-ballot Republicans. With no straight-ticket option for Iowa voters this year, coat-tails may be less important than they were in the past. Nevertheless, it can’t be good for GOP legislative candidates that Finkenauer’s campaign has had field organizers working across the district for at least six months to identify and turn out supporters.

Democrats need a net gain of ten Iowa House seats to win a majority in the lower chamber (currently split 59 R/41 D). At least eight potentially competitive GOP-held state House districts are located within the first Congressional district.

For the first time in living memory, Iowans will not have the option of filling in one oval to vote a straight ticket for a political party in this year’s general election. Republicans eliminated straight-ticket voting here in 2017, as GOP legislators have done in several other states in recent years. The more publicized provisions of Iowa’s new law, on voter ID and signature verification, will benefit Republicans by creating obstacles for eligible voters in groups that tend to favor Democrats (people with lower incomes, college students, racial minorities, and senior citizens).

By contrast, the impact of eliminating straight-ticket voting is less clear. More Iowans filled in the Republican oval than the Democratic one in the 2014 election, the only midterm for which such statistics are available.
